More key information from FTT report for Nimmo Smith Commission

The enormity of the forthcoming SPL Commission report could easily be lost in the ocean of headlines which has engulfed this matter in recent years.  I’ve noted below more information from the recent First Tier Tribunal report on Rangers tax case, in an attempt to clarify some of the key issues.

From The Evidence:

“The Appellants’ first witness was Mr Red, a senior member of the group’s tax function.  He is a Chartered Tax Advisor and qualified as a tax inspector previously to joining the Appellants.”

“Mr Red insisted in his evidence that the Trust was not a means of “tax avoidance””.

“It was noted in an internal memo prepared by Mr Red dated 8 September 2005 to the Board of MIH that he had described the Trust as a form of “tax avoidance scheme””.

Dissenting opinion from Ms Poon:

The Nature of the Side-letters
“Another strand of evidence being tested was the nature and purpose of the side-letters.  Asked about the secrecy surrounding the side-letters, referring to the fact that they were not lodged with the SFA, nor disclosed in the long period of HMRC’s enquiry, Mr Red’s reply was: ‘I still say there is nothing secret about them. We have nothing to hide in these side letters’.

“It is not accepted that there had been no deliberate concealment of the side-letters, in view of how the first side-letter only came to light through the seizure of Mr Berwick’s file nearly four years into the enquiry.

“It is not accepted that the nondisclosure of the side-letters arose from a ‘credible’ view that Mr Red considered the side-letters irrelevant to HMRC’s enquiry. As a former Inspector of Taxes, Mr Red knew, or should have known, that the side-letters were highly relevant to the enquiry.”

“The side-letters showed a form of contractual arrangement, and they proved linkage between the sums contributed into the sub-trusts at the appointed dates and their withdrawal as loans from the sub-trusts as contemporaneous transactions. The contractual aspect and the linkage between the amounts of contributions to the main Trust and the sums loaned had been repeatedly raised in the enquiry correspondence.

“A fair conclusion to be drawn from the circumstantial evidence on the one hand, and Mr Red’s oral evidence on the other, is that the side-letters had been actively concealed. The reason for the concealment might have been, in Mr Red’s view, the side-letters could be incriminating evidence against the impression of the trust operation that he had been trying to give.”

“While not denying the proposition put to him by the Respondents that ‘there’s an overarching contract with each of the footballers, consisting of the written contract and the side letters’, Mr Red maintained that ‘it’s our view that the side-letter or the letters of undertaking do not need to be registered or lodged with the SFA’ (Day 3/31-32).”

So, in evidence, Rangers witness Mr Red, did not deny the proposition that there was an overarching contract with footballers consisting of the declared contract and side-letters, but “it’s our view” that side-letters did not need to be lodged with the lodge SFA.  Ms Poon suggests a fair conclusion is the side-letters were “actively concealed” as they could be “incriminating evidence”.

The SFA has issued disciplinary action against many clubs for erroneous registration but no club has ever faced a charge of actively concealing information necessary for proper registration.

The SFA president was a working director of Rangers when “our view” was established and was legally responsible for the club’s actions.  As I noted yesterday, but, frankly, can still not comprehend, on publication of this report the president announced himself “somewhat vindicated” by its contents.

Majority opinion:

John McClelland became a board member of Rangers in 2000 (legally responsible for conduct and oversight) and according to Wikipedia held senior board level positions in the electronics industry.  He was also a director of the SPL (legally responsible for conduct and oversight) between the company being formed 1997 and 2008.

The majority opinion, which favoured Rangers position in regards to income tax, noted the following about Mr Indigo, who was “a board member of Rangers since 2000. His previous career was in industry, latterly serving in senior executive roles.”

Mr Indigo “acknowledged that he was, however, aware of the overall content of arrangements made with players and did not consider these to be “secret”. He believed that the Trust had been used to pay appearance money and bonuses.”

