Clyde FC point SFA and SPL to contractual and judicial facts

I received updates direct from last week’s Scottish Football League meeting shortly after it concluded.  My information was that Neil Doncaster in particular was given a torrid time and that the mood among clubs was firmly against agreeing to place Sevco into the First Division.

Within a couple of hours it was clear that many in the media had been given a different impression and that if the vote was taken then, a ‘healthy majority would vote in favour’.  To a degree I think we are all susceptible to messages we want to hear but it has been a feature of this debacle that executives from the national bodies have given clear guidance to the media that ‘Newco’ would be voted into the SPL, as it was, or now into the First Division.

On more than one occasion I’ve heard “You might have heard different, but Neil Doncaster told me….”

There is no shortcut for legwork and attention to detail.  On this subject, credit to STV, who present informed information on how Friday’s vote is likely to pan out, with references.  Of the 30 clubs in the SFL, the report 14 have declared an intention to vote against plans to plant Sevco into the First Division, one will abstain and one has (incorrectly) been told they are ineligible to vote.  Another 14 are yet to declare.

It seems likely that the SFL vote will go the way of the SPL vote.  There is a desire to retain the sporting element to our game among clubs, if not among administrators.

In a statement yesterday Clyde FC nailed several of the myths behind threats made to SFL clubs:

“We have obtained a copy of the Settlement Agreement signed up to by the SPL and the SFL in April 1998 – it is clear that the agreement is not ambiguous in this regard and there is no scope for the SPL to fail to meet the obligations to the SFL except by deliberately breaching the agreement… We have concluded that it defies credibility that the SPL clubs would instruct the SPL to deliberately breach a legal agreement.

“The matter is made worse because of the extent of uncertainty which hangs over Sevco. There is no need to prepare an exhaustive list of the issues as they are well publicised, however the extent of outstanding sanctions that may or may not be levied against a club which has yet to obtain SFA membership, together with the increasing number of possible commercial and legal challenges to the transactions to date simply presents a significant risk to the ability of the club to fulfil its fixtures in any league. Given that some of these matters are in the hands of the governing bodies it seems inexplicable that they are left hanging.”

In short, the Scottish Football League has a binding contract with the SLP which they are entitled to enforce.  Clyde also refer on the matter we have discussed here for many weeks, Sevco are trying to buy a SFA membership which has significant outstanding disciplinary issues against it which could see the membership suspended.  Instead of providing clarity, the SPL and SFA have refused to set deadlines of proceed with hearings.

We can speculate if SFA chief exec, Stewart Regan, will inform SFL clubs in person on Friday of plans to disband judicial oversight from our game instead of asking Lord Carloway’s panel to reconvene.

Despite the valiant efforts of many football fans and clubs, our game has been ruined by years of destructive, self-serving, leadership.

    Celtforlife- I wasn’t being obtuse, I wondered about the statement that the vast majority of the Celtic support were’ non-Catholic’.

     

     

    If you were to say ‘non-practising Catholic’ that sadly is true, but most would have been baptised in the Faith, even if they no longer attend Church on a regular basis.

     

     

    You go to chapel when there is a wedding, or a christening on, and the place is packed. It’s like when the wee teams get to a Cup final, they don’t go week in week out but on a big occasion they’ll turn out in droves.

  4. UEFA and SFA reject Rangers licence request

    Duff & Phelps have revealed that both the SFA and UEFA have rejected licence applications for Rangers.

     

     

    Before the 31 March deadline for both organisations the Ibrox administrators submitted applications to allow the club to continue playing.

     

     

    With no published audited accounts since 31 December 2010 the licence applications were rejected by both bodies.

     

     

    Since making the applications Rangers have begun the process of liquidation with Sevco applying for SFA membership.

     

     

    According to the blog of the highly respected Alex Thomson of Channel 4 News the SFA are treating the Sevco application as a transfer of membership rather than a new application.

     

     

    Having rejected the licence application of Rangers it seems highly unlikely that the SFA could then issue Sevco with membership without three years of audited accounts.

     

     

    The information is revealed in a document issued by Duff & Phelps to Rangers creditors.

     

     

    It reveals: “As noted in the Proposals, the Club submitted a licence application to the SFA for both national and UEFA licences prior to the 31 March 2012 deadline.

     

     

    “However both licence applications were refused by the licensing committee of the SFA due principally to the fact that because of the Companys insolvency it could not complete its annual, audited accounts for the year to 30 June 2011.

     

     

    “In addition, in breach of UEFA licensing regulations, the Company had overdue sums due to other football clubs and overdue PAYE/NIC amounts, which had arisen as a consequence of the Company’s insolvent position.

     

     

    “Due to the Administration, it was not possible for the Company to satisfy these outstanding

     

    matters in order to obtain the licences, however the failure to receive a national licence had no practical effect on the Club?s playing activities for the remainder of the season.

     

     

    “The failure to obtain a UEFA licence for the following season did however impact upon the level of interest from prospective purchasers.”

     

     

    SFL clubs will meet at Hampden on Friday to discuss Sevco’s application to join the SFL however it’s unclear whether any vote will be taken

    I actually love the political debate on this forum sometimes, because it doesn’t matter whether it’s left battling right or nationalist versus unionists, Nats versus Labour or even the Battle of the Sexes (that has crept in once or twice along the way, in one guise or another), it is never anything less than compelling.

     

     

    I especially love the “what if Scotland was independent?” argument. It fairly zings with wild speculation, invective and sometimes anger.

     

     

    Let me throw my two bob into the mix. I am an old school, Old Labourite, very much the unreconstructed leftie. Politics, believe it or not, and not football, was once the absolute love of my life.

