Craig Whyte owns the club, stupid

183

Rangers’ administrator, Paul Clark, last night released an utterly bizarre statement in response to the SFA punishment for breaking a lengthy list of rules in the lead up to and since Craig Whyte’s takeover of the club 11 months ago.  Clark said:

“It appears that on one hand the disciplinary panel accepted our central argument that responsibility for bringing the Club into disrepute lay with the actions of one individual – Craig Whyte – as is evident from the unprecedented punishment meted out to him.

“During this hearing the Club produced compelling evidence from a number of sources that following his takeover, Craig Whyte ran the Club in a thoroughly unaccountable manner, rather than adhering to a long-established and proper form of corporate governance.

“The thrust of the charges against the Club focused on non-payment of payroll taxes and evidence was produced that all such decisions in this area were taken by Craig Whyte during his tenure.

“Given this evidence, it is difficult to comprehend that the disciplinary panel has seen fit to effectively punish the Club even more heavily than Mr Whyte. As everyone knows, it has already been decided he is not a fit and proper person to run a football club and any further punishment on him will have little or no impact.

“Furthermore, we do not know how bidders for the Club will react to these sanctions and what affect they will have on their proposals.”

Mr Clark should know better.  Companies, including football clubs, are responsible for the corporate acts of their directors.  Also, Craig Whyte owns 85% of Rangers and should he sell it in the weeks ahead, his sale price could be directly enhanced by a lesser punishment.

Moreover, Mr Whyte is also the secured creditor for Rangers.  Whatever bids prospective buyers of the club submit, up to around £30m, will go directly to Craig Whyte.  If this punishment reduces the value of Rangers it reduces the money Whyte will receive as a shareholder and as a creditor.

There is no point in Duff and Phelps squealing now. If they wanted to separate club from owner they should have brought more focus to the sale process weeks ago. This punishment is measured and appropriate.

The ole Postie has just delivered Emmylou Harris and the Hot Band 1975 radio shows on CD. There are a lot of these shows being released just now, including Neil Young+ Crazy Horse, Stevie Ray Vaughan and the classic Allman Brothers line-up [Allman D, Allman G, Bette, Trucks, Oakley and Johansen].

The packaging can be basic, which helps keep the price down, but the music is mainly 5* fantastic; and is a great way to fill the hours before liquidation sets into something concrete, and takes the Hillbillies down to the depths of oblivion.

  3. The way I look at it is if fans misbehave the club gets punished. If the club misbehaves the fans should get punished. I think the SFA should be fining every single Rangers fan. It’s only fair….

Seriously though, Whyte owns the club, therefore Whyte is the club (Rangers fans had their chance to own some of Rangers under SDM). To punish one you must punish the other. They also gained unfair advantage as a club by not keeping up with taxes since the start of the season, so the club must make some sort of reparation.

So what if it is unfair on the fans. The fans are not part of the legal entity.

I very much doubt Rangers could use loans as a way around the sanction. The loans will have to be registered as such at the SFA.

I think the SFA have the power to do what the Swiss FA have done and that is withold/refuse a licence but that would kill the admin process and so Rangers stone dead and they do not want that blood on their hands.

I was surprised at the one year ban, I thought worthless fines would be the response but the registration ban is going to have a very strong impact on what happens next.

I appreciate it must be a shock to your system so have a beer and I’ll pay next time I’m down your way (later in May).

  7. Brogan RoganTrevino and Hogan have done a great job of raising the profile for that poor wee lassie Niamhs illness. Many CQNr,s have already donated through his link above and the total is now just below k£160. Wouldn’t it be great if CQN rs blitzed the site and took the total over £160k make sure you use the CQN or Celtic family…..come on you Bhoys a Ghirls show them lot from Govan what raising money should be used for. Hail Hail

  8. See if Sone Aluko gets sent off for diving on Sunday are the Rangers fans able to say he shouldn’t be suspended as it would deprive them of watching a 1st team player and they shouldn’t be punished for the actions of a rogue employee?

    No?

  12. Auldheid – I genuinely thought a points deduction would be handed out. A fine is moot and a points deduction now shows they are serious but at the moment consequence free.

I was surprised the regulations were applied properly and correctly.

I am of the opinion that UEFA have spoken to the SFA and the SFA do not trust the chairmen to do the right thing by the FFP rules so they have closed some doors for them.

It was in fact a master stroke and a scenario I had not envisaged at all.

  13. Ho ho ho, what a shambles the Olympics is; surely they would have known the only way to get people up here interested would be to have each Team GB play at least one game at Hampden.

Garth Crooks with a Freudian slip already: “we haven’t won anything since 1966”

Lol sponsorship boycotts now is it?

I remember a university debate I was involved in, ordered by the socialist society, in which we were asked to consider boycotting a number of global brands including Coca Cola, Nestle and a big load of other brand names.

Did I feel sorry for trade unionists in Colombia? God yes. Would I have marched for them, raised money for them and even stood shoulder to shoulder with them had they lived next door? Of course. But trying to convince me that my not drinking Coca Cola sent an effective message …. I didn’t believe that. Nor would it have mattered much, considering how many other products Coca Cola made, most of which most people don’t even realise ARE Coca Cola products …. What was I supposed to drink? And where was I supposed to buy it, since we were also being asked to boycott Asda and Tesco over genetically modified foods ….

So the Rangers fans are going to boycott SFA sponsors. Good luck with that. When they are huddled in their pubs on match-day, and they can’t drink Tennants, and Guinness and Magners aren’t on the tap for obvious reasons … and there’s no Export or Heavy either, as they are both Tennants … and of course, they can’t watch the game, cause they are boycotting Sky and ESPN, and they can’t watch Eastenders omnibus cause that’s on BBC and besides there used to be a Henrik poster up in the cafe, in his Hoops …. and STV are biased against them for daring to report the truth, and they can’t watch Channel 4 cause that’s Alex Thomson’s channel … and David Leggat says Sky itself, and Rupert Murdoch, are engaged in the global conspiracy as all billionaires know each other (they have a wee club in Monaco where they meet every fortnight to play Monopoly with real $50’s …), and that links the old swine with Dermott Desmond ….

So Channel 5 it is, for those guys who are still not back from the bookies, which is a two mile walk although there’s one right next door, but that’s a William Hill, so that’s out ….

Yes, they thought this one through. As ever.
