Back to the Future, when Celtic needed a fan to write a big cheque

It was Back to the Future on Saturday afternoon, listening to Aberdeen rescue a point against Dundee was more like 1985 than 2015.  TV highlights suggest Aberdeen pounded Dundee, but three excellent goals were enough for the visitors to set the stage for Celtic to return to the top of the league against Motherwell on Wednesday.

Aberdeen have been imperious in recent months.  Incredibly, apart from Dundee and Celtic, they have failed to keep a clean sheet only once (at drubbing at Hamilton) since September.  That’s title challenging form in any language.

This run is unlikely to endure as the vagaries of form and fortune catch them up, but it appears our long wait for a notional title rival looks to be over.  Which is good.

Any business with operating expenses in the region of £33m a year, which is £2.75m a month or just over £600k a week, that had to borrow £500k in the first week of the month in order to pay an unexpected tax bill of the same magnitude, will by now be in urgent need of funds to pay rates, other tax liabilities, electricity and gas (no matter how little they used on Friday), while wages day is approaching.  And remember, those gardens don’t ‘duty’ themselves.

Newco Rangers will need a loan, or to sell a player for cash, to avoid imminently slipping into insolvency.  If Dave King is confident about carrying shareholders at a March EGM, and has the resources, he should loan the club money to get them through the next two months, no strings attached.  A bit like John Keane did for Celtic in 1994.  With insolvency looming, Keane, currently a Celtic director, but at the time an agitator for boardroom change, wrote a seven figure cheque, no strings attached, to pay-down Celtic’s overdraft, as the Bank of Scotland threatened to call in administrators.

Anything less than this is playing into the hands of Mike Ashley.

    When viewed from the intended spirit both King and Murray fail a fit and proper assessment.

     

     

    I can only concluded they are either:

     

     

    a) Idiots.

    b) Have already been advised there is no issue.

     

    Or

     

    C) Have no intention of becoming directors but are using the suggestion as a negotiating position.

     

     

    I wonder how many other rules have been updated recently to cover future scenarios.

    How much more inflamed can presenting a penant make what will already be a hate filled atmosphere? I see no reason to treat this new club differently to any other club we have met for the first time. Celtic welcoming a new club into the fold should be seen as a positive only rabid Huns would see it differently.

    I’m sure I read they had a ‘meeting’ when MA suggested he was going to but 29% of the shares and the SFA said “but you promised us ye widnae buy more than 10% so ye did”

     

     

    Of course MA didny actually turn up as this is a petty cash job for the underlings to mop up.

     

     

    There’s another meeting next week when MA tells the SFA what to do.

  24. Can anyone tell me whether there’s an election coming up this year? I think I might have heard something about it but don’t know for sure. Maybe if I stay tuned to CQN I’ll find out and possibly even be swayed as to which way to vote because this is the only place I’d come to for that kind of advice. Thanks.

    I suspect they were just plain old panicking, and thought it would be a good idea if their definitions mapped directly to those used by the SPL (at that time).

     

     

    The problem they face is a linguistic one, bound up in the problems caused by the historical customs of football being brought into the modern commercial age.

     

     

    The problem is the word “club”. For all that they desperately want (and need) a workable definition of it, they’re using the wrong word.

     

     

    ‘Clubs’ were originally unincorporated associations, people of like minds, drawn together – in this case – to play football. Each ‘club’ joined the SFA, and the SFA in turn recognised each with membership. A certificate of membership or other formal acknowledgement would be issued in the name of the ‘club’.

     

     

    As commerce and contract law became more commonly part of the football environment, the clubs in turn incorporated into limited companies, typically transferring their assets and obligations into the new company, while the club members became shareholders in the new entity.

     

     

    Meanwhile the SFA itself incorporated, but continued to refer to the relevant members as the original ‘clubs’.

     

     

    At a point in time, it became apparent that the SFA had very few members that had a legal personality – they were all either unincorporated associations, or they had become incorporated but their membership was not adapted accordingly. As the era of TV money dawned, so it dawned on the administrators that there was a fundamental problem in the contractual status of its membership:

     

     

    The members of the few remaining unincorporated associations were unlimitedly and personally liable for all obligations; While the noted members who had since incorporated did not legally exist and thus could not contract at all.

     

     

    The SFA resolved by issuing a membership to the legal entity on the one hand, and limiting the level at which unincorporated members could play. New certificates of membership were issued, this time noting the legal entity.

     

     

    This accelerated with the implementation of quality processes in football, such that for example for UEFA, a competing ‘club’ was and remains defined as the legal entity responsible for the competing football team.

     

     

    At SFA, there were (and remain) a number of members which retain their original unincorporated status – the Scottish Football League was one for example, and my own ‘club’ East Kilbride FC is another – but for all members who incorporated their ‘club’ the membership of SFA was and is held by the legal entity.

     

     

    The member of the SFA, permitted and licensed to field a team in competition, is the legal entity.

     

     

    The error (in my view) is the decision to persist with the word ‘club’ to refer to member and team synonymously.

     

     

    The simple solution is to define ‘club’ as the entity that is in membership of the SFA, and in all other circumstances, refer to ‘team’.

     

     

    Thus would Celtic plc be a member club of the SFA, while the relevant competing team is Celtic FC, the team of the member club.

     

     

    Seemed straightforward to my mind…

    Fact – The only punishment that I am aware of handed down to Rangers, was that of a £250k fine and a transfer ban – please correct me if I am wrong.

     

     

    Fact – Green bought the assets, set up a NEW club, and as such had to apply for membership of the SFA. When that was granted, that new club had to start at the bottom tier – in fact they were given preference over the next in line Spartans.

     

     

    Martin, you studied law prior to going into football, why can’t you grasp the undeniable facts?

     

     

    Whatever the effect of Rangers being missing from the top flight – they were NOT punished and they were NOT relegated.
