Bill Proxy getting medieval on them

In order to give a fuller picture of what the next few days could hold there is one useful piece of information but first a recap.  Back in October I predicted the Cunning Ruse to liquidate Rangers and phoenix as a Newco.  Then, when Duff and Phelps first invited offers to purchase Rangers assets we predicted only Craig Whyte’s proxy would be in a position to complete a deal.

Given the situation the proxy will inherit, one final prediction – based on some solid information:

The proxy hopes to start from the Third Division.

If Newco inherits Rangers share in the SPL and competes there next season it is liable for fines and penalties due from the SFA and SPL, including what will be the most severe censure handed out in the history of British football after the Improper Registration of Contracts issue is concluded.  They will be hamstrung for many years, perhaps decades.  They will also need to pay domestic and international football debts.

However, if the start from the Third Division, they do so without any legacy baggage from the old Rangers FC.  This would allow Newco a predictable three year penury and allow them time to engage with supporters of Rangers before returning to the SPL in 2015.  Season 2015-16 would be business as usual.

This is not a decision Bill Proxy can take, however, what happens to Newco is in the hands of the SPL. Listen out for Proxy’s puppets suggesting the Third Division route.

For us, it’s popcorn time, the ice-cream is stocked and the sparkling stuff is in the fridge, but in all seriousness, past, current and now future owners have absolutely trashed that football club.  To paraphrase Tarantino, they’ve got medieval on their… face.

Pop!  And they’re gone!

    I mentioned the 90-day scenario on RTC a few weeks back,and got creamed for my efforts!

     

     

    Like you,I remain convinced that is the reason D&P consider Whyte to be an irrelevance.

     

     

    It would be nice to see Whyte get his come-uppance-after all,he has shafted some innocent and gullible people in his time-but this time I’d rather like to think he can get away with it!

    I’m almost certain a UEFA license is required not only to play in Europe, but in the SPL as well.

     

     

    Newco Rangers cannot be given a UEFA license, so therefore cannot play in the SPL. SFL clubs do not require a UEFA license.

  4. Would a newco in the SPL not have to carry the penalties and the player embargo and then the penalties for wrongly registered players, even with refereeing on their side they are still most likely to get relegated making it even worse in year two.

  6. After sorting out the KLM020512 password finally able to post from the KLM Schipol lounge on a bright sunny morning.

     

     

    On the flight over here I couldn’t get the tune Craigy Whyte out of my head. While his work of the last months has been sterling (for the 1 he put in ) David Murray as the great architect of this also should have been one of the 4 horsemen ( with his own song to boot).

     

     

    At the same time as this mess unfolds I was speaking to a young employee based at RFC yesterday. They are in dire straits and they are caught between a rock and a hard place. Like everything in life there has to be balance , so hopefully they find a way out of this mess as they are the innocent bystanders in all of this.

     

     

    I hope Lenny gets the balance from the SFA tomorrow, however I have my doubts ESP with the hassle of dealing with RFC at the moment.

     

     

    One final thought I believe Lenny will and must learn from the last 3 or 4 weeks of the season. There are too many of the Celtic business guys turning against him ; I am sure he will succeed and make Celtic stronger.

    I thought so too, however SFA rules not very clear and in fact the information relating mostly to the UEFA license being needed to play in SPL have been removed from SFA Club Licensing webpages.

     

     

    The latest amendments to those documents were made on 28 Dec 2011 and early Jan 2012.

     

     

    If rules can be broken or bent, I have no doubt the SPL/SFA etc will do their best to do so.

    The sfa fined Craig whyte £160000 which he told them they can whistle for.

     

    No chance of getting the cash therefore no punishment .

     

    The sfa fined ra gers £100000 will duff and duffer pay this or will this be added to the debt ?

     

    IMHO the sfa will never get the cash just like wattie when he stiffed the Scotland team for the gers.

     

    As for the 2 contracts?

    So the investigation has still to be concluded ?

     

     

    The investigation started on the 2 march 2012

     

    That is about 9 weeks ago and all clubs asked if they made second payments to players.

     

    If the past is taken into account in how the sfa and spl have acted towards the gers.

