Assault. With a bomb.

245

After an Edinburgh jury found Neil Lennon’s attacker at Tynecastle last season not guilty of assault no one will be surprised that Lord Turnbull has today advised the jury there was insufficient evidence to prove two accused intended to murder Neil Lennon, Paul McBride and former MSP Trish Godman.

The two will now face the reduced charge of plotting to assault their victims.  With a bomb.  Perhaps a world first.

The Celtic manager gave evidence at the trial earlier this month before carrying the coffin of his friend and fellow target Paul McBride, who died suddenly of natural causes.  The SFA yesterday wrote to Neil Lennon for the third time in 10 days concerning refereeing comments he made.

My advice to Mr Ogilvie and Mr Regan at the SFA is that they fill their boots while they can.  Neil will be free of these stresses soon and no longer be such a vulnerable target for the Association to gorge on like a bitter pack of rabid dogs.

  1. The original prosecution case seemed to be that the non viability of the device didn’t matter because they thought that it was viable and therefore had the criminal intention – the guilty mind. I’m sure someone knows the Latin phrase.

It seems now that they have been shown by the experts that it wasn’t viable their defence is simply that they knew that all along. (Go on, prove we didn’t.)

  2. Terrorism Act 2000:

    Section 1. –

    (1) In this Act “terrorism” means the use or threat of action where-

    (a) the action falls within subsection (2),

    (b) the use or threat is designed to influence the government [or an international governmental organisation][2] or to intimidate the public or a section of the public, and

    (c) the use or threat is made for the purpose of advancing a political, religious [, racial][3] or ideological cause.

    (2) Action falls within this subsection if it-

    (a) involves serious violence against a person,

    (b) involves serious damage to property,

    (c) endangers a person’s life, other than that of the person committing the action,

    (d) creates a serious risk to the health or safety of the public or a section of the public, or

    (e) is designed seriously to interfere with or seriously to disrupt an electronic system.

    (3) The use or threat of action falling within subsection (2) which involves the use of firearms or explosives is terrorism whether or not subsection (1)(b) is satisfied.

    Why does this not apply?

  3. Paul67 that’s shocking! Scottish law is an ass, in full view of the worlds media and tv audience a live assault on NL where the perpetrator was found not guilty, incompetent fools, the same law opinion reduces those on an attempted murder charge to assault, what on earth must the worldwide community think of these muppets.

“Everyone close to Rangers Football Club knows that I am, and always have been, totally committed to the Club and that remains my position. As Chief Executive and part of the Independent Board, our job was to assess and highlight to all stakeholders if we believed there was uncertainty over the future financial viability of the Club under new ownership. Unfortunately, the Independent Board had no legal power to block the transaction and Sir David Murray made it plain that he wanted to sell.

“I personally strongly recommended on more than one occasion that Craig Whyte should not be allowed to buy the Club, based on investigations into the transparency of his background and the responses to the questions asked of him as part of the process. Unfortunately that forceful representation was not accepted and when he took over I was suspended and my contract ripped up. With what has subsequently transpired, it is quite obvious why he disposed of me in the manner he did. I was further vilified in the press and continue to be subjected to endless rumours and attacks.

“Events have moved on and the damage inflicted on Rangers Football Club is shocking. I had no option but to pursue a claim based on Craig Whyte’s actions; the litigation was a response to his actions and not those of Rangers Football Club. I firmly believed it was important to make sure he would have to explain everything he did in a Court of Law. Because of the legal process it has not been possible or appropriate to make public comment, which has been extremely hard given the flow of misinformation and falsehoods both myself and the Club had been subjected to.

“In the two years since the Board restructure in August 2009 and prior to Craig Whyte forcing my removal from the Club, turnover had increased, operating costs reduced with net debt more than halved from £31.1m at 30th June 2009 to £14.1m at the 30th June 2011, while the Club had won three consecutive League titles in difficult circumstances. This debt reduction was beyond the targets set by the Bank.

“In light of the Club’s current position I instructed my lawyers to advise the Administrators that I am willing to discontinue the legal action and, subject to recovering the costs associated as a result of this action, I will give over to the Administrators the remainder of the money that was arrested as part of my case in an effort to help the Club.

“I always have done, and will continue to do, everything I can to help the Club in these difficult times.”

Martin Bain …. EBT No. 1690

A suspicious package sent to former MSP Trish Godman’s constituency office could have exploded under the correct circumstances, a court has heard.

Royal Navy bomb disposal expert Chief Petty Officer Lee Yates told the High Court in Glasgow that a liquid inside a plastic bottle within the package had tested positive for the explosive substance tri-acetone tri-peroxide (TATP).

He said the liquid would normally be ignited with a power source such as a battery, but said it could have been triggered by light energy as the envelope was pulled open.

Mr Yates was giving evidence at the trial of Trevor Muirhead, 43, and Neil McKenzie, 42, who deny plotting to murder Celtic manager Neil Lennon, as well as Ms Godman and lawyer Paul McBride QC, who are both supporters of the club, by sending improvised explosive devices to them.

The court heard that prior to the incident, Ms Godman, who was the Labour MSP for the West Renfrewshire constituency, had worn a Celtic top to the Scottish Parliament as a “dare for charity” on the final day before Holyrood was due to dissolve pending the election which followed in May last year.

