“Giant punishments” on Rangers were illusory, you were punished instead

Malcolm Murray, the newly appointed chairman of the Newco club Charles Green hopes to establish, yesterday entertained us with his comments on punishments served on a football team suspected of cheating you for over a decade.  He said:

“We’ve had giant punishments already – a European ban, a 10-point deduction, the emotional trauma everyone has suffered. I think, for the good of Scottish football, it’s much better Rangers in the SPL.”

There has been no European ban.  Newco will not be eligible for European competition because it is a Newco and Uefa requires three years accounts from participating clubs.  They are simply not eligible, they have not and will not achieve the qualification criteria for European football for three years.

The 10-point penalty imposed on Rangers last season for seeking protection from creditors by going into administration is hardly a “giant” punishment.  It changed nothing.  Rangers were second in the league when it was imposed and remained so.  They released no players and went on to defeat Motherwell twice, ensuring they finished the league in second place, earning £900k in additional prize money.

As a punishment, it is the equivalent of banning Ally McCoist from this year’s 100m Olympic competition.  Pointless.

Which leaves us with “the emotional trauma everyone has suffered”.  Compared to the emotional trauma suffered by Dundee, Motherwell, Gretna, Third Lanark fans, recent events have been nothing more than a focus for some robust rallying calls.

Don’t even start me on the emotional cost of losing the league in 2003, 2005, 2009, 2010 and 2011, all to a team of cheats.  How do you measure that?  Think back to each day we lost those titles and tell me how you felt about them then and how you feel now, knowing you were cheated.

    With regards paying the players, if he doesn’t, then how can he claim they are SevCo’s players? It is going to get very messy over this. Which player will be the first one to break cover? Naismith is my bet

  4. There are two issues when it comes to players: footballing registration and contract of employment.

     

     

    The latter is no different in the case of a footballer or a groundsman. If it is ruled that TUPE applies then they have a choice: transfer to Sevco 5088 Ltd on the same terms and conditions as they currently have or walk away with no liabilities on either side.

     

     

    The issue becomes one of whether an undertaking has been transferred. If Sevco had simply bought some property then it could be argued it doesn’t. But as Sevco is claiming to have bought “the business” and plans to run a football team it is likely that it does.

     

     

    So all Rangers employees will be transferred to Sevco unless they choose to walk away – and it is their legal right to make that choice.

    Re the court action, somewhere I have read that Green could threaten court action to prevent players going on frees – court action would take time and create delays. He wants to sell them even though they’re not really his to sell.

    Mate, I’m only passing on the news that Ramie told me and as far as Kano’s trip goes, in mileage (for us) it is like a trip from Glasgow to the Isle of Man. For Kano it is a trip to the mysterious island (And Rottnest, a Dutch colony has it’s mysteries) which means for Kano braving the waves generated from the winds of the roaring forties, and when your life is dependent on a wee box of electronic tricks under you seat which regulates all sorts of your bodies vitals, like Kano has, he is indeed braving the waves like anybody has ever done before him.

     

     

    It is winter down there and from Antarctica blows a cold, cold wind, but for Kano it will be just a cold paradise in a hemisphere apart from our very own paradise.

    It is the players registrations that interest me most. Without it the player can’t sign/play for anyone

     

     

    Would the SFA intervene to demand that the players registration be released forthwith or do the registrations default to the SFA once Rangers 1872 is liquidated, thereby the decision rests with Hampden?

    There should be no confusion. My take.

     

     

    1. Sevco do not have any player registrations. These are held by oldco until actual liquidation at which point the SFA takes the registration for safe keeping.

     

    2. At actual liquidation the player contract is terminated. The player becomes a free agent.

     

    3. Sevco can ’employ’ whoever they want. This does not mean that such employees or employer will hold a registration to play football.

     

    4. Sevco are not a member of the SFA therefore they are not a body that can legitimately hold a player registration.

     

    5. If TUPE applies, that is effected via employment law and SEVCO would be entitled to honour that contract whether a football SFA registration is involved or not (in this case not, so far).

     

    6. A player needs to sign a new employment contract with sevco whether TUPied or not.

     

    7. A company not approved as a football club and not entitled to register players will not have any locus in the transfer of a playing registration between legitimately approved bodies (oldco and the SFA).

     

    8. At present the liability for paying players employed by oldco remains with D+D as the administrators until the point where actual liquidation occurs and the employment position changes.

     

    9. (My favourite) If sevco open a contract and pay players of oldco prior to actual liquidation that would be a situation of dual contracts for the purposes of playing football, unregistered with the SFA and SPL.

     

     

    I don’t think Green has any intention of paying players this month.

    It is not impossible that Sevco could end up employing players but not holding their registrations. They would still have to pay them though!

     

     

    Given that the TUPE transfer is coming before liquidation, I would think that the SFA would look favourably on a transfer of registrations to follow the employment law position. If they acted unreasonably in denying registration there could, in theory, be liability.

     

     

    This assumes that Sevco is a football club of course. If not then clearly it cannot register football players!

    The real contracts to watch are not the players (bound by registration) nor is it the tea ladies who will get the same minimum wage whoever is in charge.

     

     

    Watch the Manager and coaching contracts. These are set at SPL/Rankers values. If sevco are not to get straight into the SPL, Green doesn’t want to pay north of £1m for a coaching team in a lower division from 1-3 years.

     

     

    However, under TUPE he is OBLIGED to honour what is currently in place.

     

     

    He is therefore caught, because whilst players can walk away (and he wants them to as they are too expensive) and get another club, who else is going so pay TFPLG and his team £1m come July?????

     

     

    Green’s Catch22. Even if he sack’s him I suspect he’ll find himself in court.

     

     

    All this whilst knowing that TFPLG has no interest in working for him and will be actively assisting the Cardiganknights undermine sevco.
