Football media rights holders face technology challenges

A raft of rights holders have joined the FA Premier League in their US class action law suit against Youtube and parent company Google (NASDAQ:GOOG) including the Rugby Football League, boxing organisations, music companies, authors and, curiously, the Finnish Football Association.

Youtube represents a challenge to rights holders who will be unable to sell highlight packages if anyone with a PC and broadband can broadcast content.

FA Premier League spokesman, Dan Johnston, said, “The clear and growing message to YouTube and Google is simple: their callous and opportunistic business model is contrary to right, contrary to law, and must and will be stopped.”

I tend to agree.

Defeating a multi-billion dollar corporation like Google is one thing, but staying ahead of the technology might prove impossible for rights holders. Broadband Internet is still in its infancy, but 100mb service, capable of delivering TV quality video already exists in several countries; real-time television on the Internet will be widespread soon.

If you want a peak into the problem, take a look at Slingbox , from Sling Media, a fabulous product which can broadcast a TV signal back out over the Internet in real time.

Business models already exist for selling rights to highly portable content such as music; keep it cheap and some people will pay, though many will not. Few paid when the price was high, and the price to watch football is high.

If the lawyers cannot stop content sharing, the next generation of the Information superhighway will blow a hole in the value of football TV contracts, a business risk which has gone unqualified by those investing in the game.

Football needs to learn how to coexist in the Youtube age, embrace the platform by developing their own channels with an income stream, albeit a small one.

Clubs in the FA Premier League are so highly dependent on rights values they need to get the lawyers involved and hope the technology goes away. Good luck to them. Celtic have little to lose from embracing Internet platforms like Youtube, the Internet is busy with people sharing (stealing) their content, offering no benefit to the club. Get the channel right, price and promote it right and people will buy. Some of them anyway.

    Keep telling it as it is, Paul. As long as I can get to see the Celtic, I'm all for technology. If their TV revenue dries up, a lot of English clubs will be begging us to join them.

    What I can't hack with these web-based media sources is that someone somewhere gets very rich - its then shown as being illegal - yet that person is still very rich after it stops. Does that make any sense?

    I can see a day when bank robbery whilst smoking a joint will be legal..

    killerheels - the opposite is a Happy Clapper! - which I am one of.

    What I find odd is that the happy clappers are pretty well always around the blog whilst the real deep mineshafters only come out mole-like after a poor result.

    Some mineshafters have a great deal to say that makes sense and would well to blog after good results as well.

    I've no sympathy for these big corporations who complain they are losing billions. They derive business models to extract the maximum amount of cash from the masses. Football used to be cheap and easy to go to watch on a Saturday afternoon.
    These corps. changed the rules and want to make the punter pay for the change.
    I don't think any of these companies have made their billions by following the letter of the law, especially in their early days. It's rich of Virgin media complaining about kids pirating/stealing their "content". How exactly did Branson start making his fortune?
    As for Bill Gates.....

    As you state, Paul, if they want to make some money from all of this, these Corps will have to drastically reduce the price. Better to make 1% of billions than 30% of millions.

    Antibes - I thought R. Branson got his dough by having money already (inherited?) and then risking some of it on my fave music man Mike Oldfield. I think he's taken risks to get places and is still doing so. I once shook his hand as I think he's one of the few that I think deserve most of what they get.

    Have to disagree Michael but that is what this blog is so good for, a platform to express our opinions.

    I must have a little more faith in our squad than yourself as i think the current squad is good enough to get through this qualifier, I know some of my previous posts dont exactly convey that thought but that was the frustration of sundays result coming through.

    I think you are correct about the defense though, we do need full back cover, that I agree, but we all know that GS will pick the same defence as played on sunday no matter if a new addition is brought in, unless its a real quality addition, but I doubt it, so we have to get used to this defensive lineup as I believe this is his first choice for this season.

