Absurd Rummenigge, Regan

When Juventus scored in the opening minutes in the away leg of their last 16 Champions League tie last night it felt familiar. It’s just three years since you and I saw them in person do the same thing at the same stage of the competition.

It took Bayern Munich 70 minutes to rebound but we’ve not really recovered from a lapses in a tie which could otherwise have been far closer than the five goal margin it turned into. Getting back onto the same field with the likes of Juventus after Christmas (or even after August) is now the big challenge. It will take some doing.

I liked Karl-Heinz Rummenigge as a player but as a Usurper of Meritocracy he’s falling well down my list. He celebrated both teams after last night’s game before asking how long Uefa would countenance teams like Juventus exiting the competition at this stage? Not only would he like clubs like his get guaranteed entrance to the competition, he feels that elimination in March should is too harsh a consequence for losing.

I’m sure Rummenigge was being deliberately absurd last night. He’s trying to provoke alarm before playing his hand.

John Clark, on Scottish Football Monitor, attended SFA chief executive Stewart Regan’s presentation at Edinburgh University yesterday on values and integrity in football. Mr Clark questioned Mr Regan on whether Rangers failure to pay overdue social taxes in 2011 broke Uefa competition eligibility rules. Clark informs us Regan said he would do “Nothing” if incontrovertible evidence was available that social taxes were unpaid and that debt collectors had been employed.

We have a criminal lack of oversight in Scotland, not just in football.  This attitude would not be possible in London.

The spirit of Jack Warner, Sepp Blatter and so many others is alive and well at Hampden. This is what we’re up against, and remember people, Blame the Victim is the hottest game in town, it doesn’t matter if you don’t know the background, anyone can play.

    If Celtic were officially to blow the whistle on the SFA to Uefa, they would have to enclose a copy of their resignation from Scottish football.

     

     

    Like the support, they either quit the game in Scotland or they support it, even unwillingly.

     

     

    Words of protest are hollow. Only action carries any weight and there is an apparent reluctance on both the club and the support for any direct action.

    Can I just calrify sonething so that it is very clear.

     

     

    There is no legal impediment to Celtic FC or anyone else reporting any of the recent nonesense or the issues raised by Res 12 to UEFA in general or the CFCB in particular. The Rules have been looked at and there is a whole protocol for making representations and complaints which is clear.

     

     

    The very terms of Res 12 requested that the board ultimately go to UEFA through the CFCB and their rules.

     

     

    The whole point of Res 12 was to get the board of the football club to make the complaint to the CFCB — had the resolutioners wanted to complain directly — they would not have had to bother with any resolution at all. They could just have prepared a letter and asked lots of fans, shareholders or people on the street to sign it.

     

     

    The whole point behind Res 12 was that the shareholders concerned were looking for leadership from the club on the issue.

     

     

    Now, some may not like the club being put in the dock like that, and it is undiubtedly true that the real culprit here is the SFA, its policies, its management or lack of it, and its unwillingness to be open frank and forthright.

     

     

    It is the SFA who are the bad guys. There is no doubt about that.

     

     

    On several previous occasions Celtic have said the very threat of going to the CFCB may well bring Regan et al to heel. Further, be very clear, they WANT the report to go to UEFA – stop and think about that.

     

     

    CELTIC WANT A REPORT TO GO TO UEFA — and if it has dire consequences for the SFA then so be it.

     

     

    They just don’t want to sign the letter.

     

     

    By the way there is no correspondence to anyone which is signed “Auldheid Morrisey etc etc” – the correspondence comes from an International firm of solicitors with over 200 partners who have an office in Glasgow.

     

     

    Thus far the individual shareholders represented by that firm are not named but I would point out the following:

     

     

    The letter states that the bona fides of the shareholders and clients concerned can be confirmed by Celtic PLC and their company secretary and the fact that the shareholders had engaged solicitors and were writing to the SFA was written into the official notes of the Celtic AGM which the SFA, and their lawyers, can have access to.

     

     

    Next, a firm of solictors is bound by the rules of the Law Societty of Scotland and other professional standards.

     

     

    In modern life, we see no shortage of “class actions” where lawyers write and claim on behalf of hundreds if not thousands of people at the one time.

