Judge King plan by those who father it

I’ve no affection for Real Madrid but was delighted for them, and Carlo Ancelotti in particular, last night.  It’s getting to the stage that it’s impossible to figure out who the best team in Europe actually is.

Bayern Munich’s season has been historic.  They swept aside German competitors with record-breaking ease on their way to what looked like them becoming the first team to retain Europe’s top crown in its Champions League format.  Real were irresistible.  Let’s hope for a Madrid final before the Lions in Lisbon next month.

After yesterday’s blog I heard that more journalistic allies from Anderston Quay have flocked to Dave King’s camp, including that Leggat (sp?) guy, who used to entertain many.

I’ve heard more theories as to what the Sevco board and the group trying to run their club into the ground are planning that I care to remember, but when you look at the team King in particular has pulled together, you would be forgiven for concluding there is no masterplan worthy of the name.

We can’t always judge a man by the company he keeps but we can just a strategy by those who fathered it.

Prediction: King will kill Sevco then fall on his arse.  Bump.

Here we Go for 10 In a Row!

Applications for the 10th annual CQN charity golf day, which will take place in Aberdour Golf Club on Friday 4th July, will close this Friday, 2nd May.

As ever it will be oversubscribed so if you would like to attend, email BlantyreKev and Taggsy at cqnopen10IAR@gmx.co.uk before Friday.  Cost for the full day’s entertainment including golf is £80.  There are a very limited number of non-golfer evening places at £45.  Further detail will be released nearer the date and when places confirmed.

Over the course of the season I’ve read lots of comment about the values we should aspire to as a club, specifically when it comes to alleviating poverty, both in our own community, and abroad.  CQN’ers responded incredibly to our Malawi school kichen(s) appeal, which dwarfed our work at home.

The Charity Foundation are selling badges (£1 each) before the Dundee United game on 11 May to raise funds to feed the poor and hungry in and around Glasgow.  I have volunteered as a coordinator on the day and have offered to help recruit around 100 to sell badges before the game.

This will be trophy presentation day – but the trophy isn’t coming out until after the game, so you’ll not miss any of the flesh-on-silver action.

    I can’t help but think that Bayern have suffered in Europe due to being so far ahead in their league. Some may think that allows them to focus on Europe more but I think the lack of intensity in league matches must affect how they perform when the big matches come around like last nights game. I suppose you could liken that to our performances in the cups this season…bewildering!

    What does strike off mean?

     

     

    Striking off, means the removal of a company´s name from the official Companies House register. The company name is then available to incorporate by a new company. A company may be struck off the register and dissolved if an application has been submitted to the Registrar or the Registrar concludes that it is not in operation.

     

     

    Who can apply to have a company struck off the register?

     

     

    The Company

     

     

    A limited company can request to be dissolved providing that it meets all of the following requirements:

     

    ◾Not traded within the last 3 months

     

    ◾Not changed the company name within the last 3 months

     

    ◾Is not subject to any legal proceedings, current or proposed

     

    ◾Has not made a disposal for value of property or rights

     

     

    If all of the criteria are met the company can complete a Striking Off application (form DSO1) to Companies House. A copy must also be sent to interested parties HM Revenue & Customs, employees, creditors, etc. within a week of submitting the application for example.

     

     

    When the application has been accepted a notice will be placed in the relevant Gazette giving at least 3 months notice of the intent to remove the company. If an objection (see below) by an interested party is upheld the action to close the company will be suspended.

     

     

    A company may be voluntarily closed, if it cannot pay its creditors or by order of the court on the petition of a creditor.

     

     

    The Registrar

     

     

    The Registrar may strike off a company for reasons such as if the business is neither in business nor in operation, for example, he has not received documents from a company that should have sent them to him or mail he has sent to a company´s registered office is returned undelivered.

     

     

    Before the Registrar strikes a company off the register, he must inquire whether it is still in business or operation. If he is satisfied that it is not, he will publish a notice in the London Gazette that he intends to strike the company off. A copy notice is placed on the company´s public record.

