Can History be bought, sold or transferred?

I was speaking to someone with only a notional interest in football last week who complained about football fans logic on several fronts including the notion of History.

I was asked, “What does it matter if a Rangers Newco playing at Ibrox being supported by the same people have an intangible claim to what happened in the past?

“Their memories remain, they cannot relive the past, what matters most is the future.”

Only a non-football fan could think like this, of course.  History is the context for whatever happens today, without it, the game is diminished, but we are now in a fascinating debate.  In practical terms, Rangers history could become quite a burden with the next few weeks.

The SPL are currently undertaking an inquiry into alleged illegal registration of players at Rangers during the 13 years before Craig Whyte rescued the club from the old board.  Hundreds of football matches could have been played, many trophies ‘won’ with footballers ineligible to play.

If these allegations are proven, games involving ineligible players will be marked as 3-0 defeats.  So much for the history, but what about the punishment?

Our friends at STV suggest that the SPL hold the view that the transfer of a league share from a liquidated company to a Newco would inherit historical rights from the liquidated party’s past.  For Rangers Newco, this would include penalties for around 500 games played by Rangers FC with invalidly registered footballers.

The tariff of which could sink even the healthiest balance sheet.

But still, if liquidated, Rangers FC, founded around 1872 and incorporated in 1899 would cease.  Newco can play wherever they like, it would be a new club.  The law would protect it from misdeeds of the old company while any assets, such as the badge design, film archive or historic Arsenal shares could be purchased by any third party, including Newco.  And before you bid, owning the badge design does not make you Rangers any more than if you acquired Rangers SPL share.

We’ve been told you can buy and sell history in recent weeks which is clearly nonsense but in finding a path through this subject you need to ask what is in the power of each and any organisation or group to affirm.

The SPL can transfer a share in the league and, in conjunction with the SFA, player registrations.  Both can also impose outstanding disciplinary measures.

Duff and Phelps can sell the badge design independent of the league share.

Craig Whyte can sell the stadium independent of all of the above.

No one can sell, buy or transfer 140 years of history, which is why football fans recoil at suggestions of a Newco replacing their team.

  1. ASonOfDan, I think Uefa oversight is already in place. Really doubt the SPL or SFA will make a move without them involved.

    The SFA & Co were going to pull the plug on Celtic in 94 for the sake of £1M.

     

     

    We didnae have any double contracts, we didnae cheat our way to league flags and cups, we just had a board that wurnae very good businessmen.

     

     

    The Bunnet got us out that hole, depite the SFA & Co, by honest investment and a lot of hard work.

     

     

    A lot of handshakes, winks and nods are getting RFC(IA) out of major, major problems.

     

     

    It’s like the “Jinky / Ham n Egg” comparison again.

  3. If the New hun tries to keep the history with Hector take an interest, think he might.

     

    If they take the history will they be subject to punishment for the crimes of Old hun.

     

    Legally they would be protected from this I think, but it could be forced onto them.

     

    Then again maybe the SPL will give them the prize money for winning the next ten league titles, they’d be as well, stupid cheats, stupid huns.

     

    Anyway, off back to work for a bit.

    My bet is that none of the bidders for corrupt fc were willing to stump anything up if corrupt fc were playing in SDiv3 and just like (it seems )the agents of the EBT role of dishonour ,were not willing to just take some one’s word for it ,no they wanted it set in (head)stone ,hence the CHEATS CHARTER .and funnily enough D&D have put back the preferred bidder farce till after the CHEATS CHARTER has been put in writing .

     

    Now the LL will be falling over themselves to tell all us gullible football fans how bad this all is for corrupt fc ,well it’s too late peepil ,when the eyes of the new media are on you ,it is not easy to cover your corruption up .

     

    The game is up ,I have attended many a football match in this country with the belief that my team were up against more than the 11 opposition players and was dismissed as paranoid ,(funny how even the brass necked hacks have dropped that reference lately ) but in your corrupt desperation ,you have now dispensed with the pretence and just went ahead with the CHEATS CHARTER .

    When it all pans out, it will simply be a case of ‘Say a good Act of Contrition and for your Penance take a pound instead of two out of the poor box’.

  6. Just as an aside – say a newco didn’t fancy starting the next few seasons minus X amount of points and getting 25% of the money from the SPL (oh and quite possibly getting pumped regularly, possibly flirting with bottom 6). Could they decide to simply apply to SFL for Div 3 anyway?

     

    What would be the difference? They won’t get Europe for a few years anyway so what would be the big difference from their point of view?

     

    They could even spin it to their fans in a “They think they can survive without us do they?” kind of way to create an even more bunker like mindset.

     

    I’m not saying this is in anyway likely, just asking the question.

    He said to me not to kid myself, they’d be bending over backwards to keep yous in the league.

     

     

    I replied… I didnt see any sympathy from anyone back in ’94, certainly not from the msm or any politician (Alex salmond).

     

     

    I’ve spoke to st mirren fans and Aberdeen fans. They really do see us as the ‘old firm’ collectively destroying Scottish football.

    Fans will be well aware of the current financial problems suffered by Rangers FC in the last few weeks. DST consider it pertinent to offer their views on this matter.

     

     

    DST’s stance on the matter is uncompromising. The sporting integrity of Scottish Football is critical. We want our club to take the moral high ground by insisting that all member clubs play by the rules, comply with the law of the land as well as the game, and fulfil their obligations to other clubs and to society as a whole. DST fully believes in these principles and is sure that all right minded supporters will feel likewise. We wish to send a clear message to the board and management of AFC that we will not condone any departure from these principles, and that they should not be party to any future arrangement which allows a club to renege on its legal and moral obligations.

     

     

    Rangers led most of the top Scottish clubs into ruinous debt by their unsustainable overspending from the Souness years onwards, and the creation and structure of the SPL has institutionalised the unfair distribution of wealth within our game. Now is the time to challenge the OF’s stranglehold to ensure a more equitable league structure and format.

     

     

    The OF need the rest of Scottish football much more than we need them. Without a league of opponents to compete with, they cannot survive. The media argument that the OF subsidise the other teams and keep them afloat is spurious. The reverse is in fact true, since they get a totally disproportionate share of the money in the game. This unfair subsidy must cease immediately.

     

    This is watershed for Scottish football. DST believes that the supporters of AFC and supporters of every SPL club should now send a strong and clear message to their club’s directors that we expect and demand change to the structure of the game as a whole. It is in every club’s interest (including the OF) to level the financial playing field, and to have 2/3rd majority voting in the SPL.

     

     

    Clubs must also find ways of improving the product on the park by increasing variety, competition and entertainment, thus providing better value for money.

     

    DST will continue to monitor events and will be collecting comments from members soon.

     

     

     

    All other spl clubs really do see us as part of the problem.

     

     

    I’d be happy to see the TV money distributed more evenly as long as justice is done.

    Before people get overwrought on SPL rule-changes… if 2a were adopted RFC would look nothing like now…. could not play in Europe… would have to pay debts…will have depleted squad… so reduced playing success… radically reduced income. Parachute to SPL yes, soft landing no.

    Good evening from India Bhoys. Not written but I have read for a while. I no longer see Celtic Quick News but Rangers Speculation News. The site is so overwhelmingly focussed on Rangers that I despair. I dont gibe two hoots about Rangers and their history means nothing to me.

     

     

    I support Celtic and dont care one bit about Rangers. Celtic and its history is secure.

     

     

    I care about what happens against Hearts not Rangers destiny which is negative assured.

     

     

    Lets support and praise our own please. This site is giving it too much about Rangers instead of our own.