     

     

    After the Bhopal disaster, one well known firm of solicitors acted on behalf of over 25,000 claimants. Do you think they named all thos claimants individually in every letter? Similarly for the lawyesr acting on behalf of the shareholders of the Royal Bank who are suing them in America. There are thousands of shareholders involved.

     

     

    However, a professional firm of siloicitors has a geberal mandate to represent a class of shareholders of so instructed by a group claiming to represent those shareholders AND if the solicitors have been given a list of names of those in the group.

     

     

    Res 12 did not, and could not, have made it on the the Celtic PLC AGM agenda in 2013 without being signed up to by a list of shareholders who were checked and authenticated by Celtic PLC – which entity, I would remind you, is a fully paid up constituent member of the SFA.

     

     

    The Company Secretary of Celtic PLC, a solicitor of many years standing and a very good guy I might add, argued vehemently that a professional firm, holding a mandate from shareholders who can and would be authenticated by the company they claimed to hold shares in, need not specify the names and addresses of every single shareholder they represent when writing to another legally qualified person who represents the professional body of which that same coompany forms part and which professional body is accpountable to the member company.

     

     

    Mr Regan’s comments about names etc is professionally very poor in that light.

     

     

    Anyway, the way to deal with all of this is to be as cold, calculated, commercial and professional as possible.

     

     

    That takes leadership — cold hard leadership as opposed to management.

     

     

    There is a difference between the two — and that was a part of the thinking behind Res 12 too.

     

     

    By all means take 3 minutes 36 seconds and have a look – it is worth watching to the end in this instance.

Watching the news there about PM Trudeau’s US visit and the newscaster is reporting from New York, just as she’s signing off a lhad on his cell phone complete with last nike hoops top and Celtic ball cap walks past her oblivious to the cameras. We’re here we’re there we’re everywhere.

     

     

    On that note I took Mrs TT to the movie “Whiskey, Tango Foxtrot” on Monday, she didnae really like it as too much gore and foul language, especially the “c” word.

     

     

    On the plus side, the sara palin impersonator and the Hobbit spend a huge portion of the movie with a Celtic scarf draped round their neck, not just a green and white scarf but one with the name Celtic featuring prominently.

     

     

    Only downside was when Tin Fey complete with said scarf lands at Glasgow Airport, or at least Hollywood’s version, and one of the passengers has the black mass stole on. It was only briefly seen but a WTF moment for me.

     

     

    Don’t know the Tim connection in this movie as Tina Fey has a Greek background, Martin Freeman an English one and the producer Toronto born Lorne Michaels is Jewish.

     

     

    Incidentally, the Hobbit is brilliant in his Scottish role has the accent down pure Glesca, calls one of the others a roger hunt but tells him that it’s in a nice way and then later on after gubbing him says it again bit says it’s not in a nice way this time.

     

     

    He also tells of someone calling him a “feenyin basturt”.

    I paid a nostalgic trip to Cadder last week, on the way to visit my parents’ grave in St.Kentigern’s.

     

     

    I couldn’t get over how well the scheme looked, after all the renovation, painting and reconfiguration of the external look of the flats.

     

     

    I am not exaggerating in saying that it looks even better than when we moved into the brand to flat in 1953.

    Not for the first time on this matter I find myself unsure as to what you’re actually saying: you seem to be trying very hard to criticise the board without actually doing so: you seem to be tiptoeing around.

     

     

    I know you (and the rest of the Res 12 team) have invested a huge amount of time and effort (and possibly money) in this. It would be almost inconceivable that you are not infuriated by the Board’s vacillation, quite possibly lack of moral fibre.

     

     

    Either way, would you care to share what you think would be a proportionate fan/shareholder response to this impasse … ?

    That for me is a plan , and would certainly put the cat among the pigeons . Celtic fc doing nothing is not an option , a stance has got to be taken , or fans of all other clubs are paying to watch a rigged sport . And that’s not for me .     From a very limited experience of employer liability claims, I seem to recall that lawyers have a standard (very short) style of ‘last minute’ letter they issue to employers to flag their client’s right to pursue a claim.

     

     

    I would be surprised if such a letter could not be filed with UEFA, letting them know that Celtic are having a problem with the SFA (which they hope to be able to resolve) and wished to bring this fact to their attention now, to avoid being time barred …
