CQN’S “FICTITIOUS ARTICLE ON RANGERS”

CQN this evening received a response to our article today – The Truth Hurts which you can read HERE.

Unusually this response to our feature was polite (usually they’re ‘industrial’) and put forward a counter argument.

Our critic talked of our “fictitious article on Rangers.”

To be clear fictitious means “not real or true; imaginary or fabricated”, yet the article simply outlines a series of quotes from the media and “real Rangers men” such as Walter Smith, Richard Gough and Stuart McCall from 2012, the year Rangers FC went into liquidation.

Did CQN make up these quotes? No we didn’t.

Did the Rangers support challenge then at the time they were made? No they didn’t.

As our article points out these quotes weren’t even controversial at the time they were made.

Anyway our friend from across the city wanted to get this off his chest. Here’s what he had to say…

Please take a look at the following quote, posted by the Daily Record in May 2015.

The statement comes a matter of months after SPFL chief Neil Doncaster also stated that Rangers are the same club  when he said: Doncaster said: “In terms of the question about old club, new club, that was settled very much by the Lord Nimmo Smith commission that was put together by the SPL to look at EBT payments at that time.

“The decision, very clearly from the commission, was that the club is the same, the club continues, albeit it is owned by a new company, but the club is the same.

“It’s the same club, absolutely.

“The member club is the entity that participates in our league and we have 42 member clubs.

“Those clubs may be owned by a company, sometimes it’s a Private Limited Company, sometimes it’s a PLC, but ultimately, the company is a legal entity in its own right, which owns a member club that participates in the league.

“It was put to bed by the Lord Nimmo Smith commission some while ago – it’s the same club.”

I know you cannot argue with ignorance, but if you actually bigged up the match or focused on your own team instead of anti rangers baiting, people would actually respect you more.

That’s it. The same club counter argument. Let’s have a wee look at the points raised.

DAILY RECORD 

Our feature outlines statements made in the Daily Record by their journalists and also by the so-called real Rangers men. Yet when they don’t suit they are immediately discarded as being fictitious. Our quotes come from 2012 – the year Rangers died. His comes from May 2015 several years after his club died and after the myth was created. And myths tend to be fictitious.

LORD NIMMO SMITH

Were there no football rules to deal with the death of a football club before Doncaster commissioned Lord Nimmo Smith? LNS only considered this matter while looking at something entirely different, but that takes us into the cheating territory and CQN will be dealing with that at a later date.

Did Lord Nimmo Smith actually state this or did he look at both sides of the argument? Who makes him an authority rather than for example the Court of Session judges that more recently ridiculed the notion of the club surviving liquidation?

The minute Lord Nimmo Smith becomes an authority on football regulations attention can be paid to his opinon but until then the only authority that matters is football and Andrea Traverso  Head of Licensing and Financial Fair Play at UEFA is the ultimate authority.
Our friend could have quoted ECA,  ASA and others and all of them say that it’s the same club because someone told them so. All of this is meaningless as they carry no authority. Andrea Traverso Head of Licensing and Financial Fair Play at UEFA in this instance is the horse’s mouth. Get him to tell you it is the same club and we’ll listen.

THE UEFA WEBSITE
This is simply straw clutching. Andrea Traverso is the Head of Licensing at UEFA. His statement carries the authority and the SFA, SPFL and the guy updating the UEFA website all have to follow what he says. 
Neil Doncaster’s claim that it is the same club because LNS said so is so ludicrous that it is laughable. Mr Doncaster could call Andrea Traverso  Head of Licensing and Financial Fair Play at UEFA and check for himself. He will know that not to follow the directive of UEFA would make his own position untenable. What are you waiting for Mr Doncaster?
Who makes the decisions at UEFA – the bloke who updates the website or Andrea Traverso  Head of Licensing and Financial Fair Play?


NEIL DONCASTER
Who paid for the LNS Commission?  Mr Doncaster  did. It would be amazing if the SPL CEO who paid LNS did not use something he had paid for to use it to sell an idea the SPL were desperate to cling to for commercial reasons. You can read about this HERE.
The problem for Neil Doncaster is that his interpretation of Lord Nimmo Smith is an idea that UEFA just do not agree with. Why is that?
Because UEFA value the integrity of their competitions.
The SFA are bound to UEFA rules as SPFL are bound to the SFA so Neil Doncaster’s statement is ultra vires with his claim. Also the SFA have never said RFC and TRFC are same club but significantly have failed published what UEFA said. Maybe our critic could ask the SFA to clear the matter up since they have a copy of the letter from Andrea Traverso, Head of Licensing and Financial Fair Play at UEFA. 


You see, when Andrea Traverso, Head of Licensing and Financial Fair Play at UEFA wrote to the solicitor representing a group of Celtic shareholders in June 2016 he copied in both the SFA and also Celtic FC.
So the groups who know for sure that the club that visit Celtic Park on Saturday are without question a new club are as follows:
*The solicitor representing a group of Celtic Shareholders. 


*The clients of that solicitor.


*Andrea Traverso, Head of Licensing and Financial Fair Play at UEFA  (who wrote the letter).


*The SFA. 


*Celtic FC.


Our critic should perhaps study the lines of authority more carefully before obtaining opinions of individuals or organisations that can only be opinions and clearly lack the authority which means that no attention should be paid to them.
He should go to the horse’s mouth. Write to Andrea Traverso, Head of Licensing and Financial Fair Play at UEFA and ask him straight. Say, “am I right in thinking that despite liquidation my club survived and is the same club or am I wrong and the team I think is Rangers is a new club.”
Andrea Traverso, Head of Licensing and Financial Fair Play at UEFA would surely do the decent thing and put him out if his misery.
He will probably re-state the official UEFA position which is as follows:

“As a consequence of decisions taken in 2012 as well as the administration of the club the events/measures that followed (including the new club/company being ineligible to apply for a licence to participate to in UEFA competitions for three seasons), there is no need for UEFA to investigate this matter any further since the club was not granted a licence to participate in the 2012/13 UEFA club competitions, the new club/company entered the fourth tier of Scottish Football and it was not able to play in UEFA competitions for the next three years in any event.

ARGUING WITH IGNORANCE

Finally our critic states that ‘I know you cannot argue with ignorance, but if you actually bigged up the match or focused on your own team instead of anti rangers baiting, people would actually respect you more.”
You cannot argue with the truth. His problem is that he is too scared to face it. Don’t expect us, or indeed supporters of any other club in Scotland to buy into your myth because you can’t face the truth.
Deep down he knows it, they all do.
Rangers died.
