Appetites wetted, consequence of intimidation

608

For some, short holidays are over. Batteries recharged, appetites wetted. The international break is not the period of worldwide travel and mockery it is for others. If you think you are champing at the bit to get to Celtic Park on Saturday, Scott Brown and Kolo Toure could probably sprint there from Lennoxtown right now.

For others it will be a chance to put disappointments behind them. A few (well, maybe just Moussa) will return having achieved new heights for their country. As ever, Tom Rogic will pitch with jetlag having played in two continents in the last six days.

You know they will all want to see and impress Brendan. This is the way of it at Lennoxtown right now. They are bursting a gut at training to get into the team. Be alarmed, Motherwell.

You know when your PR is on nationwide TV, intemperate and pointy, that you are in special hands. Asking the same question four different ways lacks courtesy (and a whole lot more), but PR can’t let the journo leave knowing he’s got what he wanted from the encounter. I’m no PR expert, but you know when you see someone mis-control a proverbial back pass.

Still angry at that newspaper’s attack on Celtic yesterday. I didn’t buy it, so didn’t realise at the time they printed Peter Lawwell’s home address. You know what you are doing when you publish someone’s home address.  It rarely happens because the consequences are so uncontrollable.

It’s one of the most insidious acts legally possible by a newspaper. It has an immediate consequence of intimidation for the family – that’s a given when you make the decision to print something several hundred thousand times.  Utterly deplorable.  We are back in the era where attacks were incited on Neil Lennon.

Apologies for issues accessing the blog recently.  I’m on the case.

One thing puzzling me and, perhaps, someone can provide an answer. If the responsibility for issuing safety certificates for football stadia within Glasgow is the responsibility of Glasgow City Council and it relies on reports provided by the clubs, can the council absolve itself from any liability if any structural fault results in injury to a spectator or does vicarious liability pertain? Or, is any resultant claim to be made solely to the club which may be in liquidation. HH

The Structural Engineer who signs it off is responsible

Thank you for foe enlightening me on the matter of culpability. Presumably the structural engineer has public liability etc insurance. Hopefully it is never needed. HH

Fine, fine words in your submission on the repeal of the OBaF Act.

Sadly, another 4 Tims were lifted from their beds at 5:30am this morning. Our general feeling is that this is the worst, and most aggressive, the authorities have been since the Act’s inception.

Hopefully, it’s a result of realisation that this is the end of this insidious piece of legislation.

Hugh McIlvanney’s reputation as a top journalist was well earned over a long career.

However, his silence over the true state of Scottish football governance in the past few years, tarnish that reputation.

That he pronounces on the decline in the game and the dearth of talent therein, while the corruption oozes from Hampden, ill serves his legacy.

There is no excuse for him, unless there is some publicized injunction, barring comment.

Bobby Evans was a great player and servant of Celtic.

There were rumours of possible police action against him, which may or may not have precipitated his transfer to Chelsea.

It was said at the time that due to his service to Scottish football, in a Scotland jersey, he was offered the opportunity to leave the country for England.

He became a forgotten man at Parkhead thereafter, until shortly before his death, when he was welcomed back into the fold.

As a player, he gave us everything and should be remembered for that.

Condolences to Minx on her loss.

A structural engineer is responsible for the design (pre-construction) and the physical integrity of buildings and other support structures once in use.

They ensure buildings and other structures meet building/design standards and that they remain stable and secure throughout their use. Design and/or survey is undertaken to ensure that ‘said structure’ is not subject to; collapse (full or partial) and any excessive; vibration/deflection/rotation which may lead to collapse.

Design calculations, loads, choice of materials and method statements (assembly) are all part of the remit. Plus as designers/practitioners – liability insurance!

Thanks for information. I take it that for an annual safety certificate to be issued by the local council there has to be an inspection by a structural engineer who may, or may not, be the structural engineer of the firm which built any part of the stadium.

If I am correct in this assumption I think that councils should be adopting a more hands-on approach and arrange their own inspections. Just my opinion though. HH

Thank you. I was thinking more of insurance to pay out claims in the event of injury if the inspection of the buiding failed to spot/highlight any defect/ deterioration which later caused personal injury to a third party e.g. a spectator.

  12. There is delude, thick, desperate, you name it, clutching at straws FFS, you would honestly think they would be better off trying to sort the probs they have.

This was lifted from SoS Facebook page this morning.

