Courts, offensive law and a club for the downtrodden

871

I’m a bit disappointed RIFC were not in a position to advise their shareholders the results of the votes this morning.  Doing so would not have added 10 minutes to proceedings.  My expectation is that the board would win both votes, giving them a resounding platform this weekend to sell tickets for lower league football.  Perhaps there’s more going on than I thought.

You have to wonder what that expensive legal business in London and Edinburgh yesterday was all about?  Many details of Sports Direct’s deal with Newco are public knowledge, and the void of missing details is filled with pretty stark speculation.  It struck me that counsel for Sports Direct noted the chronology of the new board being appointed, the subsequent leaks and that Newco had not denied they were the source of the leak.  All now on record, in court.  Confidentiality is, of course, a condition of the agreement, which could now be argued is in breach.  That would be a source of regret.  For some.

More on Dave King over the weekend.  He can’t help himself.

You have to admire those who work to expose the absurdity of the Offensive Behaviour Act, designed by the SNP government to “equalise” non criminal offenses with criminal offenses.  Unfortunately, the campaigners are wasting their time, the Act is here to stay, anyone in doubt should read the news this morning that 80% of people surveyed support it.  Ask the average person in the street if they support a law against Offensive Behaviour and they’re hardly likely to say ‘no’.  This type of survey is manipulative nonsense.  Police with guns on the streets and politically motivated laws are a by-product of blind populism.  This is an offensive law and I am horrified.

Robert King is one of the Angola 3, who were incarcerated in solitary confinement in the Louisiana town of that name, and who have become causes célèbres for miscarriage of justice campaigners and prison reformers alike.  King spent 30 years in solitary before having his conviction overturned.  If you don’t know about the Angola 3, go find out.

He pitched up on CNN yesterday dressed in distinctive attire (below).

My relationship with Celtic is different to King’s.  I’m a Celtic fan because that’s the way I was brought up, but I’m pretty sure King’s roots don’t reach back to the Emerald Isle.  Chances are, I’d be a Celtic fan whether we were a club with a social mission or not.  For others, for King, the reasons they wear a shirt on TV, buy a season ticket, or simply share in our joy on occasion, are different.

We are the club of the underdog, a beacon for the downtrodden, a place where they will find a welcome.  No one can plan for this, it either survives over the decades or it doesn’t, so it’s worthwhile telling this part of our story now and again, to set ourselves a core target: Remain the most ethical football club in the world.

To deliver on this you and I need to step forward, this is not a job that can be outsourced to the club, it takes all of us.  You can start here by signing up for the Great Scottish Run for the Foundation.  I know at least 30 runners who read this, sign up before I see you in person!

last time I wore a kilt was at my brother’s wedding about 15 years ago … it was a cold winter day in April… and I was wearing the kilt the proper way (wont say anymore as there may be children … or adults with sensitive stomachs … reading) ….

the wedding was in a beautiful old school house, which was situated in a kind of rough part of town …

part way through the evening, we were running short of whiskey… so my dad asked me to go for a run to get some more …. so, out for a walk, late in the evening, me in my kilt … when I pass by a gay biker gang! ….. leather, cheesy moustaches, the whole nine yards … I’m not joking ….

and there was me looking awfully tasty in my kilt (and I was much younger and fitter then!)

Got a comment or two from a couple of the guys … and thought ‘oh, crap … this isn’t going to be good …’ turned around, expecting to get a beating … but ended up chatting with a couple of them…. they ended up being a decent bunch … they just liked the kilt! (although a few were a bit too interested in whether I was going commando!)

but, ended up with a good story to tell when I got back to the wedding!

  9. West end of east end. Hope it was not Chris McEleny that was on line answering questions. He should know the situation by now. I have spoken to him personally and sent him lots of info about how unjust this Act is. Surely if it was Chris, he has had plenty of time to reflect, unless the party have decided otherwise. Incidentally I vote SNP. So no need to hear from you Ernie and others.

10% off season tickets if you buy before the end of June…..trying to find time to go in and see if I can cherry pick two good ones together – which sad to say often go begging, (I do to get someone to go!), so you never know they may be useful over the next season to you. Mind you’d have to keep your scarf in your pocket if circumstances dictated…!

