Lord Advocate, when the Scottish state bent over football

You will not recall an earlier time when the Lord Advocate made an unreserved apology to parliament and the Scottish taxpayer for a wrongful prosecution because it has never happened before.  Yesterday, the incumbent of that position since 2016, James Wolffe QC, did just that over the persecution of Rangers’ administrators, David Whitehouse and Paul Clark.  Each man received £10.5m compensation, an astonishing 20% of the annual Crown Office budget.  The total cost of the fiasco is likely to exceed double this amount, possibly as high as £50m.

That’s not all.  Last year Whitehouse and Clark settled an action for wrongful arrest against Police Scotland for a figure that those in power have decided you and I should never find out.

The case stood on the selective use of evidence.  Police and prosecutors were in possession of the legendary Charlotte Fakes files, some of which proved Whitehouse and Clark were innocent of the charges, but those documents were not made available to the defence.  It is the same modus operandi used to lock up the Guilford Four, who police had evidence of their innocence, but who spent 15 years in prison.

Roddy Dunlop, QC for Whitehouse, demanded answers as to why the arrests and subsequent prosecutions took place.  He is not alone, although I suspect Mr Dunlop, you and I have a fair idea. The Crown acknowledged the prosecutions, which started in 2014, were “malicious” – a huge word for the Lord Advocate to use about his prosecution services.

What’s it to you?  The criminal and prosecution service acted maliciously in the matter of who controlled the assets of a football club, in Scotland, between 2014 – 2018.  The two administrators, their employer Duff & Phelps and those they associated with over the sale of Rangers assets, faced grassroots opposition to their actions.

You may wonder if the might of the Scottish state bent (which it did) in tandem with this opposition (which has yet to be determined).  Opposition MSPs have called for a public inquiry, the Scottish Government do not want you to know what happened, so are opposed to this request.  A status that will hold at least until May’s elections.

    The first experiment to test this theory involved milkmaid Sarah Nelmes and James Phipps, the 9 year-old son of Jenner’s gardener. The vaccine helps the body develop immunity to smallpox. It was successfully used to eradicate smallpox from the human population.

     

     

    53 year ago prior tae emigrating we were required tae have the smallpox inoculation or we widnae be allowed intae the country.

     

     

    I had a small cut on my face and having leaned against my wife’s arm through the night inoculated my face. This caused a severe reaction resulting in practically the whole summer on the sick and delaying our move by at least 6 months.

     

     

    The following year we returned hame but 6 year after that decided tae come back, nae inoculation this time as in 1972 the disease was eradicated in the United States, Canada followed suit.

     

     

    So although I had a bad reaction, 53 year after getting inoculated with cowpox and actually catching it, at the time only the 2nd person in UK history to do that, my story was allegedly in the Lancet, I have yet tae Moo.

     

     

    Covid vaccines are running late here but when the opportunity arises we’ll be getting it.

    I assume pro rata infrastructure spend in the much larger populated greater Glasgow area is next on the list.

    When the Auld Reekie focused civil service were working up their proposals for City Regions they had to get creative to get Edinburgh climb up the population ladder.

     

     

    Consequently the Edinburgh city region covers the city itself plus the Lothians / the Borders / Fife so that it can have a scale — just over a one million of a population that delivers £1.3bill in funding.

     

     

    In contrast the funding for the Glasgow City Region wich includes Dumbarton / Inverclyde / Lanarkshire is in the region of £1.2bill despite having a bigger population / more industrial deacay / more deprivation.

     

     

    So much for the power of Holyrood.

     

    Public funding trough for Auld Reekie more like.

     

    Plus they got that ridiculous bridge.

    As a lover of pubs, it’s always sad to hear of one closing; especially when it is one with a long history – a last outpost of a once thriving community.

     

     

    Hoof-hearted? You always got a good nosebag at the Stanley BarThe regulars set off on one of their Sunday runs, in the 1960s.

     

    The Stanley Bar, in Kinning Park, has poured its last pint, put the towels over the taps, and called last orders.

     

     

    A ‘Celtic shoap’ – a rarity so close to Ibrox – it was once the beating heart of the Irish diaspora in Kinning Park, and the favoured watering hole of the staff from the nearby Gray Dunn biscuit factory (I can still recall the delicious aroma which used to emanate from the factory).

     

     

     

     

    Once surrounded by, and underneath, tenements, the bar – like the rest of old Kinning Park – took a hit when the M8 sliced its way through the area, with locals cast out to the fringes of the city. Many used to make the trip back into town – especially when there was a Celtic game on – to drink and blether in the same pub their parents and grandparents had drunk in. Like a shoogly tooth, the pub held on.

     

     

    The bar was also a noted stop on the ‘Sub Crawl’, when raucous gangs of pissed up students would disturb the Kinning Park peace with their loud voices and demands for ‘exotic’ drinks (anything other than lager, heavy, stout, or whisky was considered ‘exotic’ in the Stanley).

     

     

    In the ‘good old days’ of Sunday licensing, the pub regulars used to organise a weekly bus run; you had to travel more than five miles to be considered a ‘bone fide traveller’ to get a drink in a hotel.

     

     

    The Byrne clan, John and Elaine, who have run the bar for the last 16 years, welcoming and feeding the regulars like family, have now decided to call time, and another Kinning Park corner will fall silent.

     

     

    I raise a glass to them, and wish them well.

    – Why would Administrators seek to purchase new footballers for a failing club?

     

     

    – Why was SEVCO 5088 allowed preferred and exclusive status to purchase the assets in liquidation once the planned cut and shut CVA failed when an open auction would have returned more for creditors?

     

     

    and most importantly

     

     

    – Why did they sell the assets to SEVCO Scotland contrary to their legal agreement to sell to SEVCO 5088?

    My thoughts on the D&P compo is it’s so high because it’s hush money. The powers that be don’t want or can’t afford for the true story to come out. After all the corruption goes straight to the heart of the fabric of scottish society as someone once said.

    I’m 60 and i’ll be more than happy to take my jag when the time comes. I just don’t get why people are wary of it. Surely if it makes the symptoms less critical even by a fraction it’s worth the risk?

    I love music it is the greatest escape from anything that troubles you. I think sometimes though my enjoyment of it is a little backward. When I was young I tended to enjoy what would have been seen as older peoples music, as I got older I enjoyed music aimed at younger people. Hence my strange and varied taste at times.
