Fit & Proper test opens Pandora’s Box

1470

I hear the SFA had asked for clarification on Craig Whyte’s alleged disqualification as a director, without getting confirmation one way or another, since the issue was initially brought to their attention by the landmark BBC documentary, Rangers: The Inside Story.  Rangers disclosure to the Plus Exchange (where the club’s shares are traded) on Wednesday that this specific BBC allegation was correct, was the information the SFA needed before they were in a position to act and apply a Fit and Proper Person (FPP) test to Whyte.

Dramatic though it sounds, failing a FPP test, in itself, is only likely to cause superficial damage to a club or its owner.  An owner would need to resign as a director but he could allow the other directors to continue running the business, or he could appoint a proxy to take control of the business, which is often the way controllers run football clubs anyway.

What is of more interest, however, are matters likely to be disclosed as part of the SFA investigation.  The Association would require Mr Whyte to explain what he did to be barred from holding a directorship for seven years, something the BBC lawyers would be able to question Whyte on in the witness box, should he actually sue, instead of repeatedly threatening to do so.

Of most interest to the SFA will be Rangers financial submission for their Uefa licence, which enabled the club to be nominated as Scotland’s participants in this season’s Champions League.  A condition of participation in Uefa competitions is that no debts to tax authorities due on 31 December the preceding year remains unpaid on 31 March.

In September HM Revenue and Customs gained permission from the court to freeze £2.3m of Rangers money in connection with an unpaid tax bill.  The principle element of this bill has not been disputed by Rangers.  The SFA will now be keen to establish if any part of this bill was in connection to taxes due in prior to 31 December 2010.  If it was, Celtic were entitled to be Scotland’s Champions League representatives, when overcoming the likes of Malmo stood between them and a £15m pay-day.

This is a legal minefield for the SFA chief exec, Stewart Regan, who has my sympathy. Things are about to become interesting.

While we are on the subject of that £2.3m tax bill, HM Revenue and Customs are due to get their hands on the cash after Friday next week, the last day Rangers are able to dispute the debt. If Rangers enter administration prior to that date, the cash would revert to the administrator and the club’s secured creditors would be entitled to it.

  1. I’m proud that Gordon Strachan was our manager.

He won 3 championships and gave me one of the best

nights of my life up in in Dundee.

    A Celtic legend.

    All about opinions…

My opinion of WGS is that he did win 3 but at same time introduced rubbish football – some of the worst I’ve ever seen at Celtic. He was too derogatory towards the Celtic fans and too compliant with the Board – I view him as MON’s alter ego..MON was great with the fans and demanding of the Board..and brought the best football in years ..but I gues you get what you pay for..

The Gordon Strachan dissenters should ask themselves one question, Have we not enough enemies in the media? Why make an enemy out of an obvious ally?

    Well two questions then ;)

Like I said last night, there are too many so called Celtic fans on here too willing to criticise all that is Celtic.

WGS didn’t have a hip replacement that summer although that was he pretext fo leaving Soton.

He eventually had a hip resurfacing in Manchester during his time at Celtic, although. Of quite easily have had it in Glasgow.

“If they don’t file accounts on time, and then go bust, whyte will end up doing time, as he’s already been banned once from being a director. Companies Act, got to love it!”

Time will tell with MON and Sunderland…the biggest lever he will have will be Noocastle’s current success – it will force Sunderland to up their game..

What I like about MON is that he appeared to be negotiating with the Board from the go-get…

Ha! Legia coach now was Wisla Cracow coach 18 months ago. He was the Champion with them. Never said bad word about us when worked for them.

Yeah , I can find at least one player who moved from Lech to Legia, but who asked to terminate the contract without asking for money. When he signed for Legia , we found video where he sang with teammates ” Legia is old wh..e” he had very, very tough six months in our clubs. Generally, moves from and to these clubs are possible if the above not happened, or the player not said : I will never ever move to X or Y. I can tell you more. Our captain in the past Alexandar Vukovic (Serb/Polish) plays for Korona Kielce. He is the captain there. If he does not play for them he always comes to watch Legia live. They know that and accept that. Vukovic works for the hard , but his heart is here.

We had the striker from Lodz. They are for us like Hears are for you. We heard from him that Lodz was his first club and we accepted that becouse he was great man and player for us. He is now back to them for retire. He played for the Danish club couple of years ago when Celtic played against that club in CL.