    The problem at the moment is form and confidence. What if the team bang in lets say 4 or 5 on saturday, do you think the form and confidence will rise before the spartak game? i think it will.

    We all have to have some faith in GS at the moment to turn this, granted, recurring malaise around.

    I do though hope that the maloney link is true and will come off before the deadline (is it tonight? I'm starting to get confused on that one myself) as he has the geniune ability to create havoc in defenses and can play killer passes, but if it does not and we get no-one in today that I think the squad we have has the quality to see us through this qualifier, if you look at the squads, I dont know much about their squad, but I bet they recognise a few of ours.

    i think your post, like those involved in the class action are incredibly short sighted.

    you and they fail to see the benefits of seeding part highlights, interviews or compilations on youtube.

    not only can these act as a brand awareness campaign, they can generate interest, promote the channel/network/program and encourage subscription.

    furthermore, you fail to see the massive amounts of money that can be generated through the future pay-per-view youtube/google advertising network.

    rights owners come from a position of strength in that their content is already valued by the youtube consumer.

    Sorry my apologies . Not been able to post again till now. To answer your question I’m not happy with the situation before this CL game but I don’t think that’s for the want of trying to address the problem so I can’t be sure that it’s a lack of planning that’s causing the problem. I accept that negotiations for anything can take a long time unless you have a bottomless pit of cash and money is no object. That’s not the case for us so I prefer to believe that’s the issue and I’m comfortable that we use our money as wisely as we can..

    Really interesting article Paul. The football world is now just starting to confront the same rights issues which counterparts in, firstly, the music industry, and subsequently the film and television industries, have already had to address. I would argue that neither the music nor the film and TV industries have come close to a workable solution yet, as their emphasis on litigation and digital rights management as a way of countering unauthorised downloading fails to acknowledge the fact that such an approach is extremely consumer-unfriendly and always doomed to failure. Each DRM development is quickly cracked (as well as being incredibly inconvenient in this multi-platform age), and suing your customer base is rarely good for the brand.

    The sporting world generally has not needed to confront this issue so quickly, because on the face of it, their core product was not being ripped off in the way that records and films were being downloaded for free on a mass scale. When a few geeks (no offence, geeks) sit in their bedrooms watching, say, an EPL game on their PC, with Japanese commentary and the blurred picture freezing every few seconds, its an irritant for the rights holder, but it does not substantially devalue their product. But if it becomes simple to access a game on your PC with TV quality transmission, a lot of the media rights value is lost.

    I am certain that the lawyers will be unable to solve the problems confronting rights holders (at least not while copyright law remains in its current form, many argue that the entire law needs to be revamped to account for the change in the way that copyright material is now distributed).

    Nobody knows how this is all going to pan out, but what is certain is that new business models or revised versions of old ones, are going to emerge. For example, if I was in the commercial department of, say, a large football club with a massive worldwide support, I’d be looking at websites like Joost and Babelgum, which are still beta testing, but look set to pick up a massive user base in the next couple of years. They allow rights owners to establish their own branded TV channels on their site. Viewing is for free, and the programming is supported by advertising. TV quality transmissions, free viewing, revenue generating, brand enhancing – that’s got to be worth looking at. A lot of the large TV distributors are already cutting deals with them.

    If a company based in a country with relaxed business laws finds a way to offer live games on the www at a cheap rate the take up will be massive.Will Sky and the major investors continue to pour the vast sums of cash into football?

    The football clubs are in bed with the broadcasters. The broadcasters will soon if not already will be getting into bed with the major internet providers. I´m sure Dubaibhoy can confirm how easy it is to control internet content at that level. I dont buy for one minute that these bumkin billionaires that have got into bed with football recently having not already covered that angle.

    unfortunately Paul many of us need to look for less official feeds as the official site doesnt support macintosh. While these in theory are only 5% of the UK market, they almost certainly make up twice this among Scottish Catholic adults as 15 years ago (and possibly still now) Catholic schools all had macs.

