Fifa undermine outdated transfer fee system

Andy Webster’s recent ruling from Fifa has clarified the brave decision he took in resigning from Hearts last year, and has once more changed the nature of football contracts.

The rules now state that a player under the age of 28 can resign from his club once he has completed three years of his contract (not three years after he joined the club). Players over 28 can do the same two years into their contract.

On losing a player in these circumstances, a club will be entitled to a compensation fee from the player, based on his wage. A precedent for this has yet to be established, as Webster failed to follow proper procedures when resigning from Hearts, resulting in his compensation figure being inflated to cover a breach of contract fine and subsequent legal costs.

This ‘get out clause’ is only executable during the 15 days after a clubs’ final league game of the season, at which time later this month, none of Celtic’s first team players will be able to invoke the ruling – a benefit of the churn we have seen since 2005. Maciej Zurawski will then be just a few weeks short of two years into his contract.

The new rules present both threats and opportunities. Clubs will need to be alert to the possibility of losing senior players two years into their contract, something which is likely to increase the frequency of contract renewal, with inevitable pressure on wage costs.

The bargaining position of the selling club will also be affected. The discount we see when a player enters the final 12 months of his contract will, for some senior players in future, take effect 12 months into their new contract.

There will be good value out there for the pioneers this summer, though I cannot help but think we are experiencing the final years of the transfer fee system, a unique and legally doomed obscurity.

    Does it also have implications for transfer fees?

    If the compensation is due from the player will the clubs offer smaller wages to pay off the comp?

    What does Article 17 say?

    Article 17 deals with the compensation that must be paid for a breach of contract, principally but not solely the value remaining on the contract, plus a pro rata sum towards the player's original cost, if applicable. For example, player X, age 25, joins club Y for £6m on a four-year deal in summer 2004, on wages of £50,000 a week. In summer 2007 he can breach his contract by paying his club compensation of £2.6m for the value of his remaining wages, plus £1.5m for the amortised value remaining on his original transfer fee, or a total of £4.1m. Lampard signed a five-year deal in 2004, so can breach this summer for two years' wages, or about £8m. (His original £11m price tag in 2001 has already amortised to zero).

    Gerrard signed a four-year deal in 2005, so could breach in summer 2008 for one year's wages, or about £5m. As a Liverpool youth product, there is no transfer cost to factor in. He is also beyond the cut-off age (23) where Liverpool could claim development costs.

    given the season ends in the 3rd week in May, it would seem that as long as we activate contracts no earlier than the second week of june we should be ok , most of the time......

    ...there is still a danger if our policy was to offer long term..i.e. 4 yrs and over ...but as we don't offer that we seem to be well prepared and well placed to benefit from this....

    ...the biggest opportunity might be in Spain....long term contracts and huge buy out clauses are the norm here......there is a further anomaly in that the Spanish League finishes later than others. So the 15 day rule will take effect when the window is already in full swing....

    maybe there is some merit to the Fernado Torres story....said more in hope than expectation...

    I certainly remember his 1 good season, all those years ago at Forest, lightning short distance speed. But yeah, that was 8yrs ago.

    I read yesterday on the BBC that just before he went to Nottingham he lost his wife and kids in a car crash. Tragic. I would say to carry on and have any kind of football career the man deserves respect, maybe the fast food addiction can be put down to comfort eating.
    Hope he gets a taste for kebabs and deep fried mars bars by the dozen while in Glasgow:)

    One day in the future there will be no transfer fees. If an employee of a football club wishes to resign he will simply put in his contractual notice, like anyone else would do. No compensation or fee is payable if most people decide to leave their job to take up another.

    Quite how this will affect football I don't know. Will players move more frequently? Will rules stopping clubs playing for more than two clubs in a season be seen as restrainet of trade? Would a club sign a player with a history of moving every six months?

    Players already have great power in the market. If a player is unhappy and wants to leave a club it usually happens. Who wants an unhappy player in the dressing roonm? Which club (probably Chelsea apart) can afford to have a major player run out his contract in the reserves?

    Lots of questions but few answers at the moment.

    ...french papers are reporting Rangers offered 60% more than Bordeaux and a 2 year deal against 1 from Bordeaux....

    ...he wasn't seen as a first team player any longer at bordeaux, but was seen as a useful squad backup...

    ....his prefernce was to stay in Bordeaux amd would have accepted less money as long as the contract was for 2 years....

    "Some more info I have recieved from a source deep within Celtic Park, last month I told you the 2 WOW signings were going to be Riquelme and Roy Makaay, I can now say Makaay is 80% done deal, his package is sorted it isup to him now if he wants to play in the SPL. Riquelme is not as clear as itwas, seems to be a stumbling point over whom actually owns him? that's what I was told.