  10. Motherwell’s Scottish Premier League clash with Hibs was abandoned because of floodlight failure.

Hibs had led 1-0 at half-time – courtesy of Garry O’Connor’s 16th minute strike – in manager Pat Fenlon’s first game in charge.

The striker reacted quickest to thump home the rebound after Leigh Griffiths’s shot cannoned back off the post.

But the game was abandoned amid safety concerns.

The second half had been delayed by 10 minutes following a small fire within one of the pylons in the South Stand at Fir Park.

Despite dealing with the fire, Motherwell said the game was abandoned on safety grounds.

Of course time will tell but MON seems to be busy damping down that perception that he is a cheque book, anti-board, manager, through his spokesman, Pat Murphy.

There will be many Sunderland fans espousing the same theories re football finance that we hear on here:-

He’s not a player unless he has a big transfer fee

You can only judge a club’s ambition by its net debt

The chairman needs to spend his millions buying bling for the fans

If they’re asking £3m for him, bid £4m and get him in early

If your £4m buy turns useless punt him for £500k and try again

MON seems to be going out of his way to say that people are misrepresenting his philosophy. You appear to be one of them.

My prediction is that MON will improve Sunderland without big net spend but it will take over 2 years to see a big change. Like Villa, they will not break into the top 4. Their financial position will still be untenable, like the majority of EPL clubs whose spending you would have us emulate. And MON will try to get the England job

  19. The Ghood will prevail on

The accusation that Gordon Strachan was disliked by some Celtic fans because he was a Scots Prod is a vicious myth. It was devised by dirty-minded huns and believed by some gullible, ill-informed, and in my opinion borderline self-loathing celtic supporters. I’ve never heard one Celtic fan – not one – express such antipathy. But why let the facts get in the way of a bit of celtic bashing? This would be the same celtic fans who have taken managers and players to our hearts regardless of their creed or colour for generations. It’s a big, fat LIE.

If there was animosity to Gord it was because he played in a great – but aggressive – Aberdeen side who we had a keen rivalry with in the ’80s, and the fact that sometimes his manner could come across as a bit chippy in interviews, etc. Also, sometimes the footy wasn’t great, particularly in his last season. Note I’m not having a pop at wee Gord here, a man who I’ve met and like. I’m just giving the facts as I see them.

Incidentally, the best test of this is wee Gord himself. He is now Celtic TO THE CORE and always will be. He’s said as much. Do you honestly think he would still hold that mindset if he had been the victim of bigotry? No, in my opinion he will be back at Parkhead one day, back at his beloved club, in some capacity.

  20. Zbyszek,

I remember that debate well. I tihnk we had just suffered the third of our 3 defeats this season or drawn against Hibs. The reponse to me and some others saying sack Neil was as you say Neil and only Neil for ever and ever. What may be blind faith with no foundation may be proved to be correct. In my opinion Celtic were in the grubber and needed a change. I am happy that I have been proved wrong but I would caveat that with my argument that evening.

Most sides winning a championship do so with 5 defeats. So far we have had 3. I also targeted 90 points and said that we could only afford to drop 11 points in order to achieve that total. I still believe that we need to achieve 90 points to win the league. There have not been many seasons where this has not been the case although one of Gordon Strachans seasons delivered a few less than this and we won.

There are many reasons for disliking Gordon. Perhaps as many as there for liking. He has said he is a Celtic supporter but he didn’t play to entertain. He loved Tommy Burns but said the refs were not against Celtic even when they were lying last year. 3 in a row, that celebration versus Hearts, arguing with an aberdeen fan, last 16 in the champions league twice… I don’t think anyone will ever agree on Gordon.

I think some folk find it hard to remain objective on Neil Lennon. I’m glad he wasnt sacked but he was 45 mins away from leaving and he reportedly did want Gordon Strachan brought in to help him. Some supporters are supporters of a manager some are supporters of players.

We may be having a mutual misunderstanding, but, you posted:-

“AAh the Shamrock tinted hatred of WGS emerges yet again. Proddie dog factor I think.”

Now it’s cryptic right enough but my reading was, based on your previous jibes against our Irish influence, that Irish based or minded posters would dislike WGS for his Scottishness (the very charge macjay levelled in less cryptic tongue). It also suggests they may take more account of his religion too.

I pointed out that 2 posters with Scottish credentials, Jungle Kev and Tiny Tim, were more vehement about WGS than cathac and myself were (and we have the more recent Irish link I believe)

Did your cryptic utterance mean something else?