     

     

    That ended, spectacularly, on 18 March 2003, when the so-called great minds of the British Parliamentary system voted overwhelmingly to send this country’s soldiers to invade a foreign land based on outright lies, which, furthermore, a large number of people, including some in that chamber, knew were outright lies at that moment. I have never involved myself in a political campaign since. That we in the anti-war movement knew not only that there were no WMD’s, but also looked into the future and saw the consequences – George Galloway even wrote a book in which he predicted, with deadly accuracy, the civil war which was to tear Iraq apart in the years after the event – has never been a source of pride to me; rather it has poisoned my faith in large parts of the process, forever.

     

     

    The parallels with the current crisis in Scottish football are blindingly obvious; everything from dodgy dossiers to the “whips” trying to push people into line. The media campaign, hysterical, nonsensical, farcical at times, has followed the Iraq pattern almost exactly too … it is eerie.

     

     

    I’m going to do a longer piece on that at some stage, after Friday maybe, when we see if the parallel stretches all the way to the victory of lies and deception, but in a sense that result doesn’t really matter, except to the fans of Der Hun.

     

     

    Change is coming, and it’s going to sweep some people away.

     

     

    And that, my friends, is why I intend to vote Yes in any Scottish independence referendum, and why no matter what scare stories the Daily Record prints, no matter what lies the unionist parties tell about the numbers, and no matter what the so-called “consequences” will be of Scotland going its own way, at least according to those with a vested interest in fudging the numbers.

     

     

    It is a once in a generation chance to change this country forever, and I will let neither fear nor smear stand in my way when that vote has to be cast. There will be challenges, of course there will, be I think they will be overcome as time goes by and we will see benefits we hadn’t even thought of.

     

     

    One of the more prevalent claims I hear on this forum, and elsewhere, is how the Catholic minority, the Irish Catholic minority in particular, would be “persecuted” in an independent Scotland, but I don’t pay attention to that any more than I would pay attention to the financial Armageddon tales.

     

     

    Have I had moments of genuine disgust at Scotland? Of course. Have I feared, genuinely, for some of our communities? Yes, of course, but the truth is I really don’t believe they are in any real danger.

     

     

    We, this Family, this community, whatever our politics, believes in certain things, in certain principles, in certain ideas. They cross political, social, ethnic and even financial lines. We believe in fair play, in behaving with honor, in doing the right thing, in charity, in faith and in hope.

     

     

    We are strong in debate. We are passionate in defence of our rights. We hold those in power to account. We are learning to harness the weapons of social media, to unite with other groups, to forge new ground and to push for the things we care about and want with great vigor.

     

     

    In short, we’ve gotten terribly ambitious and terribly smart. And that ain’t no small thing, and it is not a temporary thing either. This is forever.

     

     

    We no longer trust the “straight press.” Another Iraq could not be forced upon the people of this blog. We have learned to look for agendas behind every action, to pull back the curtain at the man pulling the levers.

     

     

    And we are not alone.

     

     

    In short, those amongst us who care about these things, about social justice whether you believe it can achieved by the capitalist system or through something more distributive, who abhor injustice and intolerance, we are now wide awake and we’re not going back to sleep. How many of you, before Craig Whyte sauntered into town, had an ambivalent view of, say, the banking crisis, and have started to pay attention to the news now you’ve had a first hand glimpse of how those in power can carve up the territory, and cover for, and make, appalling mistakes? How many of you will never read another newspaper again, now you have seen what lies they tell?

     

     

    Because if you believe – as we all do – that the back pages contain nothing but lies, how can you ever again trust what’s written on the FRONT pages, where the agendas are even larger, the stakes even higher, and the need for spin and deceit even greater?

     

     

    In times to come, the debates over these things will be conducted in a ways the old media cannot control, and I believe, firmly, completely, that in those debates, with honesty, with facts, with truth underpinning them, we will win, we will always win, because we, frankly, are smarter than them.

     

     

    The New Scotland will not be one where our minority is persecuted by those who hold the power. The New Scotland, more likely than not, will be one where WE hold the power. We are better organisers, deeper thinkers and greater communicators. Our tendency is to reach out, to build coalitions, to make friends, whilst theirs is to depart into insular self interest.

     

     

    An old political sayings says that “if you’ve got a friend, you’ve got a vote.” And we have many, many, many more of them than you think.

     

     

    But more – we have the intellect, drive, ability and ideas to transform not only the debate but the way in which the debate itself is held … and THAT is the key to every political victory under the sun.

     

     

    I believe in this, and my belief gets stronger every day. I am not afraid of the choice, or of the change, and I am excited about what we might do, and might become, if this country was to go it alone.

    Join the American Major Soccer League. I’m sure the Americans would welcome us with open arms, they already have Canadian teams in it, Celtic would make an absolute fortune from TV revenue, we have a massive fan base in USA, the Celtic team could fly out every 2 weeks and play 2 or 3 away games in a row …

     

     

    … but much more importantly the time difference is much better for me to watch the games.

    (1) Those who are not Rangers supporters are Rangers haters.

     

    (2) These vindictive Rangers haters want to drop Rangers 3 divisions.

     

    (3) In the writer’s opinion, they are correct to do so “..if they demote it three divisions, as they should, a financial crisis…”

     

    (4) However, they are still bitter and twisted.

The license they were going to transfer has been withdrawn, and no 3 years of accounts in the new company would prevent the issuance of a new one. Or will some new rules be invented to cope for this eventuality?

    I shall not record my reaction to this, as I would undoubtedly receive a red cad for a language violation regardless of whether I were to express myself in English, Hebrew or any of the many other languages in which I am now fluent.
