Rangers administrators, Duff and Phelps, were as recently as yesterday briefing media that they hoped to conclude the sale of Rangers before the end of the season – which is their game against St Johnstone on Sunday.
Late Friday morning this seems unlikely but it is an important deadline. If Rangers morph into a Newco and are given permission by the SFA and SPL to take the field against St Johnstone on Sunday, any player who participates will have transferred his employment to Newco. Newco would then be able to retain his services for the length of his Rangers contract or would be able to sell him to fund a trading shortfall.
If a Newco is formed after Sunday, players have two months to decide if they want to join the company or remain Rangers employees until redundancy or until Rangers fail to pay wages.

I think what Paul is saying is that if a newco exists by Sunday and players turn out to play for the newco then those players have in fact tacitly agreed to tranfer their employment to the newco (knowingly or otherwise, I guess) and so the newco owns them for the remainder of their existing contract

The protocol which has been agreed to by all member clubs is to choose 3 panel members from a pool and that they shall remain anonymous (except that parties to the litigation will obviously know who they are). The decision to reveal the identities of the appeal panel, and before they sit in judgement, is a result of intimidation by officers of the club which is taking the appeal. Can’t see a problem with this myself.

That is the whole point of Employment Law and the TUPE Regulations to stop employers bouncing employees into contracts/situations where the consequences and alternatives have not been fully explained and agreed. There is also a time scale of events to allow the employee consultation and to seek professional advice which has to be adhered to.
Pitching up on Sunday saying we are newco and you are all employed would be a leaving them liable to claims. Any such employee would be able to resign on the grounds of constructive dismissal. As their registrations would have reverted to the SFA in the event of oldco transferring to newco without proper registration then their claim would possibly be against the SFA , appael to eufa..etc, etc…

They have decided that the original decision is a disgrace and that they will win the appeal. After all, the statement of reasons tells us that other club directors and employees “must have known” what was going on. Pure speculation. Where’s the proof? Kangaroo court. Best of all – “what happened to innocent until proven guilty?”
The thinking behind naming the panelists must be that the offences of RFC are going to be in the public domain soon enough and no one, not even the most bitter hun, will be able to argue with the decision to ratify the punishment.

On what grounds are the huns actually appealing?
I haven’t actually read the full document from the original panel, but pretty near the start it says that the huns virtually accepted several of the breaches but argued mitigation.
Is their defence “We are Ranjurs”? Or is it “that big boy dun it and ran away”?
I’m sure neither will go down terribly well with His Lordship.