    I used to have c67 but they changed it to be non mac friendly and i paid for it for nearly a year as they kept telling me they were working on a solution.

    Then after not having it for a year i found a dodgy link on a football forum that turned out to be a feed from c67 but mac friendly.

    I emailed them to ask if it was possible to use this feed but because of it being posted on forums they were then stopping it and have no intention of supporting macs. Bah!

    The reason why the BBC highlights aren't available overseas is due to the fact that they only have the rights to broadcast them within the UK: outwith these shores, there are other rights holders. I think channel67 has exclusivity in most countries.

    Anyway, this brings up an interesting technical point: is is possible to "fake" your IP address, to make it seem as if you are in a different country? This would circumvent this and would possibly allow people to purchase cheaper content in other countries on the "grey" market.
    (Interestingly enough, although I'm posting this in the UK, blogger has defaulted to German as I work for a Swiss company, with an apparently Swiss IP)

    ...Celtic have made good strides in recent years, but still have a long way to go.....when you cannot access CH 67 video footage via a mac in 2007, then you aren't even making the most of the opportunities available today..

    for new intel macs you should be able to install parallels desktop and use the windows media player for windows but for those of us with powerpc macs the overhead of using virtualpc makes it unworkable.

    Might have to go and get a new macbook....

    please let us know as its the main reason im thinking of a macbook. While i think C67 could have another solution i also think Apple have to see that not having a quicktime equivalent means lots of football websites arent accessible by macs including the uefa site which streams champions league games.

    the solution we are discussing is to use windows on an intel mac. theres 2 ways, either use apples free bootcamp which allows you to install windows and reboot into it which would def work but means rebooting into that .... every time you want to watch football.
    Parallels desktop allows you to install windows on the mac and then with a little speed penalty open them in the mac os.

    That's Thompson just left the club? Massive cut in the wage bill already... I thought he had left a while ago.

    The (young) Celts beat Galway 3-0 with noticable absentees in the form of Gravesen and Jarosik who weren't even on the bench. We only had 4 subs. Hopefully this means movement.

    I'd be dissapointed if we sell McGowan for £100,000 again this season he's been the top scorer by far at any level. He might not be able to do it when the level is upped but surely he deserves the opportunity? Another goal against Galway to add to his two against Finn Harps and goals against Airdrie and Albion Rovers.

    Some action in the transfer market today would cheer me up. Maloney would do, Maldini and I might actually crack a smile!

    Given that they are 3 hours ahead....does this suggest a high noon kick off over here?
    Please someone tell me I'm wrong

    Killerheels - the problem is despite the obvious superiority of the Mac most people use windows on their cheap pc.

    I paid my money for C67 and that is only windows so you have to get some sort of flip4mac download to get it to work in quicktime and I think that is the same problem with the beeb's highlights as well

    I'm tearing my hair out with it all. Good job I've got a mac and a pc at work. Mac for proper stuff the pc is an email box and for watching football highlights!

    I wouldn't have the inclination (or technical expertise for that matter!) to footer about with IP addresses myself, but I'm sure many can/would if the potential gains of free football were enough.

    So, correct me if I'm wrong, but I believe most legal content providers (eg bbc, channel67, skysports.com, uefa.com) exclusively use IP addresses to establish the location of the purchaser. If this is the case, then could they not be on dodgy legal ground by providing content to areas outside their jurisdiction if people start using "fake" IP's?

    It's already been covered, but highlights published on the BBC site isn't available outside the not so United Kingdom.

    I just got Eircom broadband up and going yesterday (I'm in Donegal) and it provides a link, exclusive to Eircom customers, to Setanta Sports with live and archived shows.

    Does anyone else have this service? And if so, can I watch the Falkirk match live on Saturday afternoon? I saw the Full SPL over breakfast this morning.