     

     

    If he sees no reason to do otherwise, the Registrar will strike the company off not less than three months after the date of the notice. The company will be dissolved on publication of a further notice stating this in the Gazette. At the date of dissolution any assets held by a dissolved company will belong to the Crown: see question 5. The company’s bank account will be frozen and any credit balance in the account will be passed to the Crown. If the company is to remain on the register, it is important to reply promptly to any formal inquiry letter from the Registrar and to deliver any outstanding documents. Failure to deliver the necessary documents may also result in the directors being prosecuted. The Registrar will take into account representations from the company and other interested parties such as creditors.

    Can anyone object to the company being struck off and dissolved?

     

     

    Any interested party may object. Objections must be in writing and sent to the Registrar of Companies with any supporting evidence, such as copies of invoices that may prove the company is trading. Reasons for objecting include:

     

    ◾the company has broken any of the conditions of its application (for example, it has traded, changed its name or become subject to insolvency proceedings) during the three-month period before the application, or afterwards;

     

    ◾the directors have not informed interested parties;

     

    ◾any of the declarations on the form are false;

     

    ◾some form of action is being taken, or is pending, to recover any money owed (such as a winding-up petition or action in a small claims court);

     

    ◾other legal action is being taken against the company;

     

    ◾the directors have wrongfully traded or committed a tax fraud or some other offence.

     

     

     

    What happens to the assets of a dissolved company?

     

     

    From the date of dissolution any assets held by a dissolved company will be ´bona vacantia´. This means they belong to the Crown. The company’s bank account will be frozen and any credit balance in the account will be passed to the Crown.

It is and has been a defunct non trading company over which termination proceedings began last year and which would have been struck off by the Registrar of Companies had false claims of directorships not been filed recently at Companies House. Sevco 5088 was listed in the company’s announcement dated 22 April 2013 to comply with the AIM Rules for Companies requiring disclosure of directorships held by the directors of the company both currently and during the preceding 5 years. Sevco 5088 was not the acquisition vehicle which purchased the assets of Rangers Football Club.”

     

     

    I await our intrepid MSM quizzing RIFC over both the failure to have this company struck off and the continuing involvement of Mr Green who was reappointed in February of this year – all of this in a company that has an outstanding Letter Before Claim against RIFC, of sufficient concern that it was noted in the Annual Accounts for RIFC as a Contingent Liablility.

     

     

    Or are they waiting for Mr Whyte to reassume his directorship of Sevco 5088?

    Not knowing what the U17 game was like the other night, cos I wasn’t there…

     

     

    But most of the MSM reports go along the lines of – sevco fans turned up not wearing colours (dodgy) and sang their songs of hate all night, set of fireworks, bangers & flares before ripping up 100 seats. Celtic fans set off a smoke bomb.

     

     

    The reports then explain along the lines of both are as bad as each other, with a pic of Celtic fans.

     

     

    I know I shouldn’t take any notice, but it’s bloody annoying.

    Well 5088 is a mystery.

     

     

    Remember Green claimed to be the sole director and applied to dissolve it only for Whyte to lodge a form that says he was also a director and put a stop to the disolution. Recently it looked like some sort of agreement had been reached between Green and Whyte (nice ring to that phrase) whereby it looked as if Green was now sole director and could go ahead and dissolve it.

     

     

    Now that proposal to strike 5088 off has been suspended. So the company that had an irrevocable agreement with Duff and Phelps to buy the assets (but not the history, because history can’t be bought and sold) of Rangers, still exists. It is not going away easily.

  19. TD67 – D&P agreed the sale to Sevco 5088. Green reasoned that he thought it should be kept withing Scotland and set up Sevco Scotland and it was sold to that instead.

    However, after a friendly debate with, well, a friend two theories have been suggested:

     

    [1] Neil will oversee the team through the CL qualifiers but will then depart, having set the Hoops up nicely in the group stages (leaving as a hero) or will depart with his tail between his legs.

     

    [2] Guide the Bhoys to 4-in-a-row, last achieved under Jock, leaving him in a legendary position.

    If the club is going to spend money…there are some amazing footballers in the SPFL the club should buy,so I agree with you on that score.

     

     

    Also judging by the online map of the stadium,there seems to be very few tickets left available for the Dundee United game.

    Have the Scottish media apologised to Celtic FC and the Celtic support for portraying the Celts the same as the horrible hordes of Huns who support Sevco 2012.

     

    I’m on hols and not up to date with all the news, just looking for some apologies and admittance of failure by paid employees of what should be a responsible group of media.

     

    How far does the media in Scotland have to go before they wisen up.
