Strict liability when playing to gallery

Being responsible is not always easy, especially when it comes to running a football club, where playing to the gallery offers vastly better short-term returns, and no doubt a rush of endorphins.

If your fans are engaged in an activity which regularly brings them to the attention of the courts, and your club into disrepute, it doesn’t matter what you think of the apparent offense.  You may chant an offending song in the shower every morning month, but your only public comment on the matter can be to chastise and urge fans to desist.

Clubs in Scotland voted against what is known as strict liability.  This means they are not held responsible for transgressions by their fans – and who wants to be held responsible for the actions of others who protected from personal liability by hiding in a crowd.

Part of the deal on not having strict liability is that clubs must demonstrate that they take all steps necessary to dissuade and educate their fans from carrying out criminal or regulatory offenses.  It’s simply not possible for club to tell fans their illegal actions were justified, as this would place the club itself in the firing line.

The nonsense following the Scottish Cup final is all background noise as far as we are concerned, but be aware the contagion will spread beyond those you could consider highly dysfunctional operators.

  1. Herald Group –not sure why they would turn down one of the biggest sport / corruption stories in Scotland when the target is the SFA.

     

     

    I would imagine Dave King would also be happy to see the SFA cleaned out ; King ignoring a snivelling Regan at the post cup final aftermath was pathetic for Regan and showed his contempt for them.

     

     

    Assuming collusion between SFA and the Oldco. Who takes the rap. In the SFA , Ogilvie is gone. Newco , Sevco clean ?

     

     

    It would be interesting to know why the Herald Group would walk away from a ringside seat at the story of the last 4 years.

    No doubt there are some great posters on TSFM, several from this parish both current and erstwhile.

     

     

    They are often thought provoking comments and insights. There is even quality blogs from time to time.

     

     

    But for me, as an heir to RTC it’s a non starter.

     

     

    Canamalar once got a bee in his bonnet (as is his want:) and has manage to achieve more.

     

     

    If you remember our CEO once made a through away comment about The Rangers and Rory Bremner.

     

     

    Well, of course The Rangers put in an official complaint.

     

     

    This was “answered” by a statement from the SFA President – Campbell Ogilvie.

     

     

    Personally I was none too pleased by this statement.

     

     

    I wrote an e-mail to Stewart Regan who graciously replied.

     

     

    Now, I thought his reply deserved a viewing outside CQN…

     

     

    It had his views on CO’s comments

     

     

    It had SR’s views on Oldco/Newco

     

     

    And

     

     

    Most importantly, it confirmed that the SFA had infact used the clause in their Articles of Association, headed – Prohibition of Transfer of Membership.

     

     

    To transfer oldco’s membership to newco.

     

     

    Quite a significant e-mail at the time.

     

     

    Well I tried to post to no avail

     

     

    Tried to register to no avail

     

     

    E-mailed them to no avail

     

     

    Not the slightest bit interested…

     

     

    These chaps seem to run the site for their delectation.

     

     

    Since they have been running the site, I can’t think of a single major exclusive or initiative they’ve taken to further their aims.

     

     

    While all of us could name a dozen sites that have shown more endeavour and edge.

     

     

    I’m not in the business of dissing anyone and as I’ve already said, they have some seriously good contributors, but considering their resources what have they really achieved.

     

     

    And why do they take it upon themselves to look down their noses at those who don’t “fit”…

    Went out for a smoke this morning and the telly’s in the foyer were running a story about a woman taken by a croc in the Northern Territory. She went swimming at night in croc populated waters where a massive crocodilian was observed the previous evening. WHF, Aye, lets get wur dookers on and get in there.

     

     

    That’s as dumb as a hun. Sympathy for her family but FFS, how thick as shit are some people (Note that I’m not singling out thick as shit aussies here), as much as I’d love to.

    Im like you , Im usually a glass half full kinda guy but where res 12 is concerned ..lets just say im very very cautious of getting my hopes up. Way too many times over the past 4 years them and more importantly the SFA seem to wriggle off the hook , nothing seems to stick to them . For the sake of scottish football I hope this finally nails them but I suppose all we can do is hope that justice is finally done .     I think a bit of expectation management is called for here.

     

     

    Remember that Res12 took its first faltering steps in late June 2013 at which time the same club narrative had not reached full maturity. It was therefore never an objective of Res12 to challenge that narrative. It may be an unforeseen consequence, but it was never the aim of Res12.

     

     

    Res12 was trying to use the AGM/PLC route to give Celtic shareholders a means of calling the SFA to account and in doing so set a precedent for other clubs with a similar shareholding structure to do the same. The end game was SFA reform by introducing oversight and accountability leading to fairer governance.

     

     

    I doubt anyone could claim yet that Res12 has made the SFA more accountable. In fact the SFA have strongly resisted attempts to get answers, but Res12 has certainly revealed just how unaccountable the SFA and clubs are and whetted some appetite for reform.

     

     

    It has also revealed one of the main reasons it has not happened sooner – the media do not see it in their interests to support such an aim because the evidence of misgovernance involves supporters of TRFC who form a goodly size of their readership.

     

     

    It is possible that if the TOG recommendation for an SFA review, based in one part on the subject of Res12, the processing of the 2011 UEFA Licence, is realised, that Res12 will have played a part in making the SFA accountable but it is a long way from claiming that it has because.

     

     

    1. UEFA may find reasons not to investigate.

     

     

    2. They may on investigation find that both RFC and SFA followed the rules as UEFA intended.

     

     

    3. They may find RFC didn’t but SFA did or

     

     

    4. both didn’t but in the a latter 3 arrive at a different slap on the wrist sanction.

     

     

    So once the case has gone to UEFA CFCB, Res12 will be done in the sense that responsibilities to the signatories of the Resolution to take it as far as possible have been met in full by the shareholders representatives.

     

     

    The adverts however will hopefully make item 1 above more difficult for UEFA but there is a court case going on that stops the evidence that kept Res12 alive becoming public. There is also the final decision on ebts and it may take the conclusion of both to bring about the aims of Res12, but if the governing bodies look ahead to what may come down the pipe they would be foolish imo to dismiss now what they may not be able to later.
