Illegal EBTs and Sporting Advantage question remains

Sir David Murray, Campbell Ogilvie, Dave King, as directors of a football club, you presided over tax evasion. While ordinary men and women have no choice, or criminal urge, to avoid paying for public services, you directed a deception on an industrial scale.

Sir David Murray and Campbell Ogilvie have their influence and signatures all over this act. The SFA was quick to discipline and sine die Craig Whyte after he was out of the game, it must now charge Murray and Ogilvie with bringing the game into disrepute. The stale influence of cronyism at Hampden must be routed and seen to be so.

The SPFL instructed an inquiry three years ago but with this verdict in, the SFA must appoint their own inquiry.

Why did the processes at Hampden allow this to happen and continue without check?

Why did Rangers get their European licence in 2011 despite being in arrears to HMRC, in contravention of that licence?  Who was responsible for this decision?

Why was a director and signatory of Rangers illegal tax schemes elected and reappointed president of the SFA?

How transparent were the SFA and the SPL in their handling of these tax evasion charges?

Was the SPL inquiry commissioned to uncover the facts, or to meet a desired objective?  Who prepared the inquiry remit and who signed off on that remit?

Lord Nimmo Smith found that legally executed Employee Benefit Trusts did not confer a significant sporting advantage.  In light of what I have already read of the verdict, we must now discover if such widespread illegal Employee Benefit Trusts conferred a sporting advantage.  This question has not been asked yet.

It’s time for football to shake off the shackles of corruption in Scotland, as elsewhere.

    On a day when our direct competitors have been found guilty of using a tax evasion scheme, I would have thought that the board would be congratulated for making the hard decision and refusing requests for players to be paid using ebts. Imagine the mess we would be in today if we hadn’t.

  9. Regarding the possibility of titles being stripped from RFC (in liquidation), Paul McConville seemed to think at the time that the decision was binding and final. It was clearly a stitchup, with possibly the SPL’s lawyer being in on it, or at least being misguided –

     

     

    What if the Upper Tribunal Overturns the FTT Verdict?

     

     

    A sensible question arising from the Commission decision is as follows.

     

     

    The Commission based part of its reasoning upon the findings in fact and law of the FTT. What would happen if the Upper Tribunal reversed the FTT verdict?

     

     

    The answer is simple.

     

     

    Nothing.

     

     

    I say that because of a concession made by Mr McKenzie for the SPL at the hearing before the Commission.

     

     

    Paragraph 104 of the determination includes the following statement:-

     

     

    The Tax Tribunal has held (subject to appeal) that Oldco was acting within the law in setting up and operating the EBT scheme. The SPL presented no argument to challenge the decision of the majority of the Tax Tribunal and Mr McKenzie stated expressly that for all purposes of this Commission’s Inquiry and Determination the SPL accepted that decision as it stood, without regard to any possible appeal by HMRC. Accordingly we proceed on the basis that the EBT arrangements were lawful.

     

     

    So, if the Upper Tribunal decides that the FTT majority got it wrong, it will not affect this case. Mr McKenzie has made clear that the Commission decision is based on the case as it stood following the FTT.

     

     

    A damning verdict at any appeal, if there ever was such an outcome, would not affect this case. The SPL has decided, even though an appeal is pending, to stick with what is present at this point.

     

     

    Conclusion

     

     

    What have we learned?

     

     

    The verdict is binding on the SPL.

     

     

    They appear to have very little or no chance of appealing and even less willingness to do so.

     

     

    A favourable verdict in the Upper will be as naught. They have conceded that point.

     

     

    All this leads me to believe that there will be no more proceedings in this matter.

    It’s not just the tax dodging that facilitated the Huns cheating. Their incestuous relationship with Masterton and his cronies at the Bank of Scotland, who provided banking facilities to virtually all Scottish Premier clubs, gave the Huns an unfair advantage in the domestic transfer market.

     

     

    For example the following conversation may have taken place in 1995-

     

     

    Moonbeams – “Gavin old bean, I hear those uppity tims are trying to sign Gordan Petric, can’t be having that now, tap us a couple of million and whack it onto the Murray group credit card will you?”

     

     

    Masterton- “why of course your eminence. It’ll be in your account in 20 minutes. By the way, I really shouldn’t say this old chap, but Dundee Utd are quite deep into their overdraft, they won’t be hard to deal with.”

     

     

    Moonbeams- “I need to gazump these tims on this one so I can give another preening interview to Traynor and the rest of the toenails brigade. Could you fix up a cheeky letter to Utd suggesting a forthcoming review of their overdraft facilities. Soften them up for when I slap in a cheeky wee bid for Petric?”

     

     

    Masterton- “why of course David, I’ll have one of the chaps issue a letter tout suite. That’ll make McLean bite your hand off for the money! Incidentally, Aberdeen are a bit strapped now too so they could be suggestible if you fancy any of their young Turks……”

  18. I might have said this before, for I have been known to repeat myself. About LNS, as somebody else said, he must be raging having been made a monkey out of. That surely comes under the offence of murmuring a judge.

     

     

    I think it was the editor of the Birmingham Post in the early 1900s who called a local judge a wee twerp in horsehair, or something like it. The wee judge was livid, and had the newsman hauled up. The poor old editor had to grovel on his knees before the bench to avoid a lengthy jail term.

     

     

    Those who misled LNS surely took the juice right out of the old gentleman, making him a laughing stock in his seniority. What would be a fitting sentence for that?

    This is a massive Scottish story, football is part of the Scottish psyche. The only thing that can bring this entire scandal to a head is a full public enquiry that provides whoever would be nominated to head up such an enquiry, with the powers to summon all the major players (pardon the pun) to appear under oath and not be allowed to hide behind any corporate vehicles or to invoke any manner of get out clause. This should have happened years ago, it would also allow any and all parties to come to the enquiry and articulate their losses in relation to the cheating without turning the whole affair into a Celtic v Oldco charade.

     

     

    Anything short of this type of set-up will result in not only nothing happening but the very real chance that a similar thing could happen again in the future given that either the same or like-minded goons will still be in charge at the SFA asylum.

    I vividly remember the day, it was November, dreary, chilly, damp. Occassional rain.

     

     

    We had sent the kids up the stairs, and the pair of us – my Wife and I – listened to what the Counter-Terrorism Officers had to tell us.

     

     

    There were 3 main risks, they said: Attack at home; Devices in the mail; and Harm when out.

     

     

    It was all a little surreal, what with Mail handling, the School run, checking under the car. The house would be sureveilled they said, the local Station appraised, Fast Response notified, but in the end, it was all about common sense, they said. Just use common sense.

     

     

    Surreal that is until the Wife caught my eye and the reality dawned on us. I was a target. We were targets. Our kids were targets.

     

     

    This same conversation played out in half a dozen other homes that week that I’m aware of, doubtless more besides, different folk, same message.

     

     

    I’d like to express my personal thanks to those who made it all possible, particularly David, Jack and the lads. Well played.
