Cost to acquire Ibrox likely to be high

Directors and shareholders in limited companies cannot be pursued by creditors under normal circumstances but special provisions exist for ordinary creditors and the tax authorities to pursue officers in a company if their behaviour transgresses acceptable standards.

The Social Security Administration Act 1992 allows HMRC to issue Personal Liability Notices to officers in a company for the recovery of company tax if they are guilty of fraud or “more serious levels of neglect”.

HMRC say:

Generally HMRC may consider a case to involve more serious neglect where it can be established that against a background of persistent failure to pay the contributions due the company was making significant and/or regular payments:

to other creditors

or

to connected persons or companies

or

in the form of director’s salaries

A case may also be judged to involve more serious neglect where ‘culpable officers’ have been associated with previous liquidated companies or other companies that have demonstrated a failure to comply with the statutory requirements of the Income Tax PAYE and NIC legislations.

While I am sure Craig Whyte has acted with the utmost probity Duff and Phelps early comments that Rangers used tax as cash to operate the company with will concern many.

Rangers accumulated £15m in tax debt during Whyte’s tenure.  In addition to his outstanding guarantees to Ticketus the Rangers owner will be alert that the administrators report could cast his actions in a poor light with respect to some of the above scenarios.

The £15m HMRC are demanding for this season is not cash Whyte received, Rangers used that money to fund a domestic and European football campaign.  Rangers owe that money and Craig Whyte is unlikely to forgo his security (Ibrox stadium) without his potential tax and Ticketus positions being covered.

Any attempts to resolve the matters surrounding Rangers which does not provide funds for this obstacle is doomed to failure.

    You have stated this frankly and repeatedly, however everyone with R@ngers’ interest at heart were prepared to allow their fanbase believe that Mr Whyte was a temporary, inconvenient blight that would be humiliated into nothingness.

     

     

    D&P’s wrote him off, Paul Murray refused to deal with him and the rest seemed to disregard his involvement but despite insults, snubs, intimidation and threats there was no way the Whyte Knight was going to vanish. It wasn’t so much that Craig Whyte didn’t do walking away, it is the case that with a huge ball & chain fastened to your leg, hiking not on the agenda.

    It’s pretty clear that the treble for the Hoops and their team going bust would be too much for them to take so the blow has been softened by the referee’s.

     

    The Ayrshire Huns and the Diet Huns will provide some levelling up for them.

     

    Expect some questionable refereeing in the Scottish Cup Final against Hibernian and a dodgy victory for the diet Huns as they will be the team we have to comepete against next season. The Hun power will shift cities for the next few seasons and the referee allegiances will too.

    Refereeing simply has to be made more accountable. The police have similar authority as referees in terms of deciding to curtail another persons freedom, but they are accountable if they misuse the law.

     

     

    Referees face no such check and all it takes is a wrong un in a position to influence, and the conditions for misuse are present.

     

     

    That is why the appointing of referees has to be a joint matter between SPL and SFA and the evaluation has to be with the SPL. They can bring in ex refs from anywhere but Scotland to do the evaluation. That evaluation would be linked to pay and good performances would be rewarded by higher pay and poor ones would see pay reduced.

     

     

    Such an evaluation sysytem would also bring a level of consistency as it would become obvious over time if a referee was making the same mistake or making it one game but not another.

     

     

    You cannot manage what you cannot measure and it appears there is no standard of measurement that applies gtame to game.

     

     

    This is not rocket science and resistance its not anything underhand on referees part either, they just enjoy the blanket authority they currently work under and would resist attempts to change it. In their shoes I might do the same but for the good of the game and the long term good of referees the way things are MUST be changed.

     

     

    We want professional referees, professionally managed and monitored with professional pay (that seems to be the case currently in terms of hourly rates). If the SFA cannot recruit and train enough to the required standard then foreign referees can fill the gap. Their authority on the park needs to be upheld and their power off it significantly diminished. They are servants of football not its masters (bar the 90 minutes plus injury time).
