D&P blow their own argument to shreds in court

The core essence of Duff and Phelps protests at the SFA judicial panel punishment handed out this week, as they state, is that: “in our opinion do the panel fail to have properly apportioned culpability between the Club and Craig Whyte”.

Yesterday we found out the truth about how Duff and Phelps really think about apportioning culpability between a company and a director.

The Lawyer magazine yesterday reported:

“The administrators are suing Collyer Bristow and Whyte’s takeover vehicle the Rangers FC Group for at least £25m in damages. The firm is accused of conspiracy, breach of undertaking, negligence and breach of trust, with Withey – who acted as the club’s company secretary – complicit in the allegations.”

The Lawyer goes on to say that Mark Phillips, QC, acting on behalf of Duff and Phelps, “told the court that there was no evidence anyone else at Collyer Bristow was involved, but that as Withey had authority to act for the firm, it was liable for the losses flowing from his “conspiracy”.

Get this clear; in the opinion of Duff and Phelps QC, as Withey had authority to act for Collyer Bristow, Collyer Bristow was liable.

Craig Whyte acted on behalf of Rangers after 6 May last year just as the old board acted on behalf of the club before then.  These people are using one argument to chase an enormous £25m but using the counter argument to subvert an SFA judicial panel.

The rules of the SFA are clear, Rangers are ‘liable’ for the actions of their directors, as anyone using this argument to pursue £25m should be well aware.  These people are shameless.

    Since it was a scripted (sort of) RFCIA recorded programme, his inane outburst had to have been sanctioned by someone in the management, which at this time has to mean the Administrators. This would be consistent with their bleating about the SFA decision in their own statement.

     

     

    In effect, who is actually running the show at Ibrokes? There is no directors, no CEO, no managing person, and other than Dupe and Whelps, only His Royal Moistness to say anything. As others have said, he spoke like a moronic fan rather than a responsible person. He also spoke from his perch of entitlement that underpins all that his culture embodies.

     

     

    The SFA will have great difficulty in ignoring the consequences of his stupidity. It is far, far worse than Neil’s comment about “decent referees”. The police, special branch, and private security are all involved in trying to protect an SFA appointed panelist from injury. Time to step up again Mr Regan.

     

     

    As for Swally, I think you are wrong.;-] He is both stupid AND a ranting condemned man. I suspect he knows that the end is nigh, hence his comment about Div 3.

    McCoist will have blood on his hands. A complete and utter fool. He should be taken to task and the book thrown at him. Proper jail time. I’m taking two of my boys on Sunday. One is 18 and he’s determined to go out with his mates after the game. I’m equally determined that he isn’t. In ‘normal’ times the huns are a danger. Their manager has ensured that the possibility of one of our supporters being killed on Sunday is a brutal and unthinkably strong possibility. The sooner they are but a memory the better. I’m renewing tomorrow. I’d pay more quite happily if they weren’t in existence. HH.

    after his words about the judicial panel and subsequent threats (allegedly) by ‘the lunatic fringe’ as someone put it! he should be facing a charge by the police for insighting violence and putting the safety of the panel at risk

  18. McCoist thinks he’s bigger than he is. I frequently socialised in many of the pubs and clubs he did in the late 80s early 90s. He never came across as a hard man but he was always team handed with pals/minders. This would give anyone a feeling of untouchableness/bigusmanus syndrome. He is and always was an arse of the highest order. Me fears though he has now taken his indestructability a tad to far. Prize arse of the highest order. It WILL come back to haunt him.

    I fear I plough a lonely furrow as I suspect I agree with no-one (except perhaps Robert Tressel)

     

     

    I am not a great lover of chief execs. I have yet to meet one who I respect as a person. They are generally physcopathic in their behaviour and I would not trust Peter Lawell, DD or any other director to represent my views.

     

     

    As someone else said earlier, my love for Celtic (the club) is unconditional and I trust many of the fans to represent me and my views because of our shared culture as the oppressed underdog and our common decency (and if I knew many of you better I’m sure I’d trust the good majority of you). It is this that I love about my club and this feeling is not conditional of the actions of the Celtic Board, the SFA, the SPL, the huns, their apologists or anyone else.

     

     

    Since when was our relationship with the club dependent on the actions of the paid employees at Celtic. None of us stopped supporting Celtic because of what Tony Mowbray did to the team.

     

     

    I trust Neil Lennon because he is a supporter. I trust the GB because it is they who brought the thunder back to Celtic.

     

     

    In these difficult times, our club needs us more than ever.
