Strict liability when playing to gallery

Being responsible is not always easy, especially when it comes to running a football club, where playing to the gallery offers vastly better short-term returns, and no doubt a rush of endorphins.

If your fans are engaged in an activity which regularly brings them to the attention of the courts, and your club into disrepute, it doesn’t matter what you think of the apparent offense.  You may chant an offending song in the shower every morning month, but your only public comment on the matter can be to chastise and urge fans to desist.

Clubs in Scotland voted against what is known as strict liability.  This means they are not held responsible for transgressions by their fans – and who wants to be held responsible for the actions of others who protected from personal liability by hiding in a crowd.

Part of the deal on not having strict liability is that clubs must demonstrate that they take all steps necessary to dissuade and educate their fans from carrying out criminal or regulatory offenses.  It’s simply not possible for club to tell fans their illegal actions were justified, as this would place the club itself in the firing line.

The nonsense following the Scottish Cup final is all background noise as far as we are concerned, but be aware the contagion will spread beyond those you could consider highly dysfunctional operators.

    Lying to UEFA will result in a ban for the club and expose the collusion between the SFA and the establishment club. Those involved at Hampden will have to be dragged kicking and screaming from their cosy sinecure and dumped in Mount Florida.

     

    Cue faux outrage from Level 5 and their media placemen.This could get very interesting. The licence application was made by Oldco so nothing to do with Newco you might argue.However Newco signed up to the 5 way agreement, part of which entails Newco accepting any punishments handed down by the football authorities.Of course this single topic on it’s own exposes the continuity sham and the mess that that the SFA has helped create.A possible 3 year ban from UEFA competitions will be a dagger to King’s wallet and Joey Barton’s European aspirations”.

     

     

    I have edited this comment from the previous post to set up an article on the points it raises which I believe are predicated on an article by James Forrest. Mr Forrest refers to an addendum to the TJN article that skewered the SFA. The SFA and SPFL, and a compliant media, would have us believe that the team playing at Ibrox is the original Rangers. These stakeholders in the survival myth have a vested interest in Rangers continued. However when exposed to a court of law the truth emerges.Had the new club qualified for UEFA participation this season, its UEFA coefficient would have been 3.460. 3.460 is the country co-efficient for Scotland and is only used for clubs that have not participated in Europe in the last five seasons.UEFA chose not apply the old Rangers coefficient ranking of 4.960. This is because the rules of UEFA are clear cut and set in stone. The Rangers Football Club now have a different company registration number from the club/company that is being liquidated and any points or rankings gained by the old club were not handed to the new club. 114 titles were handed to TRFC by the SFA/SPFL but UEFA don’t play by the ethereal rules in Scottish football.

     

     

    I therefore do not envisage any punishment being handed down to the new club unless the SFA were foolish enough to press home the myth that they were the same club. Alan McRae, and his nonsense about Charles Green buying the goodwill of RFC Plc, chose to play this card to John Clark of TSFM, before he reverted to playing the man. This bumbling Cove Rangers nonentity would not try this on with UEFA.

     

     

    The other point in the preface refers to CAS. The Court of Arbitration for Sport would only respond to a complaint by a member club. CFC could lead this but won’t. They are happy with the status quo. As I write CFC have sold 34,000 season tickets for the resumption of the Punch & Judy show. They welcome ‘the chase‘.

     

     

    In the TJN addendum, the following point cuts to the thrust of their argument:

     

     

    “The UEFA Investigatory Chamber can ask a compliance audit to be performed on the declarations submitted by any clubs. Should the information submitted by a club be considered as incorrect or misleading, due to overdue amounts being incorrectly disclosed as “deferred” or “in dispute” and/ or being concealed by a club, the case will be automatically referred to the Adjudicatory Chamber for appropriate measures to be taken.”

     

     

    As TJN points out, five of the eleven compliance audits performed during the 2011/12 and 2012/13 seasons were upheld by UEFA due to incorrect or misleading information. The Investigatory Chamber expects full transparency as well as true and accurate declarations from clubs. Therefore, the submission of false or inaccurate information by a club is considered by the Investigatory Chamber as unacceptable behaviour for which harsh sanctions will be imposed.

