Two things of concern regarding the court hearing yesterday.
Part of Celtic’s defence is the absence of important documentation which purports to show no formal link between CBC & CFC. That is not a strong defence.
Also the connection may be held to be proven under ‘Habit & Repute’ – Definition: (Scotland, law) The condition of being notorious enough to afford strong and generally conclusive evidence of something.

I would have thought that the fact the abuse was discussed by the Celtic Board (assuming that this can be proved) raises a presumption that there was a duty of care, whether or not the two entities were legally separate.
The judge is due to given his decision today on whether the case can proceed as a class action though presumably the decision can be appealed.
