Players have “no loyalty to the new club”

The notion that Newco is the same as Oldco took a bit of a battering yesterday from two employees of Rangers Football Club PLC, Steven Naismith and Steven Whittaker.

Naismith said, “I am extremely proud of the actions we took but I am disappointed and angry that Rangers Football Club no longer exists in its original form.”

“My loyalty is with Rangers, not with Sevco, who I don’t know anything about.

Whittaker got straight to the point, “We owe no loyalty to the new club. There is no history there for us.”

“No longer exists”, “no loyalty to the new club”, “no history there for us”.  Ouch.

Sevco chief, Charles Green responded by confirming he had received guidance from the Scottish FA on the transfer of player-employees from one club to a successor club/company.  Curiously he didn’t suggest the SFA backed his position that he was entitled to force players to become employees of Sevco, instead confirming only that there was an appeal route open to him:

“The Scottish FA has been considering the issue and has issued a preliminary guidance note on registration issues. That note has made it clear that it is open to the club to challenge the actions of the players.”

Perhaps emboldened by his precedent-making Court of Session challenge to the SFA which passed without censure from the Association, Green threatened to do so again:

“We have no wish to go to court on these matters but the players involved, their agents and clubs who may be pursuing these players should be in no doubt that we will do whatever it takes to protect the club’s interests.”

This is what happens when the SFA declines to pursue a club for raising actions in the civil courts.

  1. The final sentence makes you wonder why Duff&Duffer agreed to sell to Green for such a ridiculous price and have it legally binding.

     

     

    Portsmouth’s creditors have voted in favour of Balram Chainrai’s Company Voluntary Arrangement proposal at Monday’s meeting at Fratton Park.

     

     

    He now has 28 days to make good on the proposal, and start the process of bringing Pompey out of administration.

     

     

    But the decision does not mean the end of the line for the Pompey Supporters’ Trust, who had submitted a rival offer.

     

     

    If Chainrai takes Portsmouth over, the PST can do a deal with him directly to buy the club.

     

     

    Alternatively, if the PST put a better bid together over within the 28 days, then administrator Trevor Birch can choose them to take the club forward, irrespective of the creditors’ decision.

    Pirlo was the outstanding player last night, even before that penalty.

     

     

    At 33 he’s a player that continues to impress at the highest level. He looks to have the same durability as the likes of seedorf/giggs/Scholes etc.a genuine class act. Amazing how some players continue to improve with age, e.g Larsson. I suppose they are the true professionals in the game!

     

     

    I do fancy Germany to beat Italy in the semi mind you. I expect Portugal to give Spain a run for their money in the other semi.

    “Turkish club Bursaspor have been cleared to participate in the 2012/13 UEFA Europa League following a decision taken by the Court of Arbitration for Sport (CAS) on 22 June 2012. The club had been suspended from European competition for one year and fined €50,000 by the UEFA Appeals Body on 30 May 2012 for overdue payables for transfer activities dating back to 2007.

     

     

    On 8 June 2012, Busaspor filed an appeal with CAS. Yesterday, the CAS ruling stipulated that Bursaspor be excluded from one UEFA club competition for which it qualifies in the next four years, but that this exclusion is suspended for a probationary period of three years. The club was also fined €250,000.

     

     

    UEFA has duly received and taken note of the decision taken by the Court of Arbitration for Sport (CAS) with regards to this case and, as the ultimate chamber of sports justice, UEFA respects both the authority and the decisions taken by CAS. Nevertheless, it wishes also to express its disappointment and surprise at the decision.

     

     

    While the grounds for this decision will be examined with great care by UEFA, once they are made available, UEFA reiterates that it will continue to enforce its rules on club licensing and financial fair play in a strict and fair manner, and with all necessary due diligence.

     

     

    UEFA is of the firm opinion that it is imperative for clubs to pay their debts to other football clubs, and will remain vigilant to ensure that this happens in accordance with the rules laid down in the UEFA Club Licensing and Financial Fair Play regulations. These basic principles of good conduct should be strongly supported, and not undermined, by any future rulings from CAS.

     

     

    This ruling by CAS therefore in no way affects the implementation of UEFA’s financial fair play rules, which UEFA will continue to implement both equitably and universally.