A package delivered to her office in Bridge of Weir, Renfrewshire, on Monday March 28 sparked the evacuation of the building.

Mr Yates, 48, was asked by advocate depute Tim Niven-Smith if the device had the “general appearance” of an improvised explosive device, to which he replied: “Absolutely. Anyone opening that envelope would get quite a fright I would think.”

He went on: “It could have been part of a learning curve. It possibly could have been developed further if it had been allowed to go on. TATP usually comes in crystal format, like sugar.

“It is much more potent like this, putting it through the postal system in that state – it is unlikely it would reach its intended destination. Liquid is added to TATP to make it more stable.

“If it functioned in the way it was intended it could cause serious injury or even death, particularly because it contained nails which would act as shrapnel.”

  7. An interesting day ahead on the BTC … another document has appeared… which confirms that there is not one shred of defence in the EBT case.

    Game over on that front

  8. Hi Paul et al.

Hardly been on the past fortnight for a variety of reasons.

I then come back to this and feel sick to the pit of my stomach.

On Sunday, Celtic Park will rise to acclaim a man of incredible strength, courage and determination. A man who has been unshakeable in the face of outrageous intimidation. A man who is an inspiration to us all.

Is he without fault? Of course not, as none are. Is he the greatest Manager in Celtic’s History? No, not yet at least. However, has there ever been a finer Man in charge at Celtic? Have we ever had a stronger character at the helm? Not that I’ve experienced in my 43 years.

We are all fiercely proud of our wonderful Football Club. We are proud of its traditions, its values and everything it stands for. In our current Manager we have someone who will be revered however long our Club exists.

Courage in the face of adversity.

Speaking out for what is right.

Delaing with incredible provocation with a real DIGNITY.

Last season The Green Brigade would mark the 18th minute of every game with applause and chants in support of our Manager. I hope this is re-introduced this weekend, for longer than one minute but with that 18th minute being the focal point. I hope it is replicated at every Celtic game for however long Neil is our Manager.

Neil Francis Lennon, I salute you. We salute you. I am so proud that you are Manager of our beloved Celtic. Shoulder to Shoulder. You will Never Walk Alone.

can you explain to me how evidence is still being presented never mind further evidence ?

I thought that the case was concluded and that the judges had retired to deliberate on their verdict over the next two month (from Jan 2012) while analysing the presented evidence.

How can new evidence come to the fore ?

Neil Lennon is second only to Brother Walfrid on the history of Celtic. No other player/manager/club official in the history of world football has withstood this level of terrorism – thats what this is. He is in my opinion now Celtics greatest player and greatest manager. His greatness is not based on ability but what he has taken for our club. When we win the league this our greatest achievement outwith The European Cup.

  13. loose lips sink ships……could the RFFF be in cohoots with yorkston all the time? RFFF are actually buying tickets for Dunfermline games, not giving cash so not to break admin rules? Just a thought( from a good source)

We cannot let Neil walk away, if he must go( and who can blame him). He must be carried shoulder high around CP with both league and cup trophies. Then we turn the lights off and go with him to a football heaven.

    God Bless Neil Francis Lennon.

Brian Kennedy has told BBC Scotland he fears Rangers’ administrators are taking too long in finding a buyer for the club.

The Sale Sharks owner made his offer for the club almost two weeks ago along with four others, and now wants Duff and Phelps to speed up the process.

“It’s now time for them to crystalise the quality of the offers received and move forward,” he said.

Duff and Phelps want a new owner in place by the summer.

Kennedy added: “We should be looking at moving forward with one party from early next week in order to formulate a CVA.”

“There is much to do in order to get ready for the new season and getting the club out of administration as soon as possible is the only way to get things started.

“I’m in pretty much daily contact with the administrators but it’s now time to make a choice and move the club forward.”

Rangers’ administrator aims to have new owners in place by the end of the season after receiving a fifth bid for the club.

Duff and Phelps has received an offer from a Singapore-based consortium.

Kennedy, former Rangers director Paul Murray’s Blue Knights consortium, United States-based Club 9 Sports and a UK-based consortium had already indicated their interest before the latest approach from Singapore.

BTW,the latest development in the NL bomb case is a disgrace.

Even with my tinfoil helmet on,I didn’t think the JUDGE would affectively drop the case.

I could see a jury of Scots finding them not guilty, but not a bloody judge, ffs!

Rangers will lose The Big Tax Case if Hector can prove that the relevant EBTs were administered wrongly. If Hector has the necessary evidence of malpractice Rangers lose , if Hector doesn’t have the necessary evidence then Rangers win.

The fact that Rangers have tried to settle with Hector suggests that Rangers believe that Hector has evidence that the relevant EBTs were administered wrongly .

Rangers and the recipients of the relevant EBTs will know if those EBTs were kosher [or not ]

  21. Interesting that Paul McBride seemed happy with the charges (presumably he was asked). Looks to me like Findlay has got the better of the PF. As Paul67 says, assault with a bomb, a world first. Utter tosh. Let’s hope this makes the national news and the legal profession are sufficiently upset at this happening to one of their own that they highlight the scandal that it is.
