Bogus issues and a Good Old Celtic debate

1020

I’ve not spent a lot of time online this week (work sometimes creeps in) but can’t believe the amount of traction that notion that Sevco would somehow be able to acquire SFA membership of a dead club, with all associated benefits, but be in a position to dictate set terms on how past misdeeds of Rangers would be recorded.

This is a bogus debate which serves only to deflect from the more serious issues facing Sevco, namely, do they have circa £25m to pay their way this season?  If not, their pedantic views of disciplinary matters are moot, although they may be used as a principled excuse to fold a football club.

On more positive matters……….

Tony Hamilton asked me into the Celtic TV to discuss various issues surrounding the club.  We spoke about how recent events elsewhere have had a galvanising impact on supporters of Celtic and other clubs, where Celtic’s future should be.  I also gave a breakdown of what the death of Rangers would mean financially to Celtic, with or without Champions League group stage qualification, talked about how it would benefit the entire Scottish game if we found a new league to play in, and the great atmosphere we have at Celtic Park these days – which you can experience if you buy a season ticket, which you absolutely-without-a-doubt-should!

Do it now.  The video is below:

”What Neil did is what anyone would do: seek out a legal investment scheme which maximises his money for him and his family.”

It wasn’t an investment scheme it was a tax avoidance scheme masquerading as an investment scheme.

These schemes are easy enough to spot. They generally involve

    1. having to pay a substantial fee to take part

    2. having to sign a confidentiality clause

    3. any potential profit (other than tax avoidance) is minimal in comparison to the fee required to join the scheme

    4. the result of the scheme, if it works, is a substantial reduction in the amount of tax you pay.

They may not be criminal, but those involved have, at best, surrendered the moral high ground.

Tax avoidance and Tax evasion. One is legal and teh other isn’t.

Investment schemes such as the one Neil was involved in have been set up to take advantage of tax rules the government has put in place to re-generate or to help out parts of our economy. By giving tax breaks the government are trying to attract investment into flagging industries, or new technologies hoping that this will in turn provide jobs and future tax revenues. There is nothing sinister about the scheme, it just seems to have been operated poorly and since the money invested was ultimately deposited in another bank account rather than used to buy capitol equipment or emply more staff then the reason for using the scheme in the first place was defeated and so no tax advantage could be apportioned to the money used.

To my mind, looks like Neil and others invested in good faith for a worthy economy boosting cause, but since the company operating the scheme have failed to adminster it properly then he along with other investors may feel they have been misled [or “duped” using the current, common parlance] . A human interest story perhaps, but written in a way showing the full bias of this rag.

    Don’t buy them

    {sorry, I did click on the link }

  3. So will the SFA actually tell Sevco to take it or leave it? A decision must surely be made today.

It’s Brechin I feel sorry for. They must have shelled out a fair amount of cash preparing for the first ever Sevco match. Will they be reimbursed if their opponents are unable to play?

  4. Re: Lawwell asking fans to buy SB’s

Why don’t we buy Johnny Russell from Dundee Utd and, Hearts CH Marius Zaluska ?

Put the product on the pitch and, the customer’s, as PL calls us, will pack-out the stadium. imo

Furthermore, on 1st of May 2012 – Neil said that four, first team ready players would be signed to replace the six players who would be leaving ?

    What’s the hold-up Neil ?

There is no such thing as “tax avoidance”. It’s simply not a useful descriptor. Are you “avoiding” tax if you buy a couple of cartons of cigarettes in Spain because they’re cheaper? How about if you give up smoking all together because UK tax pushes the cost up so much – tax avoidance?

Putting money into an ISA – tax avoidance?

Buying a Smart Car instead of a Mercedes because of lower road tax – tax avoidance?

The only useful, clear, and unambiguous (ho ho) categories we should be concerned with are: tax compliance and tax evasion, i.e. obeying the law, or not.

Anybody who wants to claim the moral high ground on tax is free to voluntarily write a cheque to HM Treasury.

How much can they put you down for Ernie? (thumbsup)

  10. Maybe we should all just stop paying tax and then if any of us need, say, an operation, we could do some fundraising on here.

  11. Lennon n Mc....Mjallby on

As long as Neil Lennon didn’t falsely register players I don’t care what he’s done with his money and he still has every right to demand Celtic’s stolen trophies, the DR would be better served questioning why Walter Smith and Graeme Sounness were receiving payments from the huns after having left the club.

    Philvis,

surprised at this, tax avoidance in the UK is perfectly legal and is recognised as such by HMRC. As long as the details of such schemes are disclosed to HMRC they will accept this.

NB – Haven’t read the DR story, don’t think I’ll bother to.

From what I can gather, Neil put some of his money into an investment scheme.

That money, assuming it came from his salary, would already have been subject to income tax and national insurance, taking a huge bite out of his earnings.

Nobody seems to be suggesting Neil has broken the law. So what he – legally – spends his hard earned cash on is his own business. (thumbsup)

  16. philvisreturns on

TheGreenManalishi – I think you missed my point, friend. There are such a broad range of behaviours that could be described as “tax avoidance” I don’t think it’s useful to use the term at all. Government puts up VAT on petrol so you use the car less – tax avoidance? (thumbsup)

You’re either being disingenuous or you don’t have a clue how these schemes work or why people use them.

  19. TheGreenManalishi(WithTheTwoProngedCrown) on

    Philvis,

Sorry can’t agree, If the govt increases the tax on petrol I can make a choice as whether to pay for it or not. Similarly if I am offered overtime it is my choice whether to work and pay the incremental tax or not. Therefore no avoidance.

    +++++

I think these schemes allow people to claw the investment back from tax paid. Similarly people starting their own business can claim back losses from that business from their PAYE (if they have a PAYE job as well, obviously).

I know a few people who follow these schemes – all perfectly legal.

Where many of these things fall down is when such schemes are being abused, like by having a contractual arrangement to allow draw-downs from trusts, or setting up a business with no actual business and no time spent on it (then running up losses by having business lunches with your secretary who just happens to double as your wife or your mates, or buying a company CBR-600), etc.

  27. tomtheleedstim on

Philvis – whilst I recognise the point you are trying to make I think it’s worth remembering that the majority of “legal” tax avoidance schemes are developed by the wealthy, for the wealthy.

It’s funny how getting a couple of hundred quid, cash in hand, can result in a trip to prison but “avoiding” paying several millions of pounds via a scheme like EBT is deemed legitimate.
