D&P blow their own argument to shreds in court

The core essence of Duff and Phelps protests at the SFA judicial panel punishment handed out this week, as they state, is that: “in our opinion do the panel fail to have properly apportioned culpability between the Club and Craig Whyte”.

Yesterday we found out the truth about how Duff and Phelps really think about apportioning culpability between a company and a director.

The Lawyer magazine yesterday reported:

“The administrators are suing Collyer Bristow and Whyte’s takeover vehicle the Rangers FC Group for at least £25m in damages. The firm is accused of conspiracy, breach of undertaking, negligence and breach of trust, with Withey – who acted as the club’s company secretary – complicit in the allegations.”

The Lawyer goes on to say that Mark Phillips, QC, acting on behalf of Duff and Phelps, “told the court that there was no evidence anyone else at Collyer Bristow was involved, but that as Withey had authority to act for the firm, it was liable for the losses flowing from his “conspiracy”.

Get this clear; in the opinion of Duff and Phelps QC, as Withey had authority to act for Collyer Bristow, Collyer Bristow was liable.

Craig Whyte acted on behalf of Rangers after 6 May last year just as the old board acted on behalf of the club before then.  These people are using one argument to chase an enormous £25m but using the counter argument to subvert an SFA judicial panel.

The rules of the SFA are clear, Rangers are ‘liable’ for the actions of their directors, as anyone using this argument to pursue £25m should be well aware.  These people are shameless.

    Nah I’m glad Chelsea won. Another Latin sense of entitlement blown away. Good.

     

    Now Real Madrid will expect their Latin sense of entitlement to kick in.

     

    I hope Bayern finish them off. If not then Latin entitlement for what ? the 10th time

     

    as there is no way this will be the first London European cup victory.

    The only drawback for Celtic is that our best players will always go for less money than a hyped-up-journeyman e.g. Andy Carroll or Darren Bent simply by being in a smaller (TV) market.

     

     

    I agree with the sentiment and have for many years that we haven’t been maximising our potential for a long time, mainly because the vast majority of players we’ve bought since ’02 have had very limited asset management potential and when we’ve tried, we’ve made big money mistakes e.g. Loovens.

     

     

    Many of the players Neil Lennon has bought have been of a better potential.

    Sheer embarrassment is killing the huns. Its the ultimate shame and they know the world is watching, just as they know we are revelling in it. Their cosy existence in Scotland is over. Their reputation was built up by years of bigotry, racism and violence. The only defence they ever had was to drag us into their cesspit, with the help of the MSM. Thats gone too. We can never again be mentioned in the same breath and the OF tag must also be binned. Celtic have two wonderful things that the huns will never have, a proud and famous world wide reputation and the big jug. It will hurt like hell for them as they go into the anals of sporting history as the the most corrupt and infamous football club in Britain and probably Europe. They will deal with it as only they know how, with violence, vandalism….and an increase in Orange walks.

  19. Two fantastic CL semi finals. So much for an El Classico final.

     

     

    Both Chelsea and Bayern gave manly displays and the biggest two sides in the world couldn’t match them. Chelsea gave an old fashioned English perormance while Bayern were typically Germany focussed and strong mentality.

     

     

    Chelsea’s first goal was the best I’ve seen in a long long time. Drogba for all his playing acting in the first game played like two men. Fantatic performance when it mattered.

     

    Barcelona over the past week have badly missed David Villa. And the reason it isn’t an all Spanish final is down to the standard of forwards both teams have supporting Messi and Ronaldo.

     

     

    Not been a good year for the favourites in semi finals.

    Got to agree with whoever it was who mentioned the whole German subsidy of the Spanish giants. Have for a few years had an admiration for Barca and have a son who is, it would seem a bigger Barca fan than a celt. Don’t ask! Anyway. I still admire the style that Barca have and the workrate,attitude and ethos.

     

    However. This fabled ethos must be entire. As I understand it, and I’m happy to be corrected, both Barca and RM have and continue to benefit from ‘debt write off’ of some description or the other by the Spanish Govt.

     

    Nobody can be unaware of the degree of financial support provided to Spain among others by what for easy counting is effectively the German taxpayer.

     

    So we’re talking about football clubs who achieve success by not paying off their debts.

     

    Sound familiar?

     

    I’m not trying to say that Barca are the same as the huns cause they’re not.

     

    But I just feel that this is a similar feeling of entitlement among some of these clubs.
