Fit & Proper test opens Pandora’s Box

I hear the SFA had asked for clarification on Craig Whyte’s alleged disqualification as a director, without getting confirmation one way or another, since the issue was initially brought to their attention by the landmark BBC documentary, Rangers: The Inside Story.  Rangers disclosure to the Plus Exchange (where the club’s shares are traded) on Wednesday that this specific BBC allegation was correct, was the information the SFA needed before they were in a position to act and apply a Fit and Proper Person (FPP) test to Whyte.

Dramatic though it sounds, failing a FPP test, in itself, is only likely to cause superficial damage to a club or its owner.  An owner would need to resign as a director but he could allow the other directors to continue running the business, or he could appoint a proxy to take control of the business, which is often the way controllers run football clubs anyway.

What is of more interest, however, are matters likely to be disclosed as part of the SFA investigation.  The Association would require Mr Whyte to explain what he did to be barred from holding a directorship for seven years, something the BBC lawyers would be able to question Whyte on in the witness box, should he actually sue, instead of repeatedly threatening to do so.

Of most interest to the SFA will be Rangers financial submission for their Uefa licence, which enabled the club to be nominated as Scotland’s participants in this season’s Champions League.  A condition of participation in Uefa competitions is that no debts to tax authorities due on 31 December the preceding year remains unpaid on 31 March.

In September HM Revenue and Customs gained permission from the court to freeze £2.3m of Rangers money in connection with an unpaid tax bill.  The principle element of this bill has not been disputed by Rangers.  The SFA will now be keen to establish if any part of this bill was in connection to taxes due in prior to 31 December 2010.  If it was, Celtic were entitled to be Scotland’s Champions League representatives, when overcoming the likes of Malmo stood between them and a £15m pay-day.

This is a legal minefield for the SFA chief exec, Stewart Regan, who has my sympathy. Things are about to become interesting.

While we are on the subject of that £2.3m tax bill, HM Revenue and Customs are due to get their hands on the cash after Friday next week, the last day Rangers are able to dispute the debt. If Rangers enter administration prior to that date, the cash would revert to the administrator and the club’s secured creditors would be entitled to it.

What end of the ground did it happen at? Which linesman made a dick of himself over the incident? Every Celtic Supporter remembers the event well… do you?

    No sure how you deduced that from what I said. I haven’t projected my views onto anyone in the 50,000 crowd have I? How could I possibly know how they felt about Gordon Strachan a couple of decades later?

     

     

    In any case, are you suggesting that booing = detesting?

     

     

    I hope that’s wrong otherwise a large number of Celtic Supporters not only detest Gordon Strachan but also Fergus McCann, Brian Quinn and all of the current Celtic players who have been booed several times this season alone.

    just back from the jim to find the usual tirades against me. i got a rub down so i am not as raging as i normally am about it. i have told youse that it doesn’t bother me the abuse i get. it is like water of a cows back. i just hope the next time you guys find yourself trying to get on with a new set of people you dont have so much trouble. i thought we were all inclusive? a broad chapel and all that? no? i think once you guys have walked a mile in my trousers you would maybe not be the way youse are to me.

     

     

    just like big kevjungle i am a good celtic man who is worried about our club. all you lot do is talk about the huns. that has to effect the team on the park. the team that is 4 points behind the champions of 3 in a row the rangers. i am sick of seeing them top of our league. i want to see us top of the league. thats all.

    Now before the world recession is trotted out. That particular recession did not come about between DD standing on the pitch at Tannadice and the Kaunus splurge. There was a concious decision then to draw back. Even after we miraculously won the SPL in cardihuns first season … we never complained about Mc Curry .. that was the reason it was so close … why didn´t we complain about Mc Curry and the systematic cheating

    Quite simply they are lazy uninterested and dispassionate . old Firm is a marketing model that has served them well and they want to maintain it to make money. They do not care about the social ills that befall any tim in Scotland. Long may it continue. There is 100 years of evidence for that ? So how come you can´t contemplate that ?

    The incident happened when Mark McGhee(Aberdeen) was, charging toward the Celtic 18yard box(at the huns end of Hampden) and, was brought down by big Roy. MM rolled around on the turf as though he had been hit by a hammer.

     

    The Aberdeen players, led by WGS hounded the Mib Bob Valentine to show RA a red card and, he duly obliged.

     

    It has to be said that, the antics of WGS and Peter Weir in particular were, unforgivable! IMO!

     

    WGS for being his usual, insidious self and, PW for telling MM to stay down until RA was sent off!

     

    My man of that match was, Murdo Macleod who had to play CH for the remaining, 55mins + xtra time for ten man Celts but, what pleased me about Murdo was the way that he rattled WGS at every opportunity!

     

    I was down the front of the Celtic end near the middle.

    It’s just that some teams don’t think it’s that big a deal “we are all captains etc etc”.

     

    But I think being captain and especially of Celtic should not only be an honour but the pinnacle of your career.

     

    It combines both footballing talent and mental strength. Some people can’t handle the extra responsibilities (see Gallas at Arsenal).

     

    Others grow into the roll.

     

     

    I just don’t like the idea that sometimes captaning Celtic is akin to winning a raffle.

     

     

    Scott Brown certainly has the big personality which is why our young team look up to him but he has yet to reach his full potential in terms of playing ability coupled with a poor injury record and the outside chance of seeing red.

     

     

    As for being being prefect, I wouldn’t know!

    ‘If I were a betting man’ I’d like to know if there are odds around for The Foe Malign filing for insolvency before then (next Friday). Not because of the case referred to, but because HMRC will be sending round the baillifs next week to collect the ‘wee tax bill’ … and the Multi-thousandaire will want to avoid that.

    I don’t think I would have thought of raising the economic downturn as a counter-argument.

     

     

    Celtic were definitely trying to be cautious. I have no way of knowing for sure, but would put myself in the group that thinks the board tried to do ‘just enough’ to win without pushing the boat out.

     

     

    Gordon Strachan’s last season seemed to peter out at Easter Road and we lost a crucial advantage going into the final game. The Tony Mowbray appointment didn’t work. Rangers received help from referees and the administrators and also had some good players and an effective manager.

     

     

    How far out we would have needed to push the boat to combat all of these factors I don’t know.