According to rules established by SPL directors, including Mr McClelland, money paid in connection with football, including appearance money, has to be registered with the league.  It also has to be registered with the SFA.

When the Lord Nimmo Smith Commission reports, we will discover if this is what passes as vindication in Scottish football, or if a senior officeholder of the SFA, and others, will be dismissed in disgrace and banned, sine die, from the game.

    Then Neil can roll out some of the kids for first team experience and get them used to playing in competition with first team regulars. That is the way you have to introduce emerging talent and make the most of the academy graduates— their passing out class if you like.

     

     

    It also give value to the season ticket as it means we get to see the young guys at Celtic Park against proper professional league opposition as all the other teams have something to fight for– so they have to be at the top of their game.

     

     

    The young guys then have to take a step up in class in terms of opposition.

  2. The EPL are a car crash waiting to happen. Their wages are suidical.

     

    Celtic are in the position they are in now because of astute management, including financial management – rather contrasts with that other club, who used to play us now and again, can’t quite recall their name at the moment…

     

     

    Anyway, going down the path of EPL wages is suicidal. Give it to one player and others will want something similar.

     

    Sooner or later, the EPL bubble is going to burst big time and the fallout will have massive impact, well beyond the EPL.

     

    Celtic need to continue on the path they are on.

Ourselves, Arsenal, and most of the German clubs will, I think, be some of the few who will be ready to compete under those conditions. Although,I suspect, the “Big” clubs, will find a way round it, and still pay players with money they either dont have, or dont declare. (remind you of anyone?)

    Look no further than Alex Ferguson at Man Utd.

     

     

    Took him quite a while to find his feet but Utd’s loyalty has paid off far more than they could ever imagine. His consistency has been nothing short of incredible, Arsenal, Chelsea, Man City…..Spurs, Liverpool, Everton….all demonstrate how difficult it is to maintain a challenge year in year out. Alex Ferguson is worth his weight in gold and be in no doubt when he retires Man Utd will slip down to

     

    not always being guaranteed to be a top two challenger.

     

     

    We have the opportunity to allow a young manager time to settle into the job, serve an apprenticeship in the lower divisions, make mistakes and learn and become successful.

     

     

    Man City or Chelsea would kill for an Alex Ferguson it’s just they don’t have the time to cultivate one but we do and this is the time to do it.

     

     

    I don’t expect us to win every game anymore and I’d suggest some of our fans wake up and get real about our current position as a club.

    Hence the reason why, if Rankers are found innocent of wrongdoings via the side letters, it will open up the flood gates to manipulate the FFP controls.

     

     

    The decision by LNS is not only being awaited by the Scottish football authorities but, depending on the outcome, it could set a precedence which could impact the UEFA FFP processes.

     

    I.e. if it is decided side letters do not form part of the contract and do not need to be declared to football authorities, then financial controls by footballs governing bodies go ‘oot the windae’, so to speak.

    CELTIC have been forced to turn down a request to play in a testimonial match for Liverpool skipper Steven Gerrard.

     

     

     

    The Anfield club approached Parkhead chiefs to play the game in August, but it will coincide with qualifiers for the Champions League.

     

     

    Manager Neil Lennon said: “We can’t fit it into the schedule.”

  13. Have to agree that paying big Vic EPL level wages is nonsensical.

     

     

    Our income levels this year cannot be gurarunteed over the life of a new contract for Wanyama. Therefore it is hugely risky to pay salaries to players which assume that level of income, or anything near it. We should assume EL group stage football and attendant income, and work from there. Transfer fees in should pay down debt and re-invest in capital assets which are likely to generate further returns. In other words, buy low, sell high, create a virtuous circle in the management of our playing resources.

     

     

    The job on paying down debt is not really done, notwithstanding what is in the books. It has been discussed on here before but the way celtic report their financial figures (outstanding bank debt against cash in hand to provide a net debt figure) doesn’t necessarily take account of bills which fall due a day after the accounts are published. I would imagine that the club operates a large portion of the year overdrawn at the bank as a result.