    My mole keeps telling me one Stan Petrov is desperate to come back after a disapointing debut season with Aston Celtic, WGS is not sure if he wants him back £3 mil the figure quoted.     Motherwell have appealed against the red card shown to Scott McDonald during Monday's defeat by Dunfermline.
    It means that the striker could be available to face St Mirren if the Scottish FA's review panel cannot meet to consider the appeal before Saturday.

    The 4-1 defeat pulled Well into the relegation battle with the victorious Pars and Saturday's opponents.

    McDonald would have been suspended for both Motherwell's remaining games had the club not launched an appeal.

    Maurice Malpas's side need a point at least to ensure Scottish Premier League football next season.

    McDonald was sent off for a sliding challenge on Dunfermline's Scott Muirhead late in the game at East End Park.

    The SFA's review panel is almost certain to consider McDonald's case before Motherwell's final match of the season, away to Dundee United a week on Saturday.

    the problem with this ruling will be

    the club it seems pays nothing to the other club for the player, the player compensates the club

    so in theory the club could just pay the player what he has to play the club, problem solved.

    however this is where the problem starts, if they pay the player it will be subject to 40% income tac, which means the figure would have to be vastly inflated to be net what he has to pay the club. this amount may be as high as a fee would of been in the first place

    only benifit would be for gordon brown!

    Apparantly he's good in the air and has a lethal shot from any range. Not scared of a hard tackle and can interogate any defence.

    Evening Times reports that GS will be out for 4/5 days, and that TB will give an update at tomorrow's conferences.

    There seems to be a kerfuffle over the seats damaged at Rugby Park. I was in the Moffat and saw no damage at all. A few stood on seats to get a view of events at the other end, but there was absolutely no wanton damage, or even climbing over at the end. The seats are small-ish and the leg-room for anyone over Sneezy-size is tiny.

    A funnier point regarding seats in stadia is Wembley replacing over 3,000 red seats as they have been found to go pink in the sunshine.

    And a caller to Real Radio - an ex-steward at CP said that some Rangers fans used to turn up with (red, white and blue) Tesco bags and sit on them as they refused to sit on green seats.

    It does seem that the transfer system is going to be somewhat diluted, though once the penny has dropped, clubs will seek to protect their prime assets via annual contract negotiations. That means we'll still see big-money deals for years ahead, at least till some player challenges the fudged compromise of Article 17 before the ECJ.

    There are however some clear winners and losers.

    The big winners - as usual - are players, especially the most sought-after. Total transfer spend is likely to fall, and it's inevitable that part of the savings will go to enhancing players' contracts. At the bottom end of the market, players may suffer as contract terms offer ever-lower degrees of job security, but as a group players will benefit from higher wages.

    Clubs will lose more or less the same amount overall. For each club buying a player, it makes no difference whether the money goes on transfers or wages, but for clubs as a whole there's a big difference. Transfer fees stay (mostly) in the game; wages are gone forever.

    Smaller/selling clubs will suffer disproportionately. Generally speaking, there is a subsidy from larger clubs to smaller ones via the transfer system. As this subsidy decreases over the next few years, existing inequalities should increase. Selling clubs will become relatively less able to attract new talented players and fund their contracts, while at the top end of the market, the big buying clubs will benefit from a reduction in their transfer budgets, only partially offset by higher wage levels.

    Non-EU clubs are the other losers. Article 17 is a mongrel love-child born of the post-Bosman horestrading between football authorities and the EU, but it is a FIFA rule and therefore has worldwide effect. Until now, non-EU clubs could demand premium prices for their top players, even where their wages were low relative to European levels, as the Bosman ruling had no direct effect on them. Expect to see more second-string Brazilian, Argentinian and Ukranian players coming to relatively wealthy EU countries whose work permit rules allow this.

    Overall I'd see Celtic as marginal winners in all of this. On the plus side, we'll be able to pick up squad players from Scottish clubs and elsewhere for small amounts of cash; and overall, our transfer spend should drop (or go further). On the other hand, the really big hitters who we aspire to compete with will move still further ahead of the chasing pack.

    It's all very murky though. I'd guess Celtic's recent 3+1 contract structure had one eye on Article 17, but whether it is effective or not is anybody's guess; there will be a good few more lawyers' fees incurred on this subject before everyone knows where they stand.

    I'm due the same op, a resurfacing which I was told I would be in plaster for 6 weeks after it so how he'll be back in 4/5 days I have no idea he might get out the hospital in that time given the medical support he'll get at home.
    Maybe the idea of bringing it forward is so he can go on the preseason tour.
    I would expect him to be out for 2 months.

