Ellis throws administration a legal curveball

The very last thing anyone connected with Rangers wanted to read this morning is that Andrew Ellis, Craig Whyte’s former associate, is suing the Rangers owner for 24.9% of the club’s shares.  This puts a further legal impediment in the way of any potential transfer of shares or stadium assets from Whyte to a new party.  It remains to be seen if Ellis is in a position to legally enforce his claim however the veracity of his claim may be moot.

Prospective Rangers buyers do not have time to spend in court hearings and appeals before the start of the new season.  If a phoenix (or even a CVA) is to be put in place it is likely that those with a claim, any claim, will need to be satisfied.

This development comes a week after Whyte transferred the security over Ibrox he holds through Rangers FC Group Ltd to Liberty Corporate Ltd.

Legal issues over ownership of shares and assets aside, Rangers’ administrators still have to deal with creditors, in particular, HMRC, who will soon learn if their tax demand against the club has been upheld by the First Tier Tribunal, and Ticketus.  Duff and Phelps were denied the right to set aside the deal which Ticketus struck with Rangers to buy thousands of seasons tickets, leaving a path open for Ticketus to present a legal challenge to any deal which does not recognise their interests.

Chances of an early exit from administration appear to be diminishing by the day. Motherwell were in administration for four days short of two years between April 2002 and April 2004. If Rangers are not out of administration on the morning the new season kicks off they would start on minus 10 points.

    During WW2 it was standard practice for a member of aircraft maintenance crews to be picked at random to go on the test flights of the planes they had been working on.

  20. I was recently debating the old Sky Sports deal in work and my two co-pontificators (one of us and one of them) were both of the opinion that there would be no Sky deal at all without Rangers. I, on the other hand, think that there would still be a deal, albeit on a lesser financial level, on the basis that Sky would rather have some viewers than none at all.     It shows that in Q3 of last season average SPL viewing figures were double that of La Liga for Sky. And our peak audience is higher than the Ashes was in 2010. Our average is above many of the minority sports they cover.

     

     

    It would be even if based solely on viewing figures excluding all matches where Rangers were involved.

     

     

    If the tv deal without Rangers was as much as halved but distributed evenly, I think all clubs outside Celtic would benefit. To me that is the offer we need to make, in order to keep tehm out.

  21. I have had the good fortune to meet Joe O’Rourke while he was over here in Toronto a couple of years ago. I found him to be very pleasant and a great ambassador for Celtic FC. Joe visited our supporters club in Toronto and during the visit advised us of the Walfrid Wells Campaigne, which is one of the initiatives of the CSA. The Toronto # 1 Celtic supporters club have contributed to the funding of several wells being constructed in Africa, so that local people don’t have to walk a full day to get water. Joe does a lot of great work for charities and although he made have made an ill advised comment, he should not be removed from his position for doing so. He’s apologised and that’s good enough for me. How many on here have said something that they later regret? I know i have.

    Awe Naw, not sure where you are going with your last comment, or question. Have I overlooked anything or is there a rule that states clubs will be expelled if they do not submit accounts by the previous 31 March?

     

     

    I have read the Articles many times and I am sure this is not the case. There have also been three clubs in the last 10 years in this situation, none of whom were expelled.

     

     

    I, and many Celtic fans, have been delighted by the public statements from the club on not being dependent on Rangers. Celtic have no intention of voting a Newco into the SPL, this (if you indulge me) only exists in the realms of one of your persistent fantasises :-)

    Ignore any optimism about avoiding liquidation unless it comes from HMRC, who will decide if a CVA will happen. All other parties would prefer a CVA and so have an incentive to see it happen, HMRC will not be influenced by this.

    It is interesting that precedents have already been set as Paul67 has asserted.

     

     

    For me that is good enough for Rangers IA not to be singled out. They can point quite rightly to precedent.

     

     

    I can see Rangers reintroduction via a parachute all going very smoothly internally within Scotland especially as Paul67 has pointed out that our governance is a joke cloaked and couched in ambiguous language that and FRATERNITY would be happy to propagate. Celtic will show discontent in whispers that nobody will hear except for the defiant Celtic fan with the chip on both shoulders. That will bring the defiant mob out who will compensate those that are not interested in Old Firm. Poor wee Celtic canny day A thing in this sh*t ridden corrupt wee country etc..