     

     

    Celtic have to avoid the fiscal lunacy of those EPL clubs who assume an ever increasing television rights package, and spend tomoroow’s (predicted) income to pay today’s bills. It is a huge bubble which is waiting to burst. I mean, look at what QPR are paying Christopher Samba. That deal will end up costing them north of £30 million. Is his performance on the field worth an extra £7.5 million a year to the club? Highly unlikely. This dis-connect between what is spent on footballers relative to their production will lead to a collapse of the system as a whole. The attendant fall in player’s wages will make Celtic more competitive with what is on offer down south. We have to make sure that the collapse doesn’t drag us down with it, and that we are in a position to capitalise on the lunacy carried out by others over the past decade.

    This week the Rangers support once again found itself in the ring with a familiar opponent, itself. Those of my generation (and older) know that it wasn’t always like this. Or, at least it wasn’t always as palatable. A perfect storm including but not exclusive to; the sanitization of football, the increased sensitivity of society, the rise of the Internet and subsequently Social Media, a partisan, hostile media and the most turbulent twelve years of the clubs history led to a once frightening support becoming increasingly fractured and disorganized. However, in the last 12 months this started to flux. The consistent, malicious attacks on a mortally wounded Rangers seen a commonality form where previously there was practiced avoidance to find one. However, old habits tend to die hard…

     

     

    On Wednesday, the morning after Rangers reserve side clinched the league championship; we witnessed what can be most accurately described as a ‘Twitterstorm’. This storm centered on a banner unfurled at Ibrox the previous evening when The Swifts played Queens Park. The banner in question directed a message towards Mike Ashley and presumably the proposed naming rights of Ibrox Stadium. The language used was unfortunate and crude. The message wasn’t skillfully put across. But, a handful of Rangers supporters (not the Union Bears or The Blue Order as people suggested) wanted their voice and opinion heard.

     

     

    Although personally I disagree with both the method and the message, I can’t help but support those fans right to an opinion and to voice it. The banner was the subject of much derision from the online Rangers support. Immediately battle lines were drawn, fissures appeared, opinions were drawn like sabres and sheaths were discarded as quickly as you could type 140 characters. It was all too familiar. Not much thought or discussion was spent around the fact that Mike Ashley was invited in to the fold by Charles Green. Equally so, little consideration was given to the fact that, agree or not, people have a right to a voice.

     

     

    This is a subject close to my heart. The drowning out of dissenting opinion is as much to blame for the disastrous second half of Sir David Murray’s reign as anything else. That obviously led to the last 12 months and all that came with it. As such, it is absolutely vital that voices are heard. It is equally vital that contentious opinions are voiced in a sensible manner. This will not only sway opinion it will earn respect and support. The truly unfortunate thing about this was that a fantastic achievement, one that should have had the Rangers support thinking about and discussing the future, played second fiddle… To a banner.

     

     

    If Tuesday was a storm, Saturday was a tsunami. Rangers travelled to Berwick on SFL 3 business. And, as has been well covered since, an audible portion of the Rangers support engaged in what has been described as sectarian, bigoted and inappropriate singing.

     

     

    How to define these songs is a challenge in itself. I think even the most learned academics would struggle to bring concise definition to Scotland’s supposed sectarian problem. Equally so, there are the obvious contradictions as to where these songs fit on the offensive scale. Are they on a par with the anti-English sentiment of the Tartan Army? What about the anti-Protestant/British sentiment glorified by both the Celtic support? And, why is it that it is appropriate for one Glasgow team to celebrate links to one part of Ireland while it is in bad taste for another to do so? The point and counter point way of looking at this issue is available and there to be used, or exploited, as one sees fit. But, where is it going to get Rangers? There is simply not an end to it. While the veracity of each point is not in question the end goal remains undefined. And, while we argue semantics with each other, the clubs enemies line up to stick the knife in. This Saturday past we helped sharpen the knife for them.