    Apparantly Gordon's hip operation was carried out by Jack Bauer using a corkscrew, a bicycle pump and a 2 by 4 wooden plank.
    Seems he's a bit of a physio too is our Jack.
    He'll make a great signing. I doubt he'll take any nonsense from players who are unfocused.

    Yes, I think it must be four or five days hospital. The line given is that he's very much a training ground guy and wants pre-season with the players, which then makes more sense to do it now.

    They also said that he was due to have it after leaving Soton but travelled with his wife, enjoying the football break. Not the reason for leaving Soton.

    My worry for signing Jack Bauer is the work permit thing. If that can be overcome, I'm sure CTU can come to some reciprocal arrangement with us with, say, agent Gravesen going the other way. Galactico, to Celt to Counter Terrorism. It's not exactly your 'stacking shelves in Somerfield' cv.

    The game finished 5-2 for Barça, with the second leg taking place tonight.

    Before the game, Getafe's coach, Berndt Schuster said: "If we come back from this, the fans will burn our stadium to the ground (out of wonderment and joy, you understand). And all those new bridges they've just built in Getafe, they'll burn them down too. They'll burn everything."

    The second half just kicked off. It's currently 2-0 to Getafe. I hope the local fire brigade is on standby.

    Some joined up thinking between football's governing bodies would be welcome.

    On one hand we have Uefa with its egalitarian retoric as espoused by ne President Platini; and on the other we have Fifa setting precedents that will concentrate the power amongst a narrow band of players.

    The way I see it, this ruling will make players even more mercenary at the expense of Clubs.


    We all idolise the players, but ultimately we should learn to trust and back the custodians of our money - the Board.

    I'd like to post a comment about the Scott macdonald appeal thats coming up.Who's to say that it will be heard before the end of the season,They may intentionally hold up the hearing until the closed season, Then add a further four game ban for submitting a frivolous appeal.

    No one gave Getafe a hope. The football federation had already decided to host the final at the Bernabéu and Real Madrid fans had launched a campaign to protest that it was an insult to Real Madrid to hand a cup to Barcelona in their stadium.

    This is tosh. The final is always played at a neutral venue and they try to make it more or less equidistant for both finalists (the other being Seville this year).

    Real Madrid defender Michel Salgado got himself involved by backing the protest. "The one thing you should never do is provoke people," the philosophical full-back mused.

    Now look. They've all provoked Getafe, a tiny team from a dormitory town to the south of Madrid, to achieve one of the greatest results in Spanish football history.

    No one can believe it.

    Schuster was previously coach at Xerez and took them very close to promotion and, I think, on a magnificent cup run, but not as magnificent as this one.

    He was spoken of earlier this year as the man to take over from Fabio Capello at Real Madrid, whom, we all assumed, was certain to be sacked. Now Capello could win the league and may well keep his job. If he wins the league, he will only walk if he wants to.

    Schuster played for Barcelona, Real Madrid and Atlético Madrid. He played in the same Barça team as Diego Maradonna in the early 80s. Contrary to your recollection, he was a very gifted and skillful midfielder and not dirty at all, in spite of being a tall, heavy guy.

    Good news for the fire fighters is that it's pouring with rain in Getafe.

    Thanks a lot for that. As I was reading your post and you mentioned Capello I remembered seeing Schuster in the all white of Real, I knew he'd played for Barca, seems I've done him a disservice on his style of play. Big lad I remember too..hope he doesn't read CQN:)

    I assume Barca had the full team out, or did Rijkard make the classic mistake of resting a few players thinking the tie was in the bag? Did Messi play?

    I usually agree with 99% of what e-tims says when its being serious but in the article posted by Lubo tonight I cant agree with much of what teh voice is saying.

    I know to many people who do not like Gordon and no matter what he delivers they will not like him. And this is not fly by night supporters some of them are 100% home and away bhoys.

    I have even had these guys blame him for the defaeat at the Mothers and us losing the league and now passing it onto buying young mr macdonald not because he is bad but because he scored those goals.

    We must remember that Gordon Does not as yet have 1 of the greatest players ever to play for us.

    I really would love to know what our record over the last 10 years season by season is playing games with and without him.

    After he scored that wonder goal in the first leg, some suggested he would be left out for his own protection, that he would be under severe pressure from the players he had humiliated.

    Berndt Schuster said he was glad Messi wasn't playing, but only because Messi is a special player. He said he had felt a bit sorry for his boys because the entire world had seen 100 times the mugs Messi made of them, but he said they had already got over it.

    Now, of course, everyone is saying: "How could Rijkaard possibly leave Messi out? What a catastrophic mistake."
