I caught an online synopsis of Rangers’ owner Craig Whyte’s recent meeting with a group of the club’s fans last night. The group report that Whyte hopes, “’Rangers Football Club Plc’ could survive any administration event but feels it would not be the end of the world if it didn’t.”
We can all agree, it sure wouldn’t be the end of the world if that particular entity didn’t survive, although I suspect Mr Whyte is alluding to the possibility of a new club emerging. Celtic Quick News first raised the liquidation scenario back in October and explained a prepack route for Rangers Newco FC. If a football company goes into liquidation a secured creditor, in Rangers case this would be Craig Whyte, can retain control of key assets, such as the stadium, but would not own a football club which was part of any league structure.
In Scotland any Newco FC would have to apply for membership of the Scottish Premier League or Scottish Football League. A simple majority of the SPL board (three votes required) would be enough to vote a club into the SPL. The board currently has representatives from Celtic, Dundee United, Motherwell and St Johnstone, as well as SPL chief exec, Neil Doncaster. It is chaired by Ralph Topping, who only votes in the event of a stalemate.
If Rangers lose their tribunal against Her Majesty’s tax authorities (think of her underequipped soldiers), Celtic will not be the only club who will consider the commercial and competitive disadvantage they suffered while paying their taxes for the last 12 years, but they may be one of the few clubs that would survive without the sponsorship and TV income dependent on a club with the Rangers brand participating in the league. Celtic would vote against allowing Rangers into the league but I can see zero chance of Dundee United, St Johnstone, Motherwell or Neil Doncaster doing the same. If the board voted Newco FC into the league, the liquidation of Rangers would not be the end of the world; a football club would die but another could quickly emerge at the same location, selling tickets to the same people.
Opening positions on what sporting cost Newco FC should face for league entry were taken months ago when it was reported that Rangers would fight “tooth and nail” against a 25 point penalty on a Newco. A 25 point penalty on the phoenix of a failed club after 12 seasons of financial benefit would be an insufferable insult. This amounts to little more than a the loss of a single league title. 12 seasons of benefit should result in a 12 seasons of penury at the insolvency-event rate of 10 points per season. Small cost for the enormous gift of a league place and a huge football franchise. The SPL must also strike from the record any financially doped titles won by clubs still in existence or not.
Can you imagine if Peter Lawwell said, “It wouldn’t be the end of the world if Celtic PLC didn’t survive”! There would be an impromptu media village outside Celtic Park that would rival the Obama inauguration in size. Huge story sitting on a plate just waiting to be written up. Or not.

Has anyone even tried to ask the SCOTTISH FOOTBALL FANS opinion on the idea of a newco getting voted in by club chairmen or a panel of suits .
Would it be possible to set up an opinion site for ALL SCOTTISH FOOTBALL FANS not just Celtic/ragers
If the FTT goes against them ,could all the relevant facts of the wrongdoing and financial/title/cup gains

Scottish football is at risk, the stake of the game, the integrity etc is all very emotive language but will mean very little when this comes up for discussion.
Many believe that Scottish football will be “ruined” if Rangers can’t play Celtic four times a year. Football is finance and for all the calls for fairness etc will be outgunned for the essential need of money for Scottish football clubs.
The only way I see a Rangers Newco not being allowed into the SPL is through threats of litigation from other football clubs.
I think the biggest factor in all of this was the ESPN/SKY deal that Doncaster brokered last year, with the wee clause about the 4 O– F—- games as a pre-requisite to the deal.
That to me was for nothing less than to point out to the rest of the teams in the SPL if TFOD is not allowed back in, yer no gettin’ any pocket money.

I have been thinking. I do not know the answer but maybe some of our lernered friends on here (or on the RTC blog) will have some answers.
Is there any competition law rules that could apply? I am just thinking if there was any legal risk to the boards of clubs voting to have Newco back in the SPL?
Any ideas for avoiding a stitch regards newco IMO exist outwith these shores Uefa is the place we need to look to .

I agree with the your conclusions.
Going via the General Meeting of remaining members passing a Qualified Resolution makes the whole process a tad more difficult. If Celtic will vote against Newco it might just take a mad Vlad moment or a Hibs in fear of relegation with no guarantee of coming back up.
Why would any club being relegated, with the uncertainty of not knowing if the will ever get back up vote for the Newco’s direct re-entry.
To keep all parties happy their would need to be agreement and vote for an increase to league structures; an SPL 2; or some other manifestation to accommodate theNewco.
If this happens Scotland will become the laughing stock of Scottish football.
Surely there is the possibility there could be legal recourse from small shareholders of all clubs which could throw the whole thing up in the air.

I agree that this kind of decision would require a meeting of all the member clubs, my fear and MWD hints at it, is Celtic PLC might be trying to duck out of the decision to veto NewCo by leaving the vote to the sub-committee. It then can say to fans we kept our integrity and did what the fans wanted but we were out voted.
But if the decision has to be taken by all the clubs and qualified majority voting is applied through the 90% rule then clearly our representative would kill off NewCo, which they might not want to do or have that responsibility.
That is why I have said to Auldheid that we should call an “open meeting” of as many supporters’ groups and individuals as we can and discuss what the supporters want to see happen and transmit our feelings to the Club.
This is a massive issue if not a defining issue for our club we have to do the right thing, and to do that we have to decide our course of action,we must have our say on this.