     

     

    Make no mistake about it, Saturday was a spectacular own goal for the Rangers support. In full view of a nationwide television audience and within range of the (for once) fully calibrated ESPN microphones we treated every single person who wishes to see the club harmed to exactly what they wanted. A stick to beat the hell out of the club with. There has been much talk over the last couple of months of a move to England. I wonder if the average English viewer feels more endeared or estranged from the Rangers support as a result of songs about Fenians and Popes? I wonder how the same audience would have felt if we had treated them to the Ibrox songbook without? Better or worse? Then again, nobody likes us and we don’t care, right? It’s our tradition, right?

     

     

    Tradition. There has been a lot of talk about ‘tradition’ in the fallout of the Berwick fiasco. What is this tradition that people are so quick to defend? Is it a tradition of anti-Catholic sentiment that must be publicly displayed at football matches? This club goes back five generations in my family (that we know of). Does that mean we have a Rangers tradition? My father is a member of the Orange order. Yet, I don’t remember being told at any point in my life that singing about a strange old man in Rome or a group of Irish radicals from the 1860’s is a part of my clubs tradition. Surely, my father the Orangeman, would have mentioned this to me at some point? Personally, I always thought that the Rangers Tradition was based on sporting excellence, fair play, a winning mentality and an undeniable ‘gallusness’ borne out of Glasgow’s native and immigrant working class. That’s the tradition that I am quick to defend. The tradition where a grandfather peels opens an ancient scrapbook as if he was rolling out the Magna Carta, the whole time whispering about Davie Meiklejohn. Of course, there are tangible links to Unionism and Protestantism. But, I don’t think these things define the club. They absolutely define me as an individual. But, they don’t define my football club. They certainly helped shape Rangers Football Club but the institution is larger than a single political or religious belief. Is it not? Have I been duped? Are Rangers that linked to songs about Fenians and Popes that without them our tradition ceases to exist?

     

     

    In his famous speech, Bill Struth did not mention religion. If anything he spoke of how Rangers should always be ambassadors for what is right in the game. He spoke of inclusion and a healthy respect for rivalry. He also spoke about tolerance and sanity. Those that sang the songs at Berwick on Saturday displayed neither. Those that took to the Internet in the fall out to either defend or attack the singing displayed even less. Accusations of handwringing and grassing appeared on one side and knuckle dragging, embarrassment and Neanderthal on the other. Members of the clubs media team were abused and ludicrous stories surfaced on how Ally McCoist was ‘forced’ in to contrition on the issue as a result of the clubs official statement. And, all the while the clubs detractors detracted, the clubs haters hated and the clubs enemies smiled. I’m sure that the Director from Celtic’s media department, who witnessed it first hand, hasn’t mentioned it at all since. Nope, no way…

     

     

    I am willing to bet that those who have defended the singing at Berwick on Saturday have, at one point in their life, uttered the immortal phrase “no one man is bigger than The Club”. Why is it then that the same people now see themselves as exactly that? You see, there are two unavoidable facts here. Firstly, Rangers have repeatedly asked the support not to sing certain songs. Second, said songs have gotten us in to bother with UEFA previously. By extension, singing those songs put the club in harms way. So, if you did sing those songs you were being either selfish or stupid. Stupid we can all live with. I am stupid on a daily basis. On the other hand selfishness is something we can do without.

     

     

    So what is the answer then? It is quite simple really; just don’t sing songs that can be deemed sectarian (note, I did not say songs that are sectarian). The club took commendable, swift action on Saturday and Charles Green must come out with a statement himself, now. James Traynor should immediately start working with fan groups to produce a ‘song book’. The club must immediately give something back to the support by demanding clarity on the heavy handed role that FOCUS is playing at football matches. A law is about to be passed that is based on number of arrests not convictions, this effects Rangers supporters. In addition, the club must seek clarity on and take a leading role in defining and eradicating sectarian and racist behavior in Scotland. Finally, we have to learn to treat each other with respect. We are all members of the same broad Kirk. That means we won’t always agree with each other. But, it also means that the common goal of what is best for Rangers should always prevail. What was best for Rangers this past Saturday at Berwick?

