Clyde FC point SFA and SPL to contractual and judicial facts

I received updates direct from last week’s Scottish Football League meeting shortly after it concluded.  My information was that Neil Doncaster in particular was given a torrid time and that the mood among clubs was firmly against agreeing to place Sevco into the First Division.

Within a couple of hours it was clear that many in the media had been given a different impression and that if the vote was taken then, a ‘healthy majority would vote in favour’.  To a degree I think we are all susceptible to messages we want to hear but it has been a feature of this debacle that executives from the national bodies have given clear guidance to the media that ‘Newco’ would be voted into the SPL, as it was, or now into the First Division.

On more than one occasion I’ve heard “You might have heard different, but Neil Doncaster told me….”

There is no shortcut for legwork and attention to detail.  On this subject, credit to STV, who present informed information on how Friday’s vote is likely to pan out, with references.  Of the 30 clubs in the SFL, the report 14 have declared an intention to vote against plans to plant Sevco into the First Division, one will abstain and one has (incorrectly) been told they are ineligible to vote.  Another 14 are yet to declare.

It seems likely that the SFL vote will go the way of the SPL vote.  There is a desire to retain the sporting element to our game among clubs, if not among administrators.

In a statement yesterday Clyde FC nailed several of the myths behind threats made to SFL clubs:

“We have obtained a copy of the Settlement Agreement signed up to by the SPL and the SFL in April 1998 – it is clear that the agreement is not ambiguous in this regard and there is no scope for the SPL to fail to meet the obligations to the SFL except by deliberately breaching the agreement… We have concluded that it defies credibility that the SPL clubs would instruct the SPL to deliberately breach a legal agreement.

“The matter is made worse because of the extent of uncertainty which hangs over Sevco. There is no need to prepare an exhaustive list of the issues as they are well publicised, however the extent of outstanding sanctions that may or may not be levied against a club which has yet to obtain SFA membership, together with the increasing number of possible commercial and legal challenges to the transactions to date simply presents a significant risk to the ability of the club to fulfil its fixtures in any league. Given that some of these matters are in the hands of the governing bodies it seems inexplicable that they are left hanging.”

In short, the Scottish Football League has a binding contract with the SLP which they are entitled to enforce.  Clyde also refer on the matter we have discussed here for many weeks, Sevco are trying to buy a SFA membership which has significant outstanding disciplinary issues against it which could see the membership suspended.  Instead of providing clarity, the SPL and SFA have refused to set deadlines of proceed with hearings.

We can speculate if SFA chief exec, Stewart Regan, will inform SFL clubs in person on Friday of plans to disband judicial oversight from our game instead of asking Lord Carloway’s panel to reconvene.

Despite the valiant efforts of many football fans and clubs, our game has been ruined by years of destructive, self-serving, leadership.

    Proposals put forward to Scottish Football League clubs include a new top tier division of 14 clubs for the season 2013-14.

     

    This would see three promotion slots for Division One clubs, with one club still being relegated from the top flight.

     

    SFL clubs will vote on Friday whether to admit the Rangers newco into Division One or Three.

     

    Many clubs have indicated their desire to see Rangers enter Division Three.

     

    Rangers crisis explained

     

    Rangers went into administration owing up to £134m to unsecured creditors and will eventually be liquidated.

     

    As a result its registrations with the Scottish FA and Scottish Premier League were terminated.

     

    Charles Green led a consortium which bought Rangers’ assets for £5.5m.

     

    The former Sheffield United chief executive is reforming Rangers as a new company.

     

    But the ‘newco’ did not get the required votes for re-admittance to the SPL.

     

    Instead the new Rangers could start life in Scottish Division One or Three.

     

    President Jim Ballantyne said SFL clubs would receive information over potential structural changes ahead of Friday’s vote on Rangers.

     

    Meanwhile, BBC Scotland has learned a final decision on which club should replace the old Rangers in the Scottish Premier League is unlikely to take place before Monday.

     

    The proposal for Rangers starting the coming season in the second tier of the senior leagues suggested that Dundee – runners-up in last term’s First Division – be promoted and that the SPL and SFL should eventually merge.