     

    Then they will avoid punishment or minor sanctions at most.

     

    As why would they want to damage the CARTEL.

    This is a subject that needs to be given much more attention, as I am sure you are correct about some of the information having disappeared from the SFA website.

  15. Paul67 – If I was Windy Miller I would go to Division 3.

     

     

    I would do it by telling the hordes we are doing this as a GIRUY to the SPL and SFA for kicking Rangers. They will lap it up and carry him down Edmiston shoulder high.

     

     

    As you state Division 3 gives a predictable level of income. The 2 contracts saga, and it’s subsequent punishment, is a precedent setter. Nowhere has any team cheated to that degree for that long. All sanctions are on the table in that regard. Toss in civil suits from wronged parties and toxic is an understatement. I am sure Doncaster has told them the SPL needs them, however I am also sure he has told them they cannot keep the share, the history, the SPL place without taking responsibility for the sins.

     

     

    There is another facet in my mind. I believe it is legally possible to hold a NewCo liable for OldCo if you can prove they are the same thing. I don’t think it has ever been tried as it is very easy to make them legally different. Change of name etc much to creditors obvious chagrin.

     

     

    I think HMRC would love a crack at setting another precedent with chasing the team that plays at Ibrox, in blue, without a break in operating environment or period, calling itself Rangers with the same company history as a delinquent taxpayer owing several tens of millions of pounds. They may not win but boy would it be close.

     

     

    There are too many known unknowns to run Rangers in the SPL. Good old Occam and his cutting device says Division 3, staying in the SPL is a serious gamble that would very likely result in all of this happening again very soon.

     

     

    After writing that I am not sure which I want now….both are delicious.

    I agree with your article , however there are still a number of severe hurdles in front of Dignity to have a team in place for next season. Firstly, MBB owns Ipox , he is banned and has an outstanding £200k fine, the SFA will require the fine to be paid and MBB to sell the ground before a license to play in Div 3 will be provided. Secondly. Tow truck Bill’s £11.2M does not consider Ticketus’s position and the MBB price for the assets, so my view is that Dignity for Div 3 but with a temporary home which cannot be Hampden, as I understand their is ongoing work for the Games, therefore the only logical place is St Mirren Park, until the ownership of Ipox and the ticket rights are resolved.

     

     

    Still 14 May not far off for liquidation day , and the likely Hibs legal challenge, assuming they finish bottom.

    After yesterday I’m confused!!!

     

     

    At the start of the process I thought and posted that a Div3 start would actually be the healthiest option for them. For financial reasons as well as moral ones (the house training and humility that might arise from it would be good too but no breath hoding there. In fact they could actually get more vile away from the glare of the cameras)

     

     

    I’m conflicted today.

     

     

    Think I’ll refrain from posting to stop any further exposure of my lack of understanding of this situation!!!!!!

    Paul67, with no inside info, I agree that what you outline is the most sensible approach.

     

     

    The main purpose of a New Co is to dodge the debt of the Old Co. To this end, it needs to be obviously not-Rangers so that it is not pursued by creditors, HMRC in particular.

     

     

    Taking over Rangers SPL share as well as the stadium, training ground and the lion’s share of staff is probably a step too far, and at the very least would leave the New Co encumbered by legal wrangling for years to prove that it is not Rangers, and quite possibly with the debts that it was trying to dodge in the first place. A tricky balance to be struck between making it clear to the fans that the New Co is Rangers and clear to pretty much everyone else that it isn’t Rangers.

    With regard to the ongoing player registration investigation, if and when one of the aforementioned newco scenarios comes to pass does this particular investigation, and hence any potential punishment, fall by the wayside?

     

     

    At the very least, would the records still be rewritten to strip oldco of their tainted trophies?

  27. At last Duffers admits a CVA in these circumstances is not possible I.Think this means no deals are possible and the club will be liquidated. I also dont think it is possible that any newco Rangers have enough time to be up and running for the new season. We now enter the end game.

  28. theotherhalf – all we know for sure is he will be getting the brand. Nowhere has it been said he will be picking up any fixed assets and in fact I would be utterly stunned if he does. Whyte has said on several occasions he wants his £27.5m.
