No illegal registration punishment, judicial independence scrapped

The Daily Record today report the contents of a document drawn up after a meeting between the SFA, the SPL, the SFL and Sevco suggesting “punishments for Rangers for the Employment Benefit Trust tax dodge used by Sir David Murray’s regime to pay players”.

The document details that Rangers would be stripped of titles and trophies ‘won’ by the club while they fielded illegally registered players, described by the Record as “the harshest ever seen in football”.

While Rangers EBTs had been in the news for close to two years, it was Celtic Quick News who first raised the question of Rangers players being illegally registered in an article on 22 February this year.  Clubs are required to note all payments players receive in connection to football with both the SFA and SPL as part of the player registration process.  Failure to register EBT payments is completely separate to the legality or otherwise of how the EBT was conducted, and until we raised the issue, there was no question over player registration, and no possibility of league titles being stripped.

Two weeks after Celtic Quick News brought the matter to public attention the SPL appointed solicitors Harper MacLeod to investigate the case.  The subsequent report concluded Rangers had a case to answer.

There are a number of alarming aspects to today’s Daily Record report (the newspaper appears to have the main story but don’t notice its relevance):

Sevco should not be involved in any discussion around the guilt of Rangers or any subsequent consequences.  Fan  power in recent weeks had shown that we are not a Banana Republic.  Disciplinary issues are subject to establish procedures.  Any attempt to meet with a party acting on behalf of Rangers to agree an outcome with both the investigating body and the appeals body, before an independent inquiry takes place, contaminates all who participate.

Scottish football has independent judicial procedures for dealing with serious breaches of rules.  Executives from the SFA and SPL have absolutely no authority to set-aside these procedures, nor are they appropriate people to act instead of the independent procedures.

Stripping Rangers of titles and trophies if they are found guilty of cheating is not a punishment; this simply reflects the legitimate winners of past trophies.  When an athlete is found to have cheated to win a medal, his punishment is not the withdrawal of the medal, which is an obvious consequence of being caught, he will also face a sporting or financial penalty, often a ban.

There seems to be no end of attempts to subvert sport in Scottish football.  There must be no backroom deals, not even if they bring a barrel load of trophies to Celtic, we cannot be bought-off by bling.  Independent disciplinary procedures must take place.

Although Rangers failed to register players EBTs, this matter is separate from what the Record calls “punishments for Rangers for the Employment Benefit Trust tax dodge used by Sir David Murray’s regime to pay players”.

If the First Tier Tribunal (remember that?) rules that Rangers broke tax rules the club could yet face football disciplinary procedures for failing to pay social taxes.

Last month we reported that the SFA was set to remove independent judicial oversight from the game as its existence was getting in the way of their plans for ‘Rangers’.  Although the Daily Record seem to be oblivious to the fact, they appear to have found documentary evidence that this is the case.

    Former SFA President George Peat was part of the SFA board which originally cleared Jim Farry of all wrongdoing against Celtic when he deliberately delayed registration of a player in order that they could not play for Celtic FC against Rangers FC (IA).     Current President Campbell Ogilvie is a former employee, director, shareholder, and EBT recipient from Rangers FC (IA).

     

     

    Of course, we also have the Chief Executives, such as the aforementioned Jim Farry, who was forced to resign for his anti-Celtic actions.

     

     

    There’s also former Rangers FC (IA) player Gordon Smith, who joined the SFA as Chief Executive, before leaving to move back to Rangers FC (IA) as a director of football.

     

     

    This is before we even start to get into the likes of SFL President Jim Ballantyne, former Rangers FC (IA) shareholder most recently spotted at a game (against Linfield) to raise funds for the Rangers Fans Fighting Fund.

     

     

    Now we have Michael Johnson on the SPL board, the only SPL chairman not directly connected with Rangers FC (IA) who didn’t vote against admitting Sevco Scotland Ltd into the SPL.

     

     

    Then there’s the vice chairman of the SFA Referees Committee and SFA council member David Dowling, who is openly a Rangers FC (IA) supporter, and holder of shares in Rangers FC (IA).

     

     

    There’s also David Oglivie. Name ring a bell? Yup, he’s the brother of Campbell Ogilvie, and is also the SPL Operations Administrator.

     

     

    I could go on, but I don’t think there’s any need.

     

     

    It’s about time this little cartel of Rangers FC (IA) employees, shareholders, supporters, players and directors was busted, for the good of the game.

    Many years ago we had a secret meeting with him, set up this incredible scheme in which he would takeover TFOD, bring them unknown success but unbeknowns to the great unwashed, he would use unlawful means (both in terms of SFA rules and certain tax laws etc…), all the while undermining the very existence of TFOD.

     

    Then when SDM began to flag, CW would be thrown into the fray and finally CG to ensure the grand plot is successfully completed.

    not only have I forgotten entirely about the FTT and surely that outcome is exactly what the footballing authorities including UEFA and FIFA are waiting upon. That decision alone along with the switcherooni surely decides whether a transfer or a new application will be submitted.     I would imagine that the football debts will also play a heavy influence on how the football authorities determine how they will handle sevco. Green and Whyte may already have helped setup the precedent in how they will be handled. I.e as a new entity or a swap.

     

     

    They start paying some of Oldco´s debts EVEN FOOTBALL DEBTS and the creditors will be all over them including HMRC.

     

     

    The Appellate tribunal I feel is being overlooked.

     

     

    Charles Green has ALREADY made the decision for Oldco to take the national association to court. That is still outstanding. Charles Green in this particular affair still has his hands very dirty indeed. Dirt that reeks of Oldco.

    SydneyTim, budget is set by the same rules as always: every penny that comes into the club over any business cycle will be spent. Celtic have been scrupulous in observing this rule for well over a decade and will continue to do so.

     

     

    The manager has some flexibility in how this cash will be deployed (more of fees, less on wages, more now, less later, or vice versa).

     

     

    I expect some movement both ways, although I didn’t see the comment from Neil you quoted.

    let me say this, i want celtic and all other clubs to be awarded the titles/ trophys lost if rangers are found to have run with dual contracts/ EBTs. it is unfair that rangers got to cheat and win, it is worse that, the would be winners were cheated and are not rightfully awarded their success even if it is retrospective.

    We do live in a banana republic with every twist and turn of this saga we see total transparency of how this bent / biased Scottish football governing body (mafia) is keeping alive a criminal organisation that stole money from the taxpayer and refused point blank to pay its debts, being helped at every turn by these associations who are ignoring / circumventing all their own rules to accommodate this one club. Earlier this morning someone rhymed off all the people from the SFA, SFL who have been caught cheating or have strong connections / bonds with this club, it is breathtaking to watch the audacity of these people as they work to save their beloved zombie RFC.

    Paul 67 – there needs to be an end to this saga some day soon.

     

     

    I’m not sure what else can be taken from Rangers, they don’t have a lot left – removing their titles and effectively their records – will hurt them a lot.

     

     

    At end of day football is about ‘on the field’ success to fans. We need to end this soon or be percieved as a spiteful lot. Remove their ill gotten records and draw a line under the sorry episode is enough for me.

  35. I like to use the phrase “the consequences to rangers are disqualification from those tournaments” instead of using the word punishment.

     

     

    A simple word or phrase like “we are being kicked when were are down”

     

    can give the perception of being victimized and it only heightens the lack of personal/corporate ownership for the past.

     

     

    Papers and phone-ins work this way. it leads the reader on a path of their own perception while they can keep clean hands.
