Ethics of exposing a vulnerable man, Pythonesque statement

337

You know what I think, defeats from rivals only do limited damage, the toxic poison comes from within.  Internecine strife, Bear on Bear action, can rip Newco apart.

I don’t know what Lee Wallace and our old pal Kenny Miller said to Graeme Murty on Sunday, but if it was along the lines of ‘You are out of your depth, incapable of operating at this level and exposed for what you are’, they would be correct.  That doesn’t make them right, though.

Speaking truth to the boss sounds like a good idea but commonly all it does is isolate you, weaken the boss and make everyone’s job more difficult.  Kenny Miller reached the Champions League knock out stages under Gordon Strachan, he knows what a good manager looks like.  Along with the rest of the world, he knows Murty is vulnerable and out of his depth, but it is not ethically, or tactically, a good thing to expose his vulnerability.

Whatever Miller and Wallace said was almost certainly right, but ethically it is up there with the solicitor-cum-tax advisor-cum-porn star-cum-convict Paul Baxendale Walker, who was Sir David Murray’s chief architect at Oldco and who faced a bankruptcy court hearing this week.

What an absolute shower.

Loved the statements yesterday.  ‘We’re so upset we are going to be quiet’, is Pythonesque.  It sits alongside ‘I fart in your general direction’ as an absurd masterpiece.

Just brilliant that another fan group caught the zeitgeist by telling fans “Millions have been ploughed into the club by the current board”.  So let’s not be hastily apportioning blame to Dave and Co.  I hope neither group realise how much fun they give.

I’ve read at least one statement that the Celtic Board have done nothing about the cheating Rangers indulged in.

Now there may be an argument that they have not done enough, or what they have done is ineffective, but it is simply untrue to say they have done nothing.

Evidence of such and a possible reason why it was ineffective can be read at

Auldheid, thank you for your work and explanation in the most recent Not the View regarding the discount option scheme, EBT’s, both resultant tax cases and the SFA UEFA licence debacle.

Your very easy to follow details of what happened were much appreciated.

I’ve never had any doubt that KevJ is a Tim; I also think he has made some very good points.

However, he continually attacks a significant number of Celtic fans and expects do do so with impunity. He also regularly makes sweeping statements and avoids answering direct questions put to him. That’s fine, it’s his choice but he cannot play the “poor me” card when people respond to what he says.

It is also disingenuous to use the “poor health” card; the profile of many posters on here (i.e auld bastarts) means that many posters will be suffering from ill-health, many chronically.

Kev has an opinion he is entitled to but if he ruffles the feathers of there posters he has to be able to defend his position as we all do.

Credit for the Not The View Wee Tax Case summary goes to a Huddleboarder who also posts here.

He put a lot of good work into summarising a 17 page Timeline that covers events from 2000 to date, including SFA handling of letters putt to SFA by Res12 lawyer.

The Not The View article with some minor adjustments could go on line. It’s about timing.

I for one don’t think our board has done enough to challenge the cheats or the continuity myth.

Back in 2011/12, I was happy to go along with the “Don’t interfere with your enemy when it’s destroying itself” strategy which worked mainly because the fans of other clubs put sufficient pressure on their clubs to vote against Sevco’s entry to the SPL or League Division One.

Since then I don’t think we’ve done nearly enough to take on the cheats inside Ibrox or their pals in the corridors of power. In fact, we passively stood back and allowed Ogilvie to be re-elected without any challenge that I could see. I believe that emboldened the cheats and their allies to promote and persist with the continuity myth and our cause was not helped by Dermot Desmond’s statement about them being the same Rangers etc. When you add in the failure to effectively challenge the inclusion of Rangers (1872) history and honours on the SPFL website or even only include Sevco history from 2012 in our club programme, I get the sense that the club isn’t really serious about tackling the cheats. I also feel there’s been collusion between the two clubs over ticket prices (KevJ’s £49 gripe) which is telling the world that the Old Firm brand is back no matter how many times we refer to it as the Glasgow Derby.

Obviously, I was delighted to see Peter Lawell’s letter to the SFA but I now fear it was too little too late. I would still like to be proved wrong but my green pound stays in my pocket till then.

  17. Yesterday Auldheid posted about the UEFA CFCB ruling against Sion and it got the wheels turning in my memory bank…

This is the link to the ruling that Auldheid posted:

    https://www.uefa.com/MultimediaFiles/Download/OfficialDocument/uefaorg/ClubFinancialControl/02/55/17/57/2551757_DOWNLOAD.pdf

The thing that immediately jumped out to me was a name of page 1 (convenient huh?). That name was C. Flint QC. That’s Charles Flint. “Hey, I know that name”, I thought to myself, and Google helped jog my memory:

“In September 2012 he was appointed as a member of the commission set up by the Scottish Premier League to investigate the affairs of Glasgow Rangers Football Club. ” (https://www.blackstonechambers.com/barristers/charles-flint-qc/)

But I didn’t have time at that moment to do more research/memory-jogging, however this morning I was up very early and had a spare half hour and dug into my memory banks and had a chat with our good friend Google. I found it – I found where I knew the name. Charles Flint QC was one of the 3 stooges that “unanimously” decided that:

    “(5) Although the payments in this case were not themselves irregular and were not in breach of SPL or SFA Rules, the scale and extent of the proven contraventions of the disclosure rules require a substantial penalty to be imposed;

    (6) Rangers FC did not gain any unfair competitive advantage from the contraventions of the SPL Rules in failing to make proper disclosure of the side-letter arrangements, nor did the non-disclosure have the effect that any of the registered players were ineligible to play, and for this and other reasons no sporting sanction or penalty should be imposed upon Rangers FC”

The Nimmo Smith Commission. Charles Flint QC was on the Nimmo Smith Commission.

Now, from the above we are reminded again of the very well established fact that their findings were deeply, deeply flawed due to their belief that the “the payments in this case were not themselves irregular”. We all know that the Commission needs to be set aside and that and independent review of Scottish football 1999 – 2011 (at least) needs to be reviewed.

However, on the Licence front…I started wondering, “was Charles Flint involved in the CFCB case against Giannina?”. I have yet to find anything that indicates he was as I and find the report document (Auldheid, a little help?). If he was (and probably still if he wasn’t) then I would contend that Charles Flint QC would be a very useful participant in any independent review of Scottish football given his first hand knowledge of 1) the Nimmo Smith Commission and the flawed findings; and 2) UEFA licensing issues with particular reference to overdue tax liabilities.

Now we just need an independent review to be forced through. The consensus seems to be that the findings of the Compliance Officer will be the catalyst for this…it’s just a matter of him finding the most opportune time to bury the bad news…

  18. For those interested UEFA CFCB have sanctioned a Kazakhstan club Irtysh for playing in UEFA competition they were not eligible for on account of having overdue tax at 31 March 2017.

The Kazack FA appear to have escaped sanction for granting the licence when they shouldn’t have.

    I’ll post more later.
