Cost to acquire Ibrox likely to be high

Directors and shareholders in limited companies cannot be pursued by creditors under normal circumstances but special provisions exist for ordinary creditors and the tax authorities to pursue officers in a company if their behaviour transgresses acceptable standards.

The Social Security Administration Act 1992 allows HMRC to issue Personal Liability Notices to officers in a company for the recovery of company tax if they are guilty of fraud or “more serious levels of neglect”.

HMRC say:

Generally HMRC may consider a case to involve more serious neglect where it can be established that against a background of persistent failure to pay the contributions due the company was making significant and/or regular payments:

to other creditors

or

to connected persons or companies

or

in the form of director’s salaries

A case may also be judged to involve more serious neglect where ‘culpable officers’ have been associated with previous liquidated companies or other companies that have demonstrated a failure to comply with the statutory requirements of the Income Tax PAYE and NIC legislations.

While I am sure Craig Whyte has acted with the utmost probity Duff and Phelps early comments that Rangers used tax as cash to operate the company with will concern many.

Rangers accumulated £15m in tax debt during Whyte’s tenure.  In addition to his outstanding guarantees to Ticketus the Rangers owner will be alert that the administrators report could cast his actions in a poor light with respect to some of the above scenarios.

The £15m HMRC are demanding for this season is not cash Whyte received, Rangers used that money to fund a domestic and European football campaign.  Rangers owe that money and Craig Whyte is unlikely to forgo his security (Ibrox stadium) without his potential tax and Ticketus positions being covered.

Any attempts to resolve the matters surrounding Rangers which does not provide funds for this obstacle is doomed to failure.

    No but I hear rangers are trying to get the bus fair for a game at Pollock Juniors and a big home game at Bellahouston park with a bunch of weans that play down there most of the summer and are quite good. Rangers may not be able to provide the jumpers for goalposts though. McCoist said to be raging but it could just be that the filling in his pie was very hot……..

    I believe the creditor would have to specifically withdraw their invoice upon receiving the money from a random bloke off the street. They could just take the supporters’ money but remain creditors of the club. I believe in the tale of the EK glassman that there may have been some forceful negotiation from the payers to the payee to provide them with some written assurance that the club would not be pursued and that their payment should be accepted.

    wife had an impromptu fashion show with her mates. I was pulled out of bed with a raging hangover and consigned to the boys bedroom and told not to come out and given a guitar. I wasn´t too happy about it and was bored. The guitar was not tuned. I have never videoed or recorded anything before and put them up for a laugh but it has been a very useful exercise.     However I think you are giving ‘Our Hero – Craigiebhoy’ too much corporate nous with a business mind that is off the radar.

     

     

    I am sure he had some sort of ‘cunning plan’ to start with that would have been OK when dealing with run of the mill companies he previously ‘owned’. However I think even he may have bitten off more than he can chew and has been caught in the maelstrom that is RFCIA.

     

     

    I assume he has not ‘walked away’ yet as he is hoping to get enough from Ix/MP to cover the bases mention by Paul in his article.

     

     

    Hopefully the sorry mess will get liquidated soon and we can find out.

    STV has learned that around 12 Scottish players have been shortlisted to play for Team GB at the Olympics.

     

     

    However, we understand Rangers keeper Allan McGregor has failed to make the cut.

     

     

    Manager Stuart Pearce has named a pool of 80 players, which includes four men aged under 23 from Scotland – Celtic’s James Forrest, Blackburn duo Grant Hanley and David Goodwillie as well Aston Villa’s Barry Bannan.

     

     

    STV also understands Steven Fletcher is in a group of around six Scottish players over the age of 23 who have been included in Pearce’s squad.

     

     

    Why do they not just tell us who is in the squad. They have to put a Rangers spin on the story. There is no Admin FC story here.