    I used to subscribe to Channel 67, but quit as soon as the club made the stream unavailable to Mac users. It was December 2005, if memory serves. Anyway, at the time they said that Windows Media Player for Mac wasn't secure, and they wouldn't be providing the service until it was.

    I'm not keen on installing a Windows platform on my Mac (it's about as useful as a chalkboard) so I'm really hoping this Setanta via eircom broadband will show games live.

    most commonly your ISP provide will provide you with a dynamic IP address for your current internet session. This in itself is already pretty difficult for anyone except your ISP provider to track down but not impossible. It would need to take a lot of cooperation between the ISP provider and the content provider to track you down. Having worked for large telecom firms I´d be surprised if any of them would waste their time and money on it unless it was to prove lucrative.

    It is something that is usually more rigourously followed up upon when you are trying to view sites that are illegal. This tends to happen a lot in Arabian countries, North Korea etc ... where the free market and the cost of such infingements are deemed to be the action of someone trying to destabilise the government.

    You getting a dodgy football feed isn´t going to initiate any expensive investigation into your actions. Well not yet anyway but as Paul67 has highlighted the more popular these streams become and they need to be massivley improved upon for that to happen, the more likely these billionaires will want to protect their own interests. It will be their decision however in whether to invest in tracking down terrorists or somebody who has been given a cyber lift over the turnstiles.

    I see this going down a similar path to the music sharing problem that the music industry had.

    Killerheels - yes, slumming it in Antibes....watch the Hoops in a local bar. Lovely.

    As for Branson, I believe he had inherited wealth to start his fledgling business but also had a number of dodgy practices in the early days. (tax evasion, for example). Will need to read his autobiography again to refresh my fading memory.

    He may have had some business "acumen" in his youth, but has had quite a few failed companies since and now only uses others money for his new ventures. No longer a big risk taker, in spite of the hype.

    Looking at things from a different perspective , while I refuse to be negative is that this summers forward planning has been poorly executed.

    Aside from the usual poor preseason , off the park in the boardroom , things havent gone to well in my opinion. Hear me out.

    At this time and moment we're sitting with an overladen squad some "big" players out of favor looking to get rid before we bring in. Seems fine.

    It isnt.

    We knew pre-season we had to strengthen certain areas because we had a champions league qualifier. We strengthened midfield and brought cover for forward line. It is widely known we wanted a quality striker and a few fullbacks. As yet none have materialized.

    Why not?

    Targets not available at the right price?

    We were led to believe we had the cash availible to get what we wanted and be in a position of strength when we did reach CL.

    On my reckoning , over the course of WGS tenure he has had to spend 3.5 Million a year from the coffers after in/outs. This is after transfers out comes of the total net transfer spend.

    Yet , Our nearest rivals are Allegedly skint and can equal in one maybe two transfer window(s). They have spent nearly 10 million this window alone. Whilst we can speculate on their finances , they seem intent to put the money where their mouth is and speculate to accumulate and with the luck of the CL draw it seems they have pulled it off.

    Notwithstanding the quality of player they brought in was poor but it is there to see the strenghened their hand before the CLQ to give themselves that better chance. Whereas we were intent to continue with what we had.

    This to me , is the boards fault for standing still. They've froze. WGS is left to take the can. We will win the league and Boruc is our get-out-of-debt free card if we fail CLQ round but I cant help but wonder if we speculated a little more , which we could afford , we would be in a far better position of strength right now.

    Hopefully someone can make sense of this ramble.

    i hope we get to the champions league and i hope we get rid of our unwanted for at least £5 mill plus.

    this income would leave us with a potential spend of at least £10 mil. somehow i do not see it happening.

    I've always thought that the best final hours signing on the 30th Aug are bosmans. The bigger names are always holding out for big cash big clubs etc, but they can become very easy to deal with when they think they'll be left without a club.

    Please tell me the rumours of Doumbe signing are nonsense? He was nothing special and the if we are indeed trying to sign him after turning him down just a couple of months ago then it really doesn't say much for our scouts.
