Ellis throws administration a legal curveball

1263

The very last thing anyone connected with Rangers wanted to read this morning is that Andrew Ellis, Craig Whyte’s former associate, is suing the Rangers owner for 24.9% of the club’s shares.  This puts a further legal impediment in the way of any potential transfer of shares or stadium assets from Whyte to a new party.  It remains to be seen if Ellis is in a position to legally enforce his claim however the veracity of his claim may be moot.

Prospective Rangers buyers do not have time to spend in court hearings and appeals before the start of the new season.  If a phoenix (or even a CVA) is to be put in place it is likely that those with a claim, any claim, will need to be satisfied.

This development comes a week after Whyte transferred the security over Ibrox he holds through Rangers FC Group Ltd to Liberty Corporate Ltd.

Legal issues over ownership of shares and assets aside, Rangers’ administrators still have to deal with creditors, in particular, HMRC, who will soon learn if their tax demand against the club has been upheld by the First Tier Tribunal, and Ticketus.  Duff and Phelps were denied the right to set aside the deal which Ticketus struck with Rangers to buy thousands of seasons tickets, leaving a path open for Ticketus to present a legal challenge to any deal which does not recognise their interests.

Chances of an early exit from administration appear to be diminishing by the day. Motherwell were in administration for four days short of two years between April 2002 and April 2004. If Rangers are not out of administration on the morning the new season kicks off they would start on minus 10 points.

    Interesting fact #26:

A higher percentage of dogs was rescued from the Titanic than either adult male second or adult male third class passengers and also higher than the percentage of adult males overall.

    Interesting fact #27:

First Class Male passengers were more than twice as likely to be a survivor than their servants (based in the same class).

    Not so interesting observation #1:

Both of the above are statistically insignificant in that the numbers (9 dogs, 2 saved & 12 servants, 2 saved) are very small.

  6. You know, this is shaping up to look like the same scenario as happened to that poor Mister Sir David Murray, the naive millionaire philanthropist who was duped by that evil, world domination type mastermind Mister Craig Whyte. Oh, how inviting that pound sterling must have looked at the time Mister Sir David. Now, that poor unassuming naive businessman Mister Ellis Esq, looks like he’s been duped too. Oh, the humanity!

Will no-one save these poor, misguided Captains of Industry?

  7. Interesting fact #28:

All female servants (all based in 1st and 2nd class) survived whereas their ‘mistresses’ did not fare so well: 97% & 86% survival rates amongst 1st and 2nd class adult female passengers respectively.

  8. if we can i’d be happy to see O’Dea, Murphy, McGinn, Majstorovic, Cha, M.Wilson, Loovens, Rasmussen leave in the summer.

As much as i like Both McCourt & Juarez i think they will be sold, For their own careers i would say it’s better if they left. I can’t see either starting when we have Brown, Commons, Kayal, Ki, Ledley, Forrest, Wanyama, Ibrahim, McGeouch. I have no doubts McCourt & Juarez will go to other Clubs and be a huge success. They are both quality.

So in all that’s 10 players. Easier said than done getting players out but that’s what we should be looking to do. Add 2 or 3 players of real quality. We need to stop buying squad players. Trim the squad, Less players…more quality.

  9. Duff & Duffer, MSM, CW and McCoist are all incredibly optimistic about avoiding Liquidation. Can anyone explain to me what this confidence is based on? Is it genuine or just for show? I am no accountant. Please explain

  15. I dont know Joe ORourke so cant hand on heart say whether he is a bigot or not, what I am clear on his comments however intended were foolishly insensitive to say the least, im led to believe Joe has apologised whether hats enough is open to conjecture, what i am just a wee bit wary of here is us being seen as holding some level of double standards on such issues, if there is a suggestion that Joe was only passing on or commenting on an old joke (however much in poor taste) thats been doing the rounds for years well thats okay then is it?

thatll be much the same as Hugh Dallas and that infamous email.

Both in my opinion were wrong, both should never have been circulated far less repeated.

DO you know if Rangers IA have met the SPL membership criteria for this season ?

I can give you a lengthy list of stuff that had to be done by the 31st March

As HMRC might own Ibrox by then I presume that this has not been done

Does look like your softening us up for the -25 points for 5 years for Govan FC.

Anyway I wont push you on it I kind of feel it is inevitable

Which takes me back to my first ever post on CQN concerning the Old Firm

regardless of what Peter Lawwell says it is our actions that determine what we are.

If we chose Old Firm yet again and help to rebuild that brand then Celtic FC and its PLC is standing on quicksand

We will know for sure in about 15 weeks. I suspect sooner due to marketing etc.

Aw_Naw….you say you haven’t met a Celtic fan who does not feel the same way as you. I am one. If Celtic don’t protest, then I’ll be joining you. If Celtic do, as I expect, then why would I be abandoning (punishing) Celtic in their (huns) hour of need?

If Scotland along with Celtic tell MIchel Platini to GTF especially with Brian Quinn being so integral to the FFP I think no national team for Scotland and no European football for Scotland while Rangers IA avoid oblivion

  20. Does anyone know if they are going to pay up front for the tickets for the forthcoming game because there is no way we will get the money afterwards, we are talking about 300k, plus they still owe us around 40k, therefore if the dont pay up front THEY DON’T GET IN!!

  21. not Celtic related but for anyone who is on twitter and likes a laugh, you should follow Leon Knight…the chap is pretty out there. He is saying SWP only got a deal because of his dad, and having goes at other various people, quality stuff!!

I expect Celtic protestations will be highly publicised. Thick in presentation low in substance. We are very adept at that.

I tend to make my own decisions in life and I prefer my sport to be based on sporting principals not financial ones.

If you want to contribute to being Rangers bitch and saviour nobody is stopping you. Certainly not me but plainly you can see why others would not want anything to do with that set up

  23. afternoon, while coming down from a champion weekend in Ayrshire where I witnessed the Bhoys win the league in the company of my youngest for the first time, my special memories will also include geting the best bruise ever after skelping my leg of the back of a seat at goal no.1, thanks Charlie, and being unable to find where I had parked the car, thanks google maps and modern phones saved the day.

I have been googling the ~RgersIA bidders and found this on the US bloke Bill Millar, looks lke the kind of guy who will fit right in down govan way.

‘Four shareholders have filed a lawsuit against former executives of Team Sports Entertainment Inc., which failed to create a stock-car racing league that would compete with NASCAR. That effort, Huntersville-based Team Racing Auto Circuit, was abandoned in August. Its first season was supposed to begin this spring.

The suit alleges breach of contract, wrongful conversion of company monies, mismanagement, breach of fiduciary duty and fraud. Named in the suit are William Miller, former chief executive of Team Sports, and Jon Pritchett, former president.

In a press release about the suit, shareholder Edward Garland says, “The company and its directors thought they were getting an experienced CEO capable of completing the company’s team auto racing concept. Instead it got a man full of greed who wanted control of the company for himself.”

The suit, filed in Fulton County, Ga., Superior Court, pins Team Sports shareholder losses of more than $50 million on the former managers.

Miller left TRAC in August 2002 and Pritchett departed soon after.

The son of former Dunfermline keeper, Scott Thomson, Robbie has followed in his father’s footsteps and pulled on the gloves. He has worked his way through the ranks at Celtic, learning his trade between the sticks. Nick Feely’s return from injury pushed him down the pecking order in the latter stages of last season but with the Australian progressing up to the Development Squad, Thomson’s final year at 19s’ level will be crucial to his progress.