I think it is a bit premature to call a open meeting to discuss something that may not happen although I imagine the individual associations will be thinking about their own positions based on the strongest emerging possibilities by way of contingency preparation.
If as is alleged the future of Scottish football depends on TV revenue and given that this is the main argument for admitting a Newco Rankers to the SPL surely at the very least along with an annual points deduction for x seasons Newco H*N FC should not receive any income from TV revenue for an agreed number of seasons with a minimum term being determined by the number of championships that the recently defunct RFC won by illegal means. The money saved would be distributed evenly between the teams that finish in the lower half of the SPL – out with Newco H*N FC. In other words they would have no income stream apart from what they could generate themselves which in the current financial climate would be hee-haw.

It strikes me that the timing of all this may be crucial. If Hibs are relegated and promotion confirmed when Newco issue is put to the SPL, apart from Celtic all ten teams would financially want Newco.

Guys, my ten pence worth to the argument.
If we agree that the minute OldCo Rangers goes a vacancy opens up, then I would remind you all of an SFA regulation.
The team at the top of the First Division will AUTOMATICALLY be allocated a place in the SPL. That is immediate, if the league is in close season and it becomes binding for the following season if a club dies whilst the season in motion.
Now, that rule is set in stone. Relegation will be suspended and the top club in the First Division promoted as a matter of course.
There would be, therefore, NO VACANCY in the SPL. Where is the debate here? No vacancy will exist, the second OldCo Rangers disappears, and if I were either the club relegated to make way for them or the club which was not promoted in their place I would be taking it to the Court of Arbitration in sport and screaming from the rooftops about how corrupt Scottish Football is.
Rangers have two options, IF the rules are applied.
1) They can start from the bottom, as the rules dictate. The vacancy which opens up will be in the Third Division. It is that simple. If they are starting anew this is where they begin.
2) They can “do an Airdrie” and buy an existing club, wipe out it’s history and assume its identity and dispose of its assets as they see fit, although having bought Sandaza today and accepted their new level maybe they’ll opt to retain the first time squad and have done with it.
The fact is, there will BE no vacancy in the SPL … and that is just a plain and simple fact that no-one is going to be able to get around.
So now Clyde are reporting the No room for negotiation line.
But Doomsday Dawwyll and Guidi saying they WERE TRYING to negotiate recently.

Ok another daft suggestion. If our board are indeed complicit in the automatic reinstatement of the reincarnation of the H*Ns to the SPL and if the rest of the SPL go along with it what about threating that the entire Celtic support will refuse to attend domestic away fixtures – the infamous boycott in other words – quite an apt term given its historical context. If it is all about money let’s see how the TV companies react to televising games with no atmosphere. More importantly I believe a continued boycott would have a serious financial impact on other SPL clubs. Didn’t we fill Dunfermline’s ground last week? Attendances in the SPL are at an all-time low a mere 1600 people attended a game between St Johnston and Aberdeen a few weeks back – that is terrible even if one factors in an early kick off. I would also suggest that along with the boycott that all Celtic supporters cancel subscriptions to Sky / ESPN etc.
Together we are strong.

The honorable an ethical thing to do would be to allow an application from Newco to be processed that if agreed would let them work their way up the divisions starting with a clean bill of health.
However if a Newco were to start off in the SPL playing at Ibrox in light blue they might be Newco to HMRC and the legal world, but in the eyes of the football supporter they will still be Oldco, still dodging their taxes by name change with no sign that their dodgy nature had changed. Indeed quite the reverse with all the evidence pointing to their incorrigiblity.
This perception is the reality lense through which they would be viewed by supporters and the only way that it could change would be for Newco to offer some indication of contrition, like accepting that Oldco had won titles by doubtful financial means, that they had misused the rules when it gave them advantage and that they fully supported the change agenda on referees, licensing and fit ownership to prevent it happening again.
They could also change the perception of being incorrigible by agreeing that the titles won from 2000 were the result of their financial chicanery and recommend to the SPL/SFA that they be removed from Oldco’s records. These “sanctions” need not be imposed but volunteered by an SPL NewCo. Given that as a Newco they could not play in Europe for three seasons this might take away the need for a points penalty (as long as no SPL team finishing below them were not denied access to Europe as a result) as well as encouraging them to operate sustainably.
There is a pound of flesh to be extracted in return for any admission to the SPL and every ounce needs to be given up.
The underlying problem with this suggestion is an admittance by Rangers and all who support them of wrong doing, something they appear mentally incapable of doing.
Given the choice of contrition or starting again fron D3 , I think they would choose the latter and rally around a false sense of victimhood rather than be contrite, but hard choices must be presented to them so that they do not miss a metanoia opportunity.