     

    However, Dunfermline, who were relegated from the SPL last season, feel they should be back in the top flight for season 2012-13.

     

    And SFL clubs feel they would be under-represented in a merger with the SPL.

     

    The issue of where to place Rangers originated when the club could not be saved from liquidation and was relaunched by a new company.

     

    The newco had their application to replace the old Rangers in the SPL rejected and then applied to the SFL, adding they would enter whichever league the organisation deemed fit.

     

    Berwick Rangers are the latest in a series of SFL clubs to go public with their view that the new Rangers should begin in Division Three.

     

    But SFA chief executive Stewart Regan fears not putting Rangers into Division One would have a negative financial impact on all clubs.

    If the league really needs reform, why settle for 14 teams?

     

     

    The league DOES need restructuring, but it needs to be done properly and for the right motives – not some half@rsed measure just to give Sevco the best chance of getting out at the first attempt.

    Well…

     

    Today brings another to the Celtic family.

     

    My daughter was born @ 11:15, a healthy 3.8kg (8lbs 5oz for those of an old schoolian nature)

     

    Mum & baby doing super good.

     

    Dad bursting with pride, as he was at the birth of his first son & daughter.

     

     

    I love Celtic.

     

    I adore my family.

     

     

    I was back in Scotland for the first time in 5 years at the end of last year, aided by CQN, and I attended 2 matches, one with with wife & son (he was more excited about his engraved brick, in truth… so was his dad!).

     

    Ayrshire huns xmas eve = 2-0.

     

    And with my old man, defunct ex parrot fc game = 1-0.

     

    TOP OF THE LEAGUE!

     

    I think my family are good for Celtic park.

     

     

    Only last night, with my wife’s father – down from Hokkaido to help out with the day to day, my kids & I were singing Celtic songs in the curry house, much to my non-speaking in-law’s amusement. “COME ON YOU BOYS IN GREEN… ”

     

     

    As a new season approaches, with many unknowns ahead… some things are solid, steady, unflinching, forever, deep & bonding.

     

     

    The love & commitment to my family comes second to nothing.

     

    My love of Celtic, its ethos, origins & the Celtic family attaches naturally.

    Personally, I think it would be awesome, and the MSL would consider it a major coup. I could see the games against Seattle, Portland, LA, Columbus, New England and New York being huge draws.

     

     

    Logistically it would never work, but it’s fun to dream. I think it will be interesting to see what Barry Robson thinks of the quality of play as he gets more up to speed with Vancouver.

    The new jersey is worn with white shorts with the Celtic knot-work detail printed on the side panels and with black socks with a green and white hoop, again to underline the Club’s heritage.

    A 14 team top division would be the best solution I believe.

     

     

    Bringing any more in means you’re effectively taking mid table teams from the first division where quality/stadia become an issue but moreover, a 14 team league gives an oppurtunity to split after 26 games, giving the top 6 a further 10 games and the bottom eight a further 14 games. And less divvying up of the TV money compared to a 16.

     

     

    The issue is why is this being done simply to help Rangers? Football at the top level has been stale for a number of years but many clubs(Celtic included) still seem to have a slight preference for a league of 10. The fans are bored with it.

     

     

    If the lower leagues in England can have 24 teams I’m sure we can a 14 team SPL and make it viable. Not though, if its being implemented for the benefit of one team.

    That’s a wonderful crazy idea I’ve thought about previously. I’m sure the Americans would go for it. I’ve not been to many away games in recent years but I’d pencil in a few over the season for this. Of course there’d be a few obstacles to overcome, not least being the travel for the team, however it takes around five hours for an East coast US team to travel to the West coast anyway for the US teams. What a way to break into a massive TV market and also expand the fan base. I’m for it.

If you have ever seen the small faces on ” Colour me pop” on youtube or listened to ogdens nut gone flake, you would know the voice of Stanley Unwin, speaking gobbledegook. Well the below info is from Wiki.

     

     

    Stanley Unwin died in 2002 in Daventry. He is buried in the churchyard at Long Buckby, with Frances, who died before him.
