Fit & Proper test opens Pandora’s Box

I hear the SFA had asked for clarification on Craig Whyte’s alleged disqualification as a director, without getting confirmation one way or another, since the issue was initially brought to their attention by the landmark BBC documentary, Rangers: The Inside Story.  Rangers disclosure to the Plus Exchange (where the club’s shares are traded) on Wednesday that this specific BBC allegation was correct, was the information the SFA needed before they were in a position to act and apply a Fit and Proper Person (FPP) test to Whyte.

Dramatic though it sounds, failing a FPP test, in itself, is only likely to cause superficial damage to a club or its owner.  An owner would need to resign as a director but he could allow the other directors to continue running the business, or he could appoint a proxy to take control of the business, which is often the way controllers run football clubs anyway.

What is of more interest, however, are matters likely to be disclosed as part of the SFA investigation.  The Association would require Mr Whyte to explain what he did to be barred from holding a directorship for seven years, something the BBC lawyers would be able to question Whyte on in the witness box, should he actually sue, instead of repeatedly threatening to do so.

Of most interest to the SFA will be Rangers financial submission for their Uefa licence, which enabled the club to be nominated as Scotland’s participants in this season’s Champions League.  A condition of participation in Uefa competitions is that no debts to tax authorities due on 31 December the preceding year remains unpaid on 31 March.

In September HM Revenue and Customs gained permission from the court to freeze £2.3m of Rangers money in connection with an unpaid tax bill.  The principle element of this bill has not been disputed by Rangers.  The SFA will now be keen to establish if any part of this bill was in connection to taxes due in prior to 31 December 2010.  If it was, Celtic were entitled to be Scotland’s Champions League representatives, when overcoming the likes of Malmo stood between them and a £15m pay-day.

This is a legal minefield for the SFA chief exec, Stewart Regan, who has my sympathy. Things are about to become interesting.

While we are on the subject of that £2.3m tax bill, HM Revenue and Customs are due to get their hands on the cash after Friday next week, the last day Rangers are able to dispute the debt. If Rangers enter administration prior to that date, the cash would revert to the administrator and the club’s secured creditors would be entitled to it.

  3. Re the confusion on the disqualification rule it is simple. In 2007 CW was disqualified from being a director a company. It wasn’t the start of hours disqualification but he was all disqualified. That is within the past 5 years. No biguity in any way shape our form. HOWEVER nothing will happen even though they have broken the rules.

    googybhoy- No doubt his words were twisted- but we were 100% sure they would do that anyway, so why put him in that position in the first place?

     

     

     

    I agree with you but it is an important lesson for him. I hope it is part of a learning curve that our club has instigated for the youngsters. Doubt it though.

    My thought is that they will try to re admit them as a newco ,if that fails then the less leagues the sooner the busted flush get back to the top .

     

    IMO we should be taking note of all goings on at this time as in the future when it all pans out there could be some very notable results regards the Scottish football rulebook

    Murray has fled the premises, bank overdraft gone, a Buffon running affairs, if the tax Case goes against them they are totally knackered. Who knows what will crawl out the woodwork then, there is no certainty when the fan gets clogged up and there is lots of dish involved.

     

     

    I suspect the future is much worse for them than anyone can imagine. The Revenue will keep after them new company or not and then will be severely financially punished for a long time… relax and enjoy the spectacle!

  18. off subject at celtic park to get tickets for Hearts game,fourth in queue from going in to going out 35 minutes,wife in car said were they making them,guy in front of me said he had come during lunch not a happy man.has anyone else had problems at ticket office regarding this.

  23. Actually the tackle on George McCluskey minutes or seconds into the beasts first league game as player manager for Rangers was THE statement of what was to come. The Beast fitted perfectly into the HUN pandoras box. His players that day were wound out to kick and foul and make a statement of what was to come and it was not football to entertain the masses it was pure unadulterated filth managed by an egotist. It was only the arrival of gascoigne and Laudrup that punctuated this but those signings still smacked of facist football.

     

    Tiny Tims posts always get me thinking of Judas. Celtic Football club should think of the day that Rangers first approached Judas as the day that Rangers made their intent known that their plan was to end Celtic. Personally I think we are too nice a club to ever match the evil of the Judas days but I would smack the current raggy nail of hun stench right on its vertical zenith.

    In the current storm over whether the SFA should have granted Rangers a UEFA license for this season (and possibly denied Celtic a chance at qualifying for the Champions’ League), sources within Ibrox have confirmed that Rangers are planning to file a late appeal of the “wee tax case” bill related to a Discounted Options Plan.

     

     

    This bill, and the related interest, amount to £2.8m- had been agreed by the club. Rangers had even paid £500k previously to prevent court action. (The bill for penalties related to this scam had not been agreed and can be seen as a separate matter for now).

     

     

    Normally a company has 30 days to appeal a tax assessment. We know that that any appeal now is very late. The question is: why appeal now?

     

     

    It would certainly serve to provide a tissue for their friends in the media to hide behind. Stories can be planted with the usual suspects that “the bill is being appealed so it does not count”.

     

     

    However, the point at issue here is the status of this bill on 31 March. I do not know the answer, but it should be a simple question with a simple answer: was this bill overdue on that date?

    If it helps any for the future; we bought a couple of tickets online for the St.Mirren game last week in the North Stand. It now allows you to print them off at home and it saves all the bother of going to the ticket office.

     

    For this, be warned, they tack on an extra £1.75 to the price of the ticket!
