The statement released by Duff and Phelps last night revealed the substance to the lobbying that had taken place since the original punishment handed out by the SFA judicial panel:
“The decision by the appellate tribunal to uphold the sanction, namely the suspension of registration of players for one year, is not competent in the view of the club and its legal advisers.
“Such a sanction was not available to the tribunal”.
The suspension of player registrations was not one of the suggested punishments on the menu for the judicial panel but the rules allowed them to vary from guidance and choose whatever punishment they believed appropriate.
The appeal correctly found that the judicial panel were not were not subject to an exhaustive list of possible punishments. Duff and Phelps main hope was that the SFA rules were unclear and poorly constructed, as they were before an overhaul last year.
You don’t need to look too hard for the irony.

the fine imposed on craig whyte at the same time ranjurs got their fine and ban, he said he wouldn’t pay it. From memory his fine had to be paid imminently, when that fine reaches the deadline and if not paid, who then pays it? and what action can be taken against whyte?

I’m sure the stipulation was that if he didn’t pay interest would be added. The fine was imposed on Whyte personally so only he is liable. I would assume that the SFA can sue if he doesn’t come up with the cash.

I would agree, never go back, …………unless you loved the club and they loved you and you had let yourself go a little and had left the club on a bit of a disappointing note, and were hell bent on rewriting that and making amends and retiring a proper hero.

Sorry, old thing, but where is the irony here? It could only be ironic if Rangers had, at some point in their shady past, tried to bury a tornado of the type you describe. I’m not ruling that out, but it seems unlikely to me, given what Bill Struth might have had to say about it and all.

If true it means we are losing a Brilliant young keeper. I really thought Fraser would stay for the CL. I really like Fraser because of his hard working attitude, Goalies don’t really have to work hard?

Artur was very lackadaisical for the last couple of seasons of his time at Celtic (I don’t know the personal issues he was having at the time) but there is the possibility he got bored with Scottish football.
I got bored with Gordon’s (always will be a legend) style of football, and if there was ever a manager to get a fully motivated Artur, it is Neil.
Fraser will be a big loss but Artur would be a big gain, especially if it is a free move.

I earnestly believe that the first SFA panel were being lenient and even accommodating to RFCia’s circumstances.
The findings of Lord Nimmo-Smith’s findings were damning and once the uncontentious fact that R@ngers were responsible (…the principles laid down in Tesco v Nattrass regarding corporate responsibility and the “controlling mind” test applied here. – PMcConville) the scope for punitive sanctions was considerable.
However as R@ngers are in administration, out of Europe, had no funds and owed “Football” money their chances of completing any significant transfers in the summer are pretty minute. So in actual fact they have a January window embargo, when in all likelihood they will still be encumbered. In practical terms under the circumstances a paltry punishment.
I’m still of a mind that a sincere mea culpa and plea from RFCia for a suspension or reduction in duration due to exceptional circumstances may have been fruitful, before their reaction fuelled by belligerent entitlement put paid to that.
