It’s the boards responsibility to protect the company and the shareholders interests, Celtic Plc could ditch the football club tomorrow and move into another sport or industry if the shareholders want that, so stop havering like a babbling wretch. It’s the managers mod to produce a successful football team and we can tell that because it’s the manager that gets pumped if the team is not successful.
With the success of the current manager the board barely need to be competent to ensure the business does not fail which is after all their sole remit.
I’d take the Aberdeen centre half btw

Are you suggesting the HMRC letter supports the case for evidence of collusion being circumstantial?
If so you’ll need to explain that for me as I see it as the opposite since HMRC had made it clear two years in advance they were investigating rangers, any why they were investigating rangers, from then on the SFA had no excuse to remain ignorant of the facts.

Res12 should not have been required as it was their responsibility to ensure the shareholders and business interests were protected, they failed to do that which required shareholders to object to the business being subjected to unfair trading practices by the presiding authority.
We recently found out that Rangers for years had been cheating in registering players and remind us what those charged with protecting the business response was?
I’ll give you a clue, astounded of forehead.
Their reaction was to do nothing, take it on the chin, sporting and financial loss over a decade and surprised was the best they could muster, and still we gat clowns telling us how good they are ffs.

The responsibility for Res12 taking the turn it has does not lie with the support.
Football is a sport governed by rules, if the rules are ignored for commercial reasons, the football you are watching is not a sport. Entertainment yes, and its good right now (although not so just 6 weeks ago).
As long as folk know that they can decide how to support or not.
It would do well to remember season 2010/11 when the need to ensure Rangers survival produced the honest mistakes that began a quest for SFA Reform, producing anger on CQN when you just knew cheating was taking place but couldn’t prove it.
Now we can and the anger (apart from the good money supporters spent on what was not sport) is that there is no assurance that it will not happen again other than that given by the SFA as reported at the AGM that something is going to CAS.
Celtic did ask for an investigation on the Big Tax Case and LNS findings

and were thrown the bone of the UEFA Licence 2011 and only because of testimony in the Craig Whyte trial.
Now the probity of that investigation has been thrown into doubt and the process derailed by an out of the blue decision to refer something to CAS sometime.
Not good enough given what took place from mid May after 8 months Compliance Officer investigation produced this.

This needs explaining given it was around events at end of March 2011 that were referred to at the CW trail that threw up the bone.
Its been almost 5 months since an explanation was requested from SFA by Res12 lawyers just before the JPDT sat on 26th June with yet no answer and 4 months since a decision was made in July 3 weeks after its receipt to refer the matter to CAS and we are supposed trust the SFA?
What part have supporters played in any of this bar asking questions?

Our football team. The thing is we cannot just be spectators. We cannot just see the demise of Rangers FC, and all the corruption that lies behind through the lens of, this will cost us money. But the Board has consistently done so, and some might say, well me anyway, that this could be construed as us being willing participants to all that has followed the fall. As for Celtic FC, no chance of me not supporting them, not now, not ever, that said it could be argued that it is some of the decisions and positions taken by the Celtic Board that could be in fact be seen as detrimental to Celtic FC. Or as Jake Arnott might have put it, not me Guv.

I`m not privy to the inner workings of the Board room and neither are you .
Therefore , I won`t blindly condemn their actions or inactions.

Instead of targeting the perpetrators of nefarious behaviour , some choose to blame the representatives of the victims of such behaviour. ( aka deflection )

No Im saying that Id forgotten about that hard evidence from 2009 because I was concentrating on the circumstances surrounding the granting in 2011, hence the use of circumstantial in relation to that year.
In “Suits” (what an apt name for a lawyer drama) they would probably lead with the circumstantial and produce at the last minute when the case looked lost the hard evidence to back up the circumstantial but in real life it would be the other way round over the period 2009 to 2011/12.

I don’t disagree … the Huns old & new have flouted every rule going… your “sole remit” for the board caught my attention … what annoys me without knowing as much as the ones dealing with this is the fact not another cheated team questioned the Sfa and it now looks like Celtic fans (supporters) v Celtic board … whereas I thought Res 12 was to do with the Sfa treating one club different from all others

Res12, is Celtic shareholders being forced to intervene because the board do not consider being cheated as a big deal.
As I often have to remind people, other clubs have nothing to do with this, they do not have shares in Celtic Plc and they don’t care about protecting our interests. I’m at a loss as to why anyone think other clubs are relevant to Res12. Their support might be helpful in addressing the SFA but at the end of the day they were not asked for their help, the board were asked to do their job and we are still waiting.

Pretty close. In fact the “bill” was first presented in 2007 but was appealed. RFC and HMRC agreed to wait the outcome of a case HMNRC had against Aberdeen Asset Management who used DOS ebts to pay staff that went to an FTT.
The FTT found for HMRC in October 2010 and went to RFC to cough up. Theu sought advice but were told lying to HMRC in 2005 about the existence of side letters that did exist made success of a further appeal unlikely so pay up.
HMRC were basing tax owed on the amounts paid into the DOS but realised that the side letters formed part of a remuneration package for work done (wages to you and I) and base the tax owed on the PAYE terms that would have applied had the wages been paid properly in that form.
That was from Oct 2010 to 21st March 2011 when the amount was finally agreed and the bank were approached to pay. Had they agreed HMRC would have allowed 30 or 90 days (but had to put that in writing to comply with Article 50 Annex VIII of FFP.)
Had that contract to postpone existed it would have been the justification for granting so we can only assume it didnt as it would have ended Res12 when Celticasked questions in late 2011.
So what to do and you have pretty much covered it.
The money was due from 21 March
It wasnt paid by 31st.
There was no written agreement to postpone
The appeal had ended on 21st March
andi certainly wasn’t frivoulos.
So in UEFA overdue payable terms subsequently upheld by CAS in the cases of Malag and Giannina FC an overdue payable existed at 31st March.
Everything that happened thereafter starting with non disclosure of 2 HMRC letters in May that would have questioned the potential status of the liability at 31st March in time to stop the grant before UEFA informed at end of May of clubs to whom licenses were granted then into the monitoring was to hide this, so that RFC got a crack at CL money that would keep them in business..

Apologies … I thought it was mainly about the Sfa approving the license when it shouldn’t have been… therefore our board should have contested this … again if the board have failed the shareholders then every shareholder should be behind Res12, am afraid I don’t think many / enough are…
The other clubs, I only mentioned this mainly due to the cheats being allowed to cheat whether it’s a Euro licence or improperly registered players two different scenarios but with the SFA overseeing both

Res12 only asked for an investigation into the SFA processing of the 2011 UEFA licence by UEFA Club Financial Control Body (CFCB) in the anticipation that once completed some of the information held in summer of 2011 would support a case for SFA reform.
In effect what took place is more or less known unless something were to emerge from an investigation that changes the narrative and we have always been open to finding out that was the case.
The longer it takes to come to a conclusion the more likely it is that what we think is known is in fact what took place.
The consequences of finding out is not one for the Requistioners to deal with, that was for the governing football authorities who have now asked CAS to be involved on Terms of Reference and period covered no one knows.
