Finding sharpness, from the same players, with the same message

No one would have enjoyed hearing the score come through from Alicante last night as Spain crushed World Cup finalists Croatia 6-0.  By any normal measure, there should never be six goals between these sides, but team dynamics are more than just players and tactics.  Croatia exhausted every ounce of emotional energy at the World Cup.

Every clichéd action must have taken place as they overcame yet another opponent on the way to the final in Moscow.  After the dam burst against France, how do you recapture that belief that you are invincible?

There are parallels with Celtic last season.  With an invincible treble bagged, Celtic broke their own Scottish record for an undefeated run of games, but soon thereafter capitulated at Tynecastle.  Defeats from Kilmarnock, Hibs and Aberdeen followed.  The players could still raise their game, specifically to find fresh ways to humiliate Newco, but whatever it took to allowed them to reach remarkable levels every single game was gone.

Just as Celtic recorded another treble, Croatia will recover; the defeat to Spain was an aberration, but the formula for pushing players to the limit every game is elusive.  Celtic will comfortably win 8-in-a-row, but a challenge for the next phase of Brendan Rodgers reign will be to repeatedly find the same sharpness, from the same players, with the same message.  That will take more than “Here we go again!”

    “There is a reason why there are so few cases of Corporate negligence in this country.”

     

     

    Turns out there are many reasons, not least the incompatibility of the concept of mens rea in Scots Law with corporations. In essence, Scots Law does not consider that a company can have a mind, guilty or otherwise, and without a guilty mind, you can’t be guilty. This was brought out in the dreadful Transco case, and despite the introduction of Corporate Manslaughter and Corporate Homicide Act 2007, has not been resolved since.

     

     

    Health and Safety law is a matter reserved to Westminster, and a number of attempts at the Scottish Parliament to address the issue have fallen because the parliament is not competent to make criminal law in this area.

     

     

    H&S enforcement is a matter primarily for the HSE, who in Scotland are responsible for investigating incidents, following which, the matter passes to Crown Office for prosecution, if appropriate. This is a matter of course when death or serious injury occurs. Despite the 2007 act, no company has been convicted of corporate homicide in Scotland, although a number of company directors and other senior managers have been prosecuted and jailed.

     

     

    It’s a matter of concern generally that you are right to raise, but no one has yet been able to address it adequately.

     

     

    In terms of the crush at Celtic Park, in the first instance HSE should be notified of the incident. I expect this has already been done by Celtic and/or the Cops under RIDDOR as it was a “dangerous occurrence”, and a number of people suffered an injury. HSE are duty-bound to investigate it if it meets their thresholds.

     

     

    In the event that HSE finds H&S law was broken, COPFS will mark the case and decide whether to bring a prosecution. In the last two years there have been 9 such successful prosecutions.

     

     

    Mostly likely though, the investigation will result in an enforcement notice being served to do or discontinue doing the thing that caused the incident.

     

     

    None of this helps those who were injured in the incident at Celtic Park, and that is a matter of civil law. Celtic and PoliceScotland owe a duty of care to the public, and where a member of the public is injured or suffers loss as a consequence of a breach of that duty of care, the courts will award damages. This happens umpteen times each year in Scotland.

     

     

    On balance, it’s likely that HSE will conclude any investigation with an enforcement notice to Celtic and/or PoliceScotland, and absent any other factors, that will be the end of the statutory process.

     

     

    The council will review the matter under their public licensing remit in due course.

     

     

    For any civil proceedings, it’s over to those who were injured to take action themselves for compensation for any injury/losses, which are likely to be modest given the injuries reported.

     

     

    In the meantime, Celtic have commissioned an independent report from acknowledged Event Safety experts, which is a responsible thing to do in the circumstances. Anyone who wishes to contribute to that report is encouraged to, which is also a responsible thing to do.

     

     

    All of which one trusts will ensure that such an incident cannot recur.

    I always thought that our invincible run worked against us. At the end of Brendan’s first year we should have been putting out fringe players, giving our core a chance to recuperate after the League was won. Instead we were still fighting on. We must have one of the shortest closed seasons of any club. I think it was a factor in last season being much more of a slog.

  9. The gist of the article is spot on. it’s difficult to enthuse and inspire/motivate players continually in the domestic environment where, realistically at this time, we should start as treble favourites every season.

     

     

    So too with some fans, my 13 year old son for example. (I’ll happily watch celtic playing pretty much anyone!)

     

     

    It impacts too on recruitment where visits to Hamilton, Kilmarnock, Motherwell and Govan hardly entice players who have consulted TripAdvisor.

     

     

    It’s part of the reason that top calibre European football is so important to us as a Club.

  13. Steve Clarke and Kilmarnock have been charged by the SFA over comments in which he criticised referees and the disciplinary committee.

     

     

    The Kilmarnock boss was unhappy with a red card shown to Gary Dicker in the 1-0 defeat to Hearts last month, as well as the subsequent decision not to overturn the decision.

     

     

    Clarke arrived at his press conference with a prepared statement in which he hit out at the decision. He insisted it wasn’t overturned because they dare not undermine Willie Collum as he was due to officiate the following weekend’s clash between Celtic and Rangers.

     

     

    And now he has been charged by the SFA over allegedly breaking two rules due to his comments, one for implying bias or incompetence of a match official and another for bringing the game into disrepute.

    Think the word negligence is self explanatory (even in Scotland) though some might have difficulty understanding that. For the record I believe Celtic FC were negligent in relation to both crowd and stadium safety. In that their decisions and changes put thousands of supporters at risk. New segregation arrangements and all that. Not quite sure whether the injuries suffered by any supporter are or were serious enough to warrant reporting to the HSE, under the actual Regs. themselves but if they were Celtic still have five days to do so. Do not recall seeing the HSE mentioned in any statement released by Celtic, but of course I could have missed it. Will look out for their subsequent involvement in any investigation. If involved hope they take it more seriously than took the George Square Bin Lorry incident back in 2014.

    But they do now.

     

     

    Last time I was at CP a seagull pooped on my head.

     

     

    I was furious. I unscrewed my head, put it in a box and sent it to John Paul Taylor the SLO

     

     

    When he opened it I told him I wanted to make a complaint to the Board about the not making the air above CP a no fly zone on match days.

     

     

    He closed the lid and is using the box as a yappy foot rest.

     

     

    Its my own fault I now realise.