     

     

    In regard to an overdue payable to be considered as validly “deferred” in accordance with Annex VIII of the Club Licensing and Financial Fair Play Regulations, the debtor must propose a deferral agreement which must be accepted in writing by the creditor before the applicable deadline (i.e. 30 June or 30 September for the monitoring process).During the 2011/2012 and 2012/2013 audits a number of football authorities of various member countries were found to be in breach, although at this point they had not looked at the Scottish FA.

     

     

    In an email from Keith Sharp, Financial Accountant at the SFA to Ken Olverman, the Financial Controller at Rangers, Sharp states that UEFA have verbally indicated that they ‘are satisfied with the submission in respect of Overdue Payables as at 30 June’.

     

     

    This would not have been the official position as it flies in the face of the UEFA rules. The SFA know that they are exposed on this issue but the new Rangers can and will walk away from this.

    Astro 3/4 G pitches arena personal hobby horse of mine- indoor facilities even more so.

     

     

    In Scotland there are about 220 astro pitches ( 3 or 4G. ), Given Grampian is about 10% of the population you would expect 22. There are about 6 with only 1 indoors.

     

     

    Cost is about £650k each…

    England so lucky that they have an embarassment of riches, watching re-run of Scotland last night was …..well let’s just say it was not time well spent.

    JohnJames seems confident Sevco will not be sanctioned, if this were by the SFA he’d be right, but this is UEFA.

     

    Either the SFA admit the continuation lie or sanction Sevco.

    Its very pleasing that a club , AFC Wimbledon set up by fans of the original Wimbledon football club, were promoted today.

     

     

    A victory for the fans of the original club who fought back to have a club they could be part of.

     

     

    While they were a non league club, they played a pre season game against another club built by fans, FC United of Manchester . The trophy they played for had the Jock Stein quote , football without fans is nothing, inscribed on it.

     

     

    I am no liker of Man U or their fans but the FC United of Manchester committee are to be commended for not accepting what happened to Man U when the Glazers took over and then setting up their own club where its supporters and the team are the priority.

    Surely Brendan is going to do us all a favour and sell Effe to Fernebche, really hope so, nothing against the big fella other than he is an out and out liability. Typical would be cruising against Aberdeen, 3 nil up, Charlie M goes off injured Effe comes on – we end up holding on for a 3-2 win. Thats just an example there are many more. For me this is Brendan’s first test, here’s hoping he passes!

    He was a slimeball who never had any attention of signing for Celtic. He met with the Club to see what they would offer him and went straight down the toad to Newcastle and used our offer as his starting position in the talks.

    My situation with the pitches is both how many of them there are but also the lack of indoor facillities — what we have is a monument to over engineering and architectural ego trips..

     

     

    Ravenscraig — Take a bow — Stirling prize awaits.

     

     

    We need more full sized indoor pitches.

     

    One for every Holyrood constituency would be a good start.

     

     

    To have 9 and 11 year olds out playing and training in horizontal rain in November and March is heading towards physical abuse. The club should take a lead on this and help out with facilities in the East End.

     

     

    Club facility — 9 till 4pm.

     

    Community facility — 4pm till 10 / 11pm.

     

    Add in some school use and some other sports.

     

     

    My thoughts are the build cost for the building would be in the region of £5mill.

     

    Add in space for 2/3K seats and it would be a useful all round facility.

  17. Anyone got any idea why Mikey Johnston from the under 17s seems to get no recognition compared to Jack Aitchison? He scored more league goals, he scored more Glasgow Cup goals, and he’s a winger! He’s only a few months older than JA. Got overlooked by the Scotland under 17s. Manager too.

    Mikey Johnston might be a bit slight to make the jump yet, whereas JA is a bit like Wayne Rooney at that age – built like a welterweight. Hopefully in the next couple of seasons.

     

    It’s the Scotland manager that annoys me – is he really not good enough for Scotland? Really?

    Id be sad to see Stubbs go and especially to a smaller club down south.

     

    Always good to have some ex Celts in charge up here, not that they lie down to us or anything but at least he gets his team playing a bit of football and not only that…..he is a very likeable guy and i think it helps our game having men like him about.

     

    Haven’t a clue if he has stuff going on and they will be closer to home but i hoped he would get another season to attempt to guide the Hibees back up without having to try to compete with a team that can only field the team they do because they borrow a million a month to put that team on the park.

     

    Maybe a good time for him to go after being the manager to end their Scottish cup hoodoo though…….legend forever now, whereas those memories may become sullied if he overstays.
