Assault. With a bomb.

After an Edinburgh jury found Neil Lennon’s attacker at Tynecastle last season not guilty of assault no one will be surprised that Lord Turnbull has today advised the jury there was insufficient evidence to prove two accused intended to murder Neil Lennon, Paul McBride and former MSP Trish Godman.

The two will now face the reduced charge of plotting to assault their victims.  With a bomb.  Perhaps a world first.

The Celtic manager gave evidence at the trial earlier this month before carrying the coffin of his friend and fellow target Paul McBride, who died suddenly of natural causes.  The SFA yesterday wrote to Neil Lennon for the third time in 10 days concerning refereeing comments he made.

My advice to Mr Ogilvie and Mr Regan at the SFA is that they fill their boots while they can.  Neil will be free of these stresses soon and no longer be such a vulnerable target for the Association to gorge on like a bitter pack of rabid dogs.

    Brian Kennedy believes Rangers’ administrators need to get a move on and find a buyer for the Ibrox club.

     

     

    The Sale Sharks owner made his offer for the ailing Scottish champions almost two weeks ago and now wants administrators Duff and Phelps to speed up the process in order for the club to be ready for the challenges of next season.

     

     

    Kennedy said: “They need to get a move on, time is pressing on.

     

     

    “I am pretty much speaking to the administrators on a daily basis, but I am not unique in that, the other bidders are too.

     

     

    “But for the sake of the club we need to move forward.

     

     

    “Contracts need to be sorted out, the club needs to know who is going to be playing next season and needs to ensure it has a good, competitive team.”

     

     

    Duff and Phelps hope to name a preferred bidder, possibly next week, after recently receiving a fifth offer for the club from a Singapore-based consortium

    As for talk of bhoycotts…

     

     

    Any action/non action really needs to be 100%, regardless of whatever it is.

     

     

    Any half hearted action by some fans will just send the wrong message.

     

     

    Personally, (and I can’t attend the games anyway) I would only want the fans to do what Neil Lennon and the team would want from the fans in the away games. He always speaks of how magnificent they are at away games.

  13. It is true, every1 would have to agree to it. I’m sure Celtic would arrange beam backs therefore OUR club and no1 else’s profits. I know the players and our manager love the away fans for all we do, but can we really justify keeping the other clubs going when all they keep trying to do is bring us down??

    When it deals with civil matters emanating from Scotland it is always presided over by a Scottish judge, currently Lord Hope, who writes all his judgements, whether it’s a Scottish, English or whatever case in his home in Edinburgh’s New Town. Which is in Scotland.

  20. I really think the prosecution service has a lot to answer for in recent cases where Neil Lennon has been the victim because they are pushing for charges that they must know have little chance of being proven based on the evidence they have.

     

     

    When he was assaulted at Tynecastle they would never have proven that the assault was motivated by religious hatred, regardless of what was said by the assailant, unless the guy had a some kind of history of similar or had evidence in his house (eg some kind of documented anti-catholic ranting). So why did they insist on pursuing this charge and not simply one of common assault?

     

     

    I’m afraid I think this is similar. If the ‘assaulters’ knew that the device wasn’t viable and never intended it to be so but their intention was to threaten the recipient, then again, how would they ever prove attempted murder.

     

     

    I have perhaps a little devils advovate going on here, but if the judge and jury are presented with a charge and evidence, and the evidence doesn’t support the charge what are they to do? Do we blame the judge or do we blame the prosecution for not bringing the severest charge that’s actually supported by the evidence?

    I know I have argued this point on here before (re the aquittal of Worlds End murder accused, by Lord Clark in 2007), but I will state it again. It is not for the Judge to decide what is fact in the case, that role is reserved for the Jury. I doubt very much if any reasonable person would ever cite Lord Turnbull as an expert on explosives, or even in my opinion the Explosives Act (1861, 1883 etcetera) although he did play a role in the prosecution of the Lockerbie bombing accused, a case which, handily for the Scottish legal system, did away with the Jury altogether. In usurping the role of the Jury however, he has, in my opinion, like Lord Clark before him, acted ultra vires. He has also, in my opinion misinterpreted the definition, under Scots Law, of that which constitutes murder, or in this case attempted murder, either that or he has ignored it altogether. Further evidence then (which Lord Turnbull will not be able to discount) that the reputation of the Scottish legal system is one of complete disarray.
