Fan power begins to flex its muscle

I am sure Neil Doncaster’s job is full of stresses and strains but this week will probably be a breeze.  Fans of every club in the league appear to be in uproar at the resolutions for an Insolvency Transfer Event to be voted on later this month. Infuriating everyone is surely better than infuriating most but leaving one group happy.

Fans of 11 SPL clubs have reacted in horror that the league seek to introduce a facility to allow a liquidated club to phoenix straight back into the top tier of Scottish football.  Fans of Rangers, while along with administrators and bidders for the club are publicly opposed to liquidation, are outraged that this new facility to allow a new club entry to the SPL should carry a sporting and financial inhibitor.

For clarification: the inhibitor is there to ensure clubs have a modicum of moral hazard against gaining an unfair advantage before ditching creditors and their old skins, and emerging in the SPL with player registrations from another club but without the debts or consequences of mismanagement.

Rangers US and Singapore based bidders seem unperturbed by the proposals.  Paul Murray’s Blue Knights consortium has curiously lost its tongue.  Maybe this helps explain all those years when the EBTs were unopposed by the former Rangers board.  Silence, not even an utterance!

There remains three possible outcomes to this issue:

The proposed SPL resolutions will be passed, allowing a Newco straight entry to the League.

The resolutions will fail and the SPL board will vote a Newco into the league anyway.

The resolutions will fail and the SPL board will deny Newco a place in the league.

Celtic Quick News first flagged this scenario in October last year when we predicted Newco would be given a parachute into the SPL, opposed only by Celtic.  As the key resolution (2A) requires only 8 votes I still expect this to happen, despite the ‘Bring it on’ view of many Rangers fans to the prospect of starting again from Division Three.

As the financial penalty resolution (2B) requires 11 votes I expect this to fail and no financial penalties to be imposed.

The question for Kilmarnock, Dunfermline, St Mirren, Inverness, Motherwell, St Johnstone, Hibs and Kilmarnock (don’t tell me they’ll not try to get two votes, they have a huge mountain of debt to service and have every right to demand two votes) is, will they listen to their fans or their bank manager?

Dundee United and Hearts, like North Korea, appear convinced of their own superior wisdom and, like a North Korean missile, could head off in any random direction to demonstrate their contempt for clubs scared of providing satirists with material.  They could easily vote themselves into a Gorgie-Tannadice League, if they could agree on a Gorgie-Tannadice/Tannadice-Gorgie naming convention.

For now, if you care about any of this, participate in the online SPL Fan Survey.  We’ll soon find out who runs Scottish football, fans or the Bank of Scotland! One additional point about democracy, it carries responsibility. In this instance, stopping Newco means fans of all remaining clubs have to step forward in increasing numbers to buy season tickets. This is the cost of sporting integrity.

    What was the situation regarding Gretna and their demise?

     

     

    I recall that they couldn’t meet wages once their benefactor withdrew, and they ended up being demoted, or has my aged memory done for me again.

     

     

    Are there any parallels with RFCIA and the SPL proposals?

    n the spring of 2008 it was revealed by the administrator, Wilson Field of Sheffield, that Gretna had creditors of nearly £4m and assets (Raydale Park) of less than £1m. HM Revenue and Customs was owed nearly £600,000 in total, and it was their threat to wind up the company that precipitated Gretna’s move into administration. On 8 May, the administrator set a deadline of 17 May for a buyer to be found, or the club would be liquidated.[25][26]

     

    After that deadline passed without a buyer making a firm offer, all the remaining employees were made redundant, but it was reported that the club were still negotiating with an interested buyer.[27] On 29 May, Gretna were relegated to the Third Division due to their financial struggles, with the Scottish Football League threatening expulsion should a takeover not be completed within a week. After a takeover bid fell through on 1 June,[28] the administrators confirmed the following day that they would look to sell Raydale Park to someone who will use the site for something other than football.[3]

     

    Gretna resigned from the Scottish Football League on 3 June.[29] Near neighbours Annan Athletic won the vote to replace Gretna in the Scottish league.[30] With no ground, staff, players or a competition to play in, the club’s dissolution was inevitable and the club was formally liquidated by the administrators on 8 August.[5]

    Lets say, in absence of previous year accounts, SFA grant Newco a license based on sensible projections and proof of funding. Just as they may have done for start-up clubs. How then can they be blamed for SPL decision to include them in top tier and consequently be disregarding UEFA’s spirit of fiancial fair play?

     

     

    Can SFA state that they gave Newco a license just as they would any other club according to precedent and absolve themselves of responsibilty?

