Cost to acquire Ibrox likely to be high

Directors and shareholders in limited companies cannot be pursued by creditors under normal circumstances but special provisions exist for ordinary creditors and the tax authorities to pursue officers in a company if their behaviour transgresses acceptable standards.

The Social Security Administration Act 1992 allows HMRC to issue Personal Liability Notices to officers in a company for the recovery of company tax if they are guilty of fraud or “more serious levels of neglect”.

HMRC say:

Generally HMRC may consider a case to involve more serious neglect where it can be established that against a background of persistent failure to pay the contributions due the company was making significant and/or regular payments:

to other creditors

or

to connected persons or companies

or

in the form of director’s salaries

A case may also be judged to involve more serious neglect where ‘culpable officers’ have been associated with previous liquidated companies or other companies that have demonstrated a failure to comply with the statutory requirements of the Income Tax PAYE and NIC legislations.

While I am sure Craig Whyte has acted with the utmost probity Duff and Phelps early comments that Rangers used tax as cash to operate the company with will concern many.

Rangers accumulated £15m in tax debt during Whyte’s tenure.  In addition to his outstanding guarantees to Ticketus the Rangers owner will be alert that the administrators report could cast his actions in a poor light with respect to some of the above scenarios.

The £15m HMRC are demanding for this season is not cash Whyte received, Rangers used that money to fund a domestic and European football campaign.  Rangers owe that money and Craig Whyte is unlikely to forgo his security (Ibrox stadium) without his potential tax and Ticketus positions being covered.

Any attempts to resolve the matters surrounding Rangers which does not provide funds for this obstacle is doomed to failure.

  5. I don’t know the PPOTY voting system, but I would guess that you are only allowed to vote for one player from each team? If that is the case, I would expect Charlie to be our top player.

  14. Union’s Fraser Wishart urges end to Rangers administration

     

     

    PFA Scotland chief executive Fraser Wishart has criticised Rangers’ administrators for so far failing to appoint a preferred bidder.

     

    Wishart was involved in negotiations with Duff & Phelps that led to temporary salary reductions at Ibrox.

     

    “We are only a few weeks from the end of the season at which time players’ wages will legally revert back to what they were before cuts,” said Wishart.

     

    “I don’t think they will be making any more sacrifices.”

    Three parties tabled best and final offers to take control of Rangers but one party, the Blue Knights, have since stepped back from the process and an earlier bidder, Brian Kennedy, has made a renewed offer to buy the club.

     

    The Blue Knights, Kennedy and Singaporean bidder Bill Ng are all keen on achieving a company voluntary arrangement rather than liquidation, which is favoured by American bidder Bill Miller.

     

    Wishart says the union is seeking legal advice because it believes players will be free to leave Rangers if they are liquidated and relaunched as a “newco”.

     

    ”We believe that’s the case under employment law even if Rangers are allowed to keep their name and their history,” said the former Rangers player.

     

    “Should a newco be formed the players do not have to go across. They have the right to object to that transfer.

     

    “There may well be complications in terms of Fifa regulations and football regulations.

    “We believe the best solution to end uncertainty is for a preferred bidder to be appointed and an agreement with creditors to be reached,” added Wishart.

     

    “I think it’s so important, given the size of the debts Rangers have, that someone is given exclusivity as soon as possible.

     

    “We are hitting real tight time deadlines. In three weeks’ time the season finishes, players go on holiday.

     

    “They don’t know whether they are coming back, some of them who are out of contract. They don’t know what state Rangers are going to be in.

     

    “There is a lot of talking to be done and the players are getting frustrated.

    FUNDRAISING Rangers fans have settled a club debt to East Kilbride firm Glencairn Crystal.

     

     

    The News reported last week that the cash-strapped Ibrox side still owed £354 to the Langlands-based glassware company for a personalised leaving gift for departing captain David Weir – three months after he quit the club.

     

     

    However, as we went to print last week, Ibrox fans Tom Clark and Alfred Nicholson walked into the firm’s headquarters unannounced and handed over the cash to bewildered managing director Paul Davidson.

     

    Paul said, ” One of them muttered something about the weather in East Kilbride and left after leaving the money.”

  22. As far as I know, radio stations cannot tell if you are listening unless you do it online. I wouldn’t be surprised then if Radio Clyde analysts come on to websites like this and count the number of posts to ascertain the popularity of their output.