     

     

    I sincerely hope that Saturday was a blip on what has been an incredible display of pageantry from the Rangers support this year. It is a privilege, not a right, to be part of this support. We have a title party looming and on the darker side of things we have some vicious fights approaching around the corner. We need to embrace the togetherness of the Hampden march and Kilmarnock at home last season. Because, if the last 12 months have taught us anything it is this; Rangers enemies are petrified of a united Rangers support galvanized and full of purpose. Nothing will have them cowering and showing their hand quicker than the thought of our support united and focused. Now that would be something to sing about.

    For me the singing section is probably a step in the right direction, but still falls short, because unless we can move to another league set up, the heady days of a full season ticket fan base are over. I think we have got to recognise that it’s unlikely that our SB uptake next season will increase. If we are lucky numbers may stabilise.

     

     

    Entrance into another league seems as likely as rangers paying taxes, and we may need to be more creative than just allowing fans to sing in certain areas, (with the relevant police permission of course and depending on the mood/persuasion of the cop in charge on the day)

     

     

    Some fans will blame the drop in numbers, on the economy, and if they are correct then the solution must be to allow fans cheaper entry. IMO it will need to be significantly cheaper, nearer £10 than the current £25 at the gate.

     

     

    Some might say, that it’s better to have 60,000 fans paying £15 each than 30,000 fans paying £30 each. The gamble for the club would be, if they dropped SB prices significantly but didn’t increase fan take up take up significantly, the club may end up with even less income, a big gamble that may devalue the SB if it failed. If I recall correctly the club gave away something like 5,000 tickets for a few games over the festive period and still didn’t fill the stadium, so if we can’t give tickets away for domestic games, I wonder how many folks who don’t already have SBs would turn up if SBs were cheaper.

     

    So we then compare the occasions when we did fill the stadium, what was the difference, why was the stadium full? Was it because

     

    We gave tickets away free?

     

    We had a terracing?

     

    We had a singing section?

     

    We had cheap tickets all round?

     

     

    No, invariably it was very simple. We played against better class of opposition and in fact we even charged more money to get in.

     

     

    Now we all knew the answer to that question, but none of us know how to achieve that objective of playing more competitive games, however failure to address it will likely result in ever decreasing circles. I too believe that the EPL credit bubble will burst one day. I don’t know if it will be anytime soon and wonder how poor our attendances will be if we just wait it out. I guess it depends on how long we have to wait.

     

    I also believe that a top Euro league is inevitable, how else will Barca, Madrid and the likes pay their debts without it? And I hope that we are still a serious club when that opportunity eventually comes around.

  28. blantyretim. I have the galaxy note 11 and once I got my kids to show me what it does, no problem. I think it is a great phone so I would go with it mate. If I can use it any young guy like you could breeze it.

    Dunno much about Thurso but I was in that wee boozer in Gretna once at the roundabout across from the retail park.

     

    Celtic were playing at Killie and we had been at the Grand national the previous day. Is that a Rangers pub? Ted McMinn was in with some very scary looking guys and our bus and another were supporting the Hoops. Ted’s henchmen went up and spoke to the vocal bhoys from the other minubus and they left instantly. Very uncomfortable atmosphere after that. Not sure if they were just passing through or actually drank there. I wouldn’t go back.

  30. blantyretim – I’ve had a Samsung Galaxy S Plus for a year or so (Ithink the two replaced it). No problems with it at all. At the time would have liked the Iphone 4 but the difference in cost was ridiculous (free for one 400+ euros for the other).

     

    One thing that I didn’t like in the newer Galaxys was that they were getting too big for a pocket phone – treading the line between phone and tablet.
