Ogilvie was born for this moment as SFA to consider expelling Rangers

877

Although Rangers won their case at the Court of Session today, they have the option not to serve the ruling on the SFA that its Judicial Panel’s 12 month ban on player registration is illegal.  Winning the point in law might sound like a victory, but taking the Association to court breaks membership rules of the SFA, rules imposed on all associations by Fifa.

We will find out soon enough the reach of SFA president, Campbell Ogilvie, who was one of the recipients of an EBT which precipitated Rangers crisis.

Rangers are deep in Sion territory now.  Either they walk away from this showdown, the SFA expel or suspend them from football, or Fifa will shortly remind the SFA of their duties when a member club takes action in the civil courts.

Campbell Ogilvie was born for this moment; it justifies him holding onto his position all these months despite being “heavily conflicted”, according to his chief executive.  I do not expect this to end well.

Despite an independent judicial panel ruling against Rangers, there is no way the office holders at the SFA will expel Rangers, no matter what they do. They would rather jeopardise the Scotland national team and every other club’s European participation.

    to be outside of the

Significant FIFA story shortly from the BBC’s @richard_conway – across all BBC outlets.

  6. If I am correct in the Sion case the Swiss FA were told to ignore the ruling by FIFA/EUFA and advise Sion if they did not accept ban they would be expelled.

I am sure that this will be the same here. The SFA rules are not ‘the law’ and they can made/change the rules of their club. The ruling is saying that the ban was not one of the sanctions and it should go back to the appeal stage. If it does that then it is accepting the civil courts can legislate in the FIFA/SFA rules and I am sure FIFA would not allow that.

Presumably the SFA can ignore the ruling say it intends to apply the original sanction and if RFC(IA) do not like it they can leave or be expelled. Of course the SFA could appeal the COS decision but would this fall foul of FIFA.

Someone tweeted that FIFA were asking SFA to stop court action. Could this be that RFC(IA) were to be told accept ban or we toss you out.

Interestingly I would have expected a statement from SFA on the outcome as surely they must have discussed their response regardless of the outcome. If they have not is really just shows the lack of leadership.

    Quote:

A statement from FIFA read: “At the time of writing we have not received any communication from the Scottish FA.

“In such a case, FIFA will ask the Member Association to take action so that the club withdraws its request from the ordinary courts.

“As a general rule, in case a club is seeking redress in front of ordinary court, as mentioned above the Member Association shall take direct action in order to safeguard the principle laid down in art. 64 par. 2 of FIFA Statutes, which shall be, in view of art. 64 par. 3 incorporated in the Member Associations’ Statutes.

“FIFA will closely monitor the situation so that the issue is resolved as fast as possible.”

  9. As Chairbhoy has suggested above, now is probably the time for the SFA to hit them heavy with charges relating to their other misdeeds.

Why not also withdraw that rather lenient audited accounts extension while they’re at it.

Is there something to stop the non corrupt clubs from starting their own new FA and applying to FIFA/ UEFA for membership in this scenario?

150 years of history (failure mainly) of the national team is all that would be lost. A kind of international Newco if you like.

Or is there some mechanism by which a corporate coup d’etat can be arranged with non corrupt member clubs taking officials?

Over and above that I think Ogilvie will, despite what Paul67 says (or maybe because of it) walk the plank. Regan is not stupid.

  17. Is this Bosman Mk2?

If the SFA fail to enforce the punishment that they handed down for Rangers’ years of cheating every other club in the SPL, as well as their failing to pay for many of the players that they signed onto illegal contracts, then surely it is carte blanche for clubs in Scotland and throughout the world. Celtic can simply go on a signing spree, agreeing ridiculous fees for all the top players, offering them huge tax-free contracts that do not comply with any football regulations, with-holding the monies due to both the selling clubs and the tax authorities. We’d have such a strong team that no other club in our league could get near us, and we’d win all the trophies every season. And when anyone manages to sue them for their impropriety, simply threaten to wind the club up and re-form as a NewCo, with direct entry back into the top division… because the other clubs can’t survive without us.

It seems to me that FIFA will oblige SFA to ignore court ruling, and further punish Rankers (IA) for taking the matter to court in the first place. So, transfer ban will stand and further punishment to follow. What’s not to like?

Forgive me if I’m missing something, but what legal recourse (if any) do the huns have if the SFA ignore todays ruling and keep the ban in place??

  27. Lets make no mistake here, we are in the footballing equivelent of the first day of all out nuclear war, and the hun have fired their weapon, what will follow as sure as day follows night will be retaliation, this will result in one of the following

    1. The SFA act swiftly (today!) suspend the hun pending a move to expel them and Uefa tell their gunners to stand down, the hun are then duly expelled and spend the next 5 years in various court cases whilst a new club set up by their fans plays as Govan Rangers, or something similar. Celtic play another year in scotland and then quietly buy out Portsmouth or another….

    2. The SFA dont act, waiting for “clarification” allow rangers to escape via a newco and start signing players under appeal – Uefa suspend the SFA’s membership and all Scottish teams are banned from european football

    3. The SFA rattle a few sabres at Rangers, tell them to take their medicine and tell them not to worry because when this blows over everything will go back to normal, Uefa give the SFA time to get their house in order and threaten a ban if they dont, nobody loses their job, Rangers get off with it and we are all expected to accept it as the status quo

It will take a brave man to bring the house down around the SFA, but Peter Lawell is a very brave man

    Monaghan1900,

I seen someone asking for that info earlier, then low and behold Celtic Research post it.

So why wasnt rule 95 offered in court, by the sfa

  29. mmm….. reading between the lines, i think celtic have given Rankers enough rope to hang themselves. We have heard very little from the club from PL or DD, me thinks they are working on the best parachute available whether that be England or elsewhere, hence Paul67 asking about teams in one country playing in another. Precedents have been set and if our league is tainted with corruption and integrity and dignity have been found wanting, then the SPL & SFA will be under sanction and we leave them to their own devices. We have played by the rules and been cheated for a decade at least a compelling arguement in my book. UEFA could surely not expect us to stay in a corrupt association and we all know the emphasis they put on “Fair Play” and Platini with his new rules etc.

Celtic are also able to play their trump card “us” two awards from UEFA & FIFA for 80,000+ fans in Seville not a hint of trouble but friendship & sportsmanship. The direct opposite of Rankers in Barcelona & Manchester, we have a very good case in imo and the inaction of our governing body leaves Campbell holding a lit cannonball and he doesn’t know whether to throw or sit on it.

Maybe DD has is get out of jail free card all thanks to what the MSM called our “paranoia” wouldn’t that be ironic!!!