     

     

    I understand their position is as guardians of the game but denying a license according to their rules would seem an unfair stance.

     

     

    Should they instead, already be vocal on the SPL proposals put forward? As these are certainly damaging to the game.

     

     

    Perhaps speaking on behalf of all the clubs beneath the SPL who have been leapfrogged by a new club who has never won a single game of football?

    Also that Middlesborough had repurchase their original badge design.

     

     

    They must be stripped of previous titles and these titles awarded to the cheated runners up.

Its about sitting watching the media, the SFA, the SPL, Alex Salmond and perhaps even HMRC and now UEFA (David Taylor?) all colluding and contorting themselves to manufacture safe passage for the huns.

     

     

    Even if the huns do end up in the third for years with half a history, we have seen and read plenty to show it is blatantly obvious what the rules and integrity mean to the establishment.

     

     

    The huns are the establishment, always were, always will be.

     

    The independant bastions of fair play, the new broom that is Doncaster and Regan never made an iota of difference.

    Rules are an irrelevance.

     

     

    Even if the walls of the SFA come crumbling down, a new order will form and it will be as you were.

  9. Another important feature of the administration procedure is the statutory moratorium. The commencement of the administration procedure imposes a freeze in proceedings or executions against the company and its assets. This provides the company with breathing space to make arrangements to restructure the company, reorganise or reschedule their debts.

     

    The moratorium ensures that:

     

    • No resolution may be passed or order made for the winding-up of the company.

     

    • No steps may be taken to repossess any goods under hire-purchase agreements that are in the company’s possession or to enforce any security over property of the company.

     

    • No legal process may be instituted or continued against the company or its property unless the court gives leave.

     

    • Section 11 (3) of the Insolvency Act 1986 states that no steps could be taken to enforce any security over the company’s property.

     

    With the leave of the court or with the administrators consent the statutory moratorium may be relaxed. Under the old provisions several test cases have arisen and have been used by the courts to spell out their approach to the granting of the relaxation of the statutory moratorium.

     

    There are nine possible exit routes from administration:

     

    • One year after the company enters administration, administration comes to an end automatically.

     

    • By court order made by the administrator.

     

    • By the administrator, who was appointed out of court, filing a notice that the purpose of administration had been achieved sufficiently.

     

    • On an application made to the court, by a creditor claiming that there was an improper motive on the part of an administrative applicant, for an order under paragraph 81.

     

    • The court making a winding-up provision on the grounds of public interest.

     

    • Where a notice for a creditors’ voluntary liquidation is filed by the administrator.

     

    • Where a notice is filed by the administrator for the dissolution of the company.

     

    • Where the court makes a termination order as the creditors failed to agree to the administrator’s proposals or the revised proposals.

     

    • By court order where the administrator’s actions have unfairly harmed either creditors or members.

    The key parts seem to be that

     

    RFCIA have potential buyers and Gretna didn’t.

     

    And

     

    Gretna were relegated to the third division due to their financial struggles

     

    And

     

    HMRC provoked Gretna’s demise by threatening a winding up order.

     

     

    Wonder why Gretna didn’t move into liquidation and do a Newco with Annan, apart from any local rivalry issues?

  11. 67 heaven – while I know Paul tells us how Celtic will vote I am becoming increasingly concerned with the silence emanating from CP. Celtic should be screaming from the rooftops by now – and please dont excuse it all with us maintaining a dignified silence. Of all the clubs impacted by Rangers behaviour Celtic (and the supporters) are the hardest hit.

     

     

    Perhaps they are awaiting for the outcome of the tax case – but when the SPL produced the drivel they have they HAVE to react to it.

     

     

    The silence makes me doubt their intentions – and lets face it they dont give two hoots about us as supporters.

    It is just a time-line mate, to be fair as a company (name) Portsmouth FC was not in admin but the company that owned it, and payed all the bills, was. To be honest mate, I get really sick of all the shenanigans that goes on and credit to Craig Whyte (by accident as opposed design) for showing up the world of companies as often a sewer populated by vipers.

     

     

    At the end of the day don’t those in office appreciate that all that is going on is having a massive influence on the thinking of the children. Never mind how it will all end but all the bias and prejudice will mould minds accordingly and proportionately.

    A wee tip about weed-killer for ol’tim – add a wee drop of washing up liquid to the mix; It acts as a wetting agent for want of a better explanation. (from several process engineers and a couple of farmers)

     

     

    I buy my weed-killer by the drum and the first thing I do is add a bottle of washing up liquid before I dilute it. Also if he buys it concentrate from the suppliers he’ll get it for about a quarter of the price.
