Strict liability when playing to gallery

Being responsible is not always easy, especially when it comes to running a football club, where playing to the gallery offers vastly better short-term returns, and no doubt a rush of endorphins.

If your fans are engaged in an activity which regularly brings them to the attention of the courts, and your club into disrepute, it doesn’t matter what you think of the apparent offense.  You may chant an offending song in the shower every morning month, but your only public comment on the matter can be to chastise and urge fans to desist.

Clubs in Scotland voted against what is known as strict liability.  This means they are not held responsible for transgressions by their fans – and who wants to be held responsible for the actions of others who protected from personal liability by hiding in a crowd.

Part of the deal on not having strict liability is that clubs must demonstrate that they take all steps necessary to dissuade and educate their fans from carrying out criminal or regulatory offenses.  It’s simply not possible for club to tell fans their illegal actions were justified, as this would place the club itself in the firing line.

The nonsense following the Scottish Cup final is all background noise as far as we are concerned, but be aware the contagion will spread beyond those you could consider highly dysfunctional operators.

    If you have a chance look at the ages of the victims (Eight of the 17 killed were children. All but one of those killed were Catholics.)

    WC has been dropping these with increasing frequency over that last few weeks,

     

     

    Getting a raging stauner has, in my experience, impacted my ability to walk about in public……..

  11. What Robertson fails to recognise (nor evidently understand) is that the mentality behind the chanting of the BBs, that overwhelming sense of entitlement, superiority and embittered hatred drives the violent response by the Sevco fans.

     

     

    As I recall, some years ago, Wembley stadium was awash with Scottish fans after Scotland had just beaten England. The Scottish fans were ‘sticking it’ to the English fans that day.

     

    I don’t recall the English fans rushing onto the park to fight. If the goading by fans justifies the counter invasion, what happened that day?

     

     

    The goading by the Hibs fans did not cause the violent response by the Sevco fans. It may have precipitated events but the underlying fuel was already smouldering. It was the deep-seated hatred which is constantly fed by the club, media and Scottish society.

     

    The constant condoning of the violent behaviour of the Sevco fans by a compliant media, football and legal authorities through their failure to condemn and punish their actions led to the violent events.

     

    The pitch invasion itself was harmless. It was the respondent counter invasion which was violent.

     

     

    Unfortunately, because the SFA and Police are filled with Sevconian thinkers, they fail to recognise their own part in fuelling the events.

     

     

    Before you can solve a problem, you have to recognise the problem exists. Until Scottish society fully acknowledges the truth of this underlying disease, it will never be addressed and these events will continue to happen.

     

     

    Mr Robertson should have condemned the singing, the Hibs fans invasion, the Sevco fans invasion and most of all, the statements made by his own club which have simply reinforced that sense of entitlement and hatred within the core Sevco support.

     

     

    Thank you Mr Robertson, the next time your club’s supporters go on the rampage you have played your part.
