Legal term of the day: uttering

Since Corinthians FC gave up the good fight football has largely been a brutish game.  Even those supporters, who are unable to raise a limb with anything approaching athletic guile, often talk a brutish game.  Now, in Scotland, the accountancy geeks are having their day.

The mere mention of the word ‘taxation’ has ears pricking up while the entire corporate accountancy system is now as much of the daily lexicon of football fans as the Laws of the Game.  I reckon the law geeks will have their day soon.

I’d never heard of the crime ‘uttering’ until yesterday, now it’s all I hear from my Edinburgh sources.  Uttering can broadly be defined as using a document you know to be forged.  Don’t worry, it has nothing to do with Our Hero, just an observation for you.

On other matters, still no word from the SFA on the scope of their investigation into Rangers, or the position of their president relating to this matter.  When respected mainstream journalists are making unchallenged assertions about improper registration of players, the SFA cannot choose to ignore these events.  We know they are aware of the allegations, we know the allegations relate to the period when the SFA president was involved with Rangers.  We just don’t know if the SFA are doing anything about them.  A statement confirming that no one is immune from investigation would be a start.

    I see the head of thems fan club Andy Kerr was done for D D on Saturday as he returned home from the Killie game. He was 3 times over the limit @101. His car was confiscated and he was banned for 2 yrs and fined £670.00. They also kept him in custody for 2 days

     

     

    What id like to know is. What the hell was he celebrating??

  5. Rangers doing the Banstead thing would still require authorisation from both national bodies and Fifa to allow a team to participate in a league in a different country to its home ground. It would fall down at the part where they try to change the Home ground. They would likely be left with a non-league team in Surrey called Rangers FC.

    Just a couple of points.

     

    1. If they go into liquidation then Ibrox gets sold off to the highest bidder. So don’t see how they could be playing at Ibrox (unless the highest bidder is Banstead)

     

    2. Where is the money coming from that would enable Banstead to progress through the leagues ? There are some clubs with money struggling to get out of the Championship. So it could be a loooooong time before there is any money to be made on that one.

  11. Following on from Auldheid above, the league would have a big say. I am fairly certain in the SPL there are rules stating that major changes to a clubs details (Strip, name, home ground etc) go to a league vote. We for instance could not just up and decide to move our home stadium to Dublin.

     

     

    In theory the Banstead thing would perhaps work, in practice it would take years of legal wrangling, in an environment that horses out associations that allow the local courts system to interfere in football.

     

     

    Neither FA would let it get past 1st base.

    The match delegate has reported sectarian singing at Ayebrokes last Saturday. So they must get off with it as any punishment SHOULD alert UEFA and as they already have a three year suspendedsentence hanging over them it will be a case of case dismissed surely ?

  16. Talking about years of legal wrangling…..an angle I have not yet seen discussed surrounding the criminal investigation into Whyte’s purchase of Rangers.

     

     

    I am led to believe should Strathclyde’s finest believe yes there is indeed a case to answer, that all of the assets involved in the alleged crime are frozen resulting in the business being de facto suspended from trading whilst the investigation is carried out. Good luck trying to bring a business out of administration with frozen assets and a subsequent de facto suspension in operations.

     

     

    That would be fun…..it could be Rangers FC 2014.

  17. rangers have not put money into Banstead Athletic. Whyte has used rangers money to purchase land to build 18 pitches and a training facility.

     

     

    So no Newco from that direction.

    One that has crossed my mind. So possibly! A concern I think. Needs to be watched.

     

     

    Are there rules covering geographical location of football clubs playing in national leagues? Cardiff and Swansea and Wrexham of course all play in the league of a different country and are registered not to the Welsh FA but to the English one.

     

     

    The worm can is bottomless.

     

     

    Mind you if it were so easy to do then why would Celtic not have bought out Staleybridge Celtic, moved them to Celtic park, given our reserves a chance to get them through a few leagues, buy them some players as they go up and up and then eventually just merge the two clubs when they look like knocking on the door of the Championship? It seems to simple. Still, never trust them. Assume they are up to something and laugh when it turns out they didn’t know what they were up to……………

    Encourage that idea in the mind of the huns – and when they think it might just be a possiblity, advise them that Banstead Rangers would be competing in the Combined Counties Premier League in 2012-13 (level 9) of the English Football system).

     

     

    To get to the Championship (level 2) would take 7 back to back promotions meaning they would only begin playing in those giddy heights in the 2019-20 season.

     

     

    That sounds like a great basket to put all your eggs in!

    Whyte may have projections that detail hitherto unknown income that would allow the club to afford £2.5m per year on top of the substantually reduced season book income over the next 4 years.

     

     

    This may allow him to sell Rangers 1873 for some degree of profit.

     

     

    Or perhaps Whyte knew that any offer of a CVA was going to be rejected, but just to be sure he low balled HMRC. £2.5m per year is 5% of the principal. Interest on the sum would be more than this.

     

     

    He may have made the offer to show the fans that he tried to rescue the club and only failed because an intransigent HMRC unfairly picked on Rangers. In any case I don’t think that it was an offer that whyte expected to be considered, let alone accepted. This is very similar to his attempts to buy players in the summer, when clubs over-valued their players and tried to hold Rangers to ransom. A laughable assertion, but one that was bandied about at the time.

     

     

    It still doesn’t change my opinion that should the FTT find that these ebt payments attract PAYE and NIC, these payments are wages and should have been included in player contracts submitted to the SFA. Whether the failure to do so amounts to invalidating the players’ registration is of course then a decision for the SFA to make.