“Imagine this scenario. You get a cheap bit of land next to your house that due to a bent valuation and a dodgy discount, you buy for a fraction of the true market value.

The next day you borrow against your new piece of land the full market value of the land at a discounted interest rate as you’ve a pal at the bank.

Your dastardly plan is to wait until the pre determined date is reached where you can’t have any of your dodgy land discount revoked and sell it for its true value and payoff the discounted loan that you’ve benefited from for those years.

Great idea as you can live off the proceeds of the loan for a while and live the life you’d normally not be able to afford.

So for a few years you live off the riches you shouldn’t have had in the first place and you take the moral high ground as your neighbours suffer due to criminals taking over their property and ripping your neighbours off.

Things are going great until two things happen

    1) the guys that arranged the dodgy discount start getting suspended from their work and there an investigation meaning you can’t sell the land next your house and may get penalised for the deal.

    2) your mates bank that provided the loan at discounted rates that you expected to pay off once you sold the land that you can no longer sell get taken over. The new bank that you owe the money to decide the loan terms aren’t great and want paid back the cash they lent you.

The proverbial is going to hit the fan

I’m glad it’s not the Rangers that done that deal.”

If you are looking in,thanks for the info on West Calder , I went along last week to view the house and found out that the estate hadn’t even been built yet ! ! !

Not a brick had seen the light of day. Seemingly building work will start in February

As I was going into Edinburgh I decided to stop in East Calder,There was a social club in the village-East Calder Homing Association.A poor man’s Shettleston Juniors club was the first impression. Managed to buy a pint even though I looked suspicious as I had two eyes, two ears and one nose. Turned round on purchasing my pint to see several framed “football” jerseys on the wall. There was a hearts-there was a Hibs-there was a Livingston, in fact there were two Livingston jerseys and there was a raingers 1872-2012 but no sign of the famous Glasgow Celtic. So with all due respect to Shettleston Juniors and any stray tims who happen to live in this town I would advise all to give it a miss.

  15. Thought a fair bit about why the daily rectum would publish PL’s address.

If you got the rectum into a conversation about why they did it, can you think of a reason why it would be relevant to do so?

Can you think of a question that would give the rectum a reason to print his address, cos I can’t.

If you’re a crazy terrorist/fundamentalist guy then his address would be fairly easy to find.

If your wee rab who stays within a £10 taxi fare away from PL and has neither the knowledge/tools or motivation to look for his address then its a fair excuse to go out there and cause trouble for the guy and his family.

My Celtic fan mate reckoned they would shit on his heated driveway cos that would be funny to watch it cook. I reckoned that if they got past his security that would be the last thing on their minds.

The only reason the rectum printed that address is so when wee rab gets full of beer etc they will then be able to rock up to the guys house and threaten him and his family.

There can be no other reason,

There will be insurance in place, but the insurance will have conditions, like a satisfactory Structural report. Any incident would be investigated and Liability will be apportioned dependent on the investigation, there are many directions this can take, from Company blame to personal blame, or an act of god, there may be no blame on anyone although this is unlikely, usually someone has messed up. If I was doing the report and followed Company procedures fully the procedures and who developed them could be responsible, if I cut a corner or ignored something I could be responsible, it would get very complex and legal as you can imagine.

The original S/Engrs would’ve been subject to a ‘defects’ liability period (minimum 7 years) – however external factors are always in-built (on a flood plane/ edge of a volcano etc – routine to extreme).

The ‘Building’ Insurers then call the shots re: surveys – often influenced by value of property/ location/ type of use/ historical value etc., etc. That Certification and the Insurance Report usually form the basis of the ‘Operational’ Licence granted by GCC (subject to ‘Entertainment’ type use – usual; entrances/exits, emergency exits, toilets, stewarding per number of audience/fans).

GCC don’t have the manpower (doubtful they’ve got the expertise) to carry-out independent structural audits – they rely on the auditor being an ISE Member).

It should be noted that a S/Engrs survey is normally prepared by; a full S/Engr Member, calculations by a S/Engr Technician and Certification approved/signed-off by a Senior Partner – all covered by a ‘bolts & braces’ Liability Policy.

GCC may well be – between a ‘rock & hard place’ on this one!

Ultimately someone is always responsible, GCC need to have followed their procedures as well, if that means they inspect everything then they must, if it means they rely on a Certified Engineers report then they must rely on that and the responsibility gets passed on.
