McGill comments allow SFA scope for inquiry

440

Amid the acres of confusion that surrounds Rangers and the Scottish game at the moment, one matter is now clear of the tax authorities, not subject to dispute by the various parties squabbling over Rangers, and free for the SFA to examine.  If they are interested.

Former Rangers director, Mike McGill, when speaking to the media alongside Sir David Murray on Tuesday, said, “The club used an old offshore EBT scheme in 1999 with three players.  That scheme is the subject of the small tax case.

“The Revenue provided some information to us in early 2011 and we conceded based on that information and provided for payment in the club accounts.”

The simple question for the SFA is, were details of payments made through the old offshore EBT scheme, which HMRC challenged last year and Rangers’ old board conceded, submitted to the SFA?

If they were, our faith in the governance of the game can be restored and we can all look forward to the Cup Final on Sunday.  If not, whose registrations were invalid and which games did they participate in?

As this question affects more than just SPL football, the SFA are the only body competent to investigate this matter. They are also competent to administer any appeal process. We hear the SPL inquiry will not mature until after the HMRC-Rangers First Tier Tribunal reports, which could be well after the SPL split, potentially creating chaos if Rangers were incorrectly placed in the top six.

This is a governance issue of enormous proportions. The SFA should use McGill’s comments as an opportunity to take a fresh look at this issue and quickly instigate an inquiry.

I’m off the see the lawyers this morning.  More later, I hope!

  1. If the Ticketus deal is deemd to be invalid, surely they will then get a debt for equity deal from the admin, thus possibly pushing HMRC below the 75% threshold.

Could be a cunning plan to aid the CVA process

  2. ASonOfDan,

Unlikely to be ABLE to ban them as a newCo… they would have the obvious 3 season ban anyway. Anything else would probably be legally unenforcable as in theory the newCo are not the huns

  3. Awe_Naw – Commendable effort contacting Bremen and Stuttgart! The more pressure from out width Scotland the better.

    Keep up the good fight!

The administrators who are there to oversea this entire procedure at the Big House are clearly as incompetent as the man who got them into this mess(who may have fled oversees, by all accounts).

    You couldn’t make it up!

Agreed, it should certainly be linked to the number of away fans brought to games. Take St Johnstone for example, their average attendance is 3,934. when we visited there were 6,759.

now we know their ave attendance figure is skewed due to large increases when Celtic (and Rangers) visit so its not beyond the realms of possibility to suggest that we bring 3,000 supporters to visit their ground.

Do they bring 3,000 to Celtic Park?

Provided HMRC are owed at least 25%, they can block a CVA. At a creditors meeting, 75% of creditors have to agree to CVA.

  9. Woody Lee – Unlikely. he rule states no payment should be made by a club to an individual due to their involvement in association football. The question would be asked “Why are you paying that player that money?”

The answer of “because we felt like it and it was nothing to do with him playing even though he only got these payments when he did play” would not stand up to any scrutiny

Pinch of salt to be taken with that last post matey!

However, the administration procedure(ie. the mess I was referring to) was initiated as a result of non payment of tax since Whyte took over, no?

Either way, its party time in many a fenian establishment!

I doubt there is any chance of gate sharing. The ten aren’t even trying their arm on that one.

There ARE ways that the ten can improve their lot. They just have to do some work, rather than scrapping for the crumbs of our efforts.

First, they can improve their home gates by in siting on fan-friendly times for kick offs. Their home gates against us would improve if games at Aberdeen and Inverness were held at reasonable times.

Second, they should sign a pledge to ensure they take all reasonable steps to leave no ticket unsold. That means moving their own supporters to make room for visiting fans, where there is demand. Teams like Motherwell and Kilmarnock have turned their noses up at hundreds of thousands of pounds.

Once they have taken care of that, we can talk about sharing tv money.

    Funny how things work out.

Seems like only yesterday when the Huns were doing the conga through a disreputable Glasgow slop house in support of Porto – bet they won’t be raising a glass to them now that they are about to hammer yet another nail into the coffin.

    The longest Christmas ever…

Just catching up….Good to see the Media in Germany getting up to speed on this…Well to be honest , I could only understand the words – R**ge*s, Porto and most importantly Michel Platini in there…Oh aye and Forster? surely the big man’s no involved:)

I am a Celtic Supporter, I spend my money to watch Celtic!

    ————————————-

I’m not sure how to break this to you but the other team on the park playing in different colours, defendiong their goal and having the audacity to attack Celtic’ are there for a purpose. To give you a Celtic to watch. Without them you might as well do the Celtic park tour every Saturday and admire the history.

This gives smaller clubs a wee bit of a negotiating advantage, especially if they gang up on us, so much as it upsets you we have to listen.

In days before TV geopgraphy determined club size via the numbers close enough to come through the gate. Although TV income has destroye that model elsewhere, the relatively small amount involved in the TV deal means it still applies to an extent in Scotland.

For the initial logical reasons I have no problem with the principle of greater sharing, my worry (and I’m sure Celtic’s) is what will the opposition do with that extra cash to improve their standard as opposed to paying more to the same level of player? A50/50 share would lead to an overall dumbing down, with Celtic having as much chance of making any progres in Europe as say Hearts have now.

On the other hand the SPL clubs need to recognise that what keeps the Celtic gate that they want a bite of up, is not only that a winning team is turned out but the standard of play is acceptable.

Football is a perfect model of interdependence, get it wrong and the whole construct dies.