    Dunfermline Press, 11th June, 2015

Oil worker spouts racist abuse – then attacks good Samaritan

A DRUNK Dunfermline man spouted racist abuse at a black man before ganging up with another person to launch an attack on him – then assaulted a good Samaritan who came to their victim’s aid.

Craig Kelso (37), of 10 The Castings, called his first victim a “black coon b******” and “dirty black coon” before carrying out the “totally disgraceful” attacks in Chalmers Street.

And Sheriff Charles Macnair warned that it was only the age of Kelso’s previous convictions that had kept him out of prison.

Dunfermline Sheriff Court heard last Wednesday that Kelso had been drinking at the Raffles Bar and consumed alcohol prior to the racial abuse and assaults, which took place on 19th January.

Fiscal depute Ruaraidh Ferguson said both Kelso and his first victim, a “black African” Nairobi-born man from London, had been at the pub shortly after 6pm.

“The accused proceeded to racially abuse him making comments such as, ‘I’ve just been smacked in the face by a black coon b******’. He continued using other phrases such as ‘dirty black coon’.

“The complainer left the bar and went onto Chalmers Street. He was followed by the accused and another individual.

“Whilst walking away from the bar, the accused assaulted him, grabbing hold of him, punching him to the face repeatedly and striking him on the body with his knee.

“The complainer wears glasses which were knocked off during the attack. He was injured and suffered swelling to the forehead and his right eye.

“The right eye was also bloodshot and he had cuts to his fingers.”

The attack was seen by a takeaway delivery driver, who stopped his car and attempted to intervene.

Mr Ferguson continued, “When he did so, the accused, still acting with another, then assaulted him, pushing him to the body, seizing hold of him and punching him to the head to his injury.”

The driver suffered a burst nose. Police were contacted and apprehended Kelso.

Mr Ferguson clarified that neither victim required medical attention and it did not appear that Kelso and his first victim knew each other.

Kelso admitted that on 19th January at Raffles Bar, Chalmers Street, he acted in a racially ag-gravated manner which caused or was intended to cause alarm and distress to the man, in that he used racially abusive language.

He also pleaded guilty to charges that on the same date at Chalmers Street, whilst acting with another, he assaulted the man, seized hold of him, repeatedly punched him on the face and struck him to the body with his knee to his injury; and assaulted the delivery driver, pushed him on the body, seized hold of him and punched him on the head to his injury.

In mitigation, solicitor Ian Beatson said Kelso, who works in the oil industry, had been returning home after three weeks offshore, and had consumed a “considerable amount of alcohol on his way down with another individual”.

On arriving in Dunfermline, they continued drinking, and Kelso was looking for his friend ‘Pele’ who is also of African origin”.

Mr Beatson added, “He said ‘black b******’ in a jokey way and the complainer believed it was directed at him.

“The barmaid heard his racial remark but cannot comment if it was about the complainer or Pele but she accepts his comment was unacceptable.

“The complainer quite rightly took offence at what was being said. He attempted to explain but understands that he did take offence.”

Of the assault on the driver, Mr Beatson said Kelso was “not thinking clearly at that stage with the amount of alcohol he had consumed”.

He said Kelso had not been in trouble for nine years, adding, “He’s extremely upset about what he has done and appears to be genuinely remorseful.”

Sheriff Macnair blasted Kelso for the “totally disgraceful incident, carried out when you had far too much drink”.

“The racial abuse which I’ve heard cannot be in any way described as a joke. Jokes of that sort are no longer acceptable and it was aggravated by being in a pub or immediate vicinity of a pub.

“You have some record but it is only the age of the convictions that keeps you out of prison. If this had been any more recent, you would have been going to prison.”

He imposed a community payback order with six months of supervision and 300 hours of unpaid work, to be carried out within nine months.

Kelso, reported to earn £96,000, was also ordered to pay compensation of £1000 to his first victim and £500 to the delivery driver.

WITS …. there is a bit more … there few a few young ladies at the wedding, who spent most of the evening running around lifting kilts …. and, lets just say, I didn’t do too much to discourage them! but it is a family blog, so I wont say any more!

    O.K. so here we go.

We will take a last resort crisis loan of 5Million to keep the ship sunken, then we’ll decide that it’s not in our interests to give you back the loan.

Then we’ll wait and see who else will give us another loan, with no money, no manager, no team, no development, and less than six weeks to go to continue the journey.