     

     

    UEFA underlines that the rules on club licensing and financial fair play have been supported by the entire European football community, and that compliance with the system is vital to safeguard the interests of clubs and players alike, as well as protecting the future sustainability of football in Europe.”

     

     

    Usual rhetoric – would be good to see UEFA act hard, fair and fast where required. The CAS process doesn’t always help but I suppose there is a need for an appeals system. However, none of this seems to apply to Scotland.

    “The Crown Office has today instructed Strathclyde Police to conduct a criminal investigation into the acquisition of Rangers Football Club in May 2011 and the subsequent financial management of the Club.

     

     

    “The investigation into alleged criminality follows a preliminary police examination of information passed to them in February this year by the Club administrators.

     

     

    “The Procurator Fiscal for the West of Scotland will now work with Strathclyde Police to fully investigate the acquisition and financial management of Rangers Football Club and any related reports of alleged criminality during that process.”

  17. Ticketus have formally launched legal action against Craig Whyte over money owed to them by administration-hit Rangers.

     

     

    Majority shareholder Mr Whyte has revealed he gave personal guarantees to the investment firm over capital issued to the club on the basis of future season ticket sales.

     

     

    Documents from a previous court case showed Ticketus had made two payments to Rangers, one in May 2011 and one in September, which were worth more than £30m when VAT was added.

     

     

    The initial payment, worth £24.4m in total, was used by Mr Whyte to pay off the club’s bank debt.

     

     

    With money from ticket sales last season clawed back, Ticketus are owed £26.7m, according to a report by administrators.

     

     

    A statement from the London-based firm on Friday said: “Ticketus today confirms that it has made demand pursuant to the guarantees provided by Craig Whyte and The Rangers FC Group Limited, formerly named Wavetower Limited.

     

     

    “In addition, demand will be made against Liberty Capital Limited.

     

     

    “These guarantees form part of the additional protection built into the ticket purchase agreement that Ticketus made with the club in May 2011.

     

     

    “As previously stated, Ticketus will claim upon these guarantees to recover any potential shortfall in monies owed to Ticketus by the club.”

    A criminal investigation will evidently take priority and could be used by the heavily conflicted lickspittles to delay commissioning other independent enquiries.

     

     

    6 months or more down the line, Strathclyde’s masonic finest announce that there is insufficient evidence to mount a prosecution then close their invovlement without any more damning info coming into the public domain.

    Rangers owner Craig Whyte offered to pay up to £15m should the club lose its big tax case appeal, according to Scottish FA documents.

     

     

    The SFA also reveal in its judicial panel findings that Sir David Murray had “no option” but to sell his 85% stake in the Ibrox club because of financial pressure, including his company Murray International Holdings being approximately £700m in debt.

     

     

    On Friday, the reasons for the sanctions imposed on Rangers for various rule breaches, including bringing the game into disrepute, were released.

     

     

    In the document, the panel noted that in takeover discussions Mr Whyte had given personal guarantees about his ability to pay off part of any tax bill arising from the first tier tax tribunal.

     

     

    The panel found: “The matter of a potentially adverse ruling in ‘the big tax case’ was discussed and Craig Whyte represented to [Rangers director] John McClelland that he would be prepared and able to meet any liability falling upon Rangers FC in that tax case up to a value of £15,000,000 from his own personal wealth.

     

     

    “Despite the representations made by Craig Whyte, the directors of Rangers FC were provided with no details or evidence of any financial matters or proof of funding or assets relating to Craig Whyte or his companies.”

     

     

    Mr Whyte did not attend or take part in the judicial proceedings which resulted in him being banned from holding an official position in Scottish football for life, as well as a £200,000 fine.

     

     

    Rangers FC were also fined £160,000 for bringing the game into disrepute, while they were also hit with a 12-month player registration embargo by the SFA for the various rule breaches. Administrators Duff and Phelps have appealed against the sanctions, which will be heard by a tribunal made up of Lord Carloway, Craig Graham and Allan Cowan next Wednesday.

     

     

    The judicial panel said it considered terminating Rangers SFA membership because of the seriousness of the rule breaches, but decided that the punishment was “too severe”.

     

     

    In its findings released on Friday, the SFA panel found that after Mr Whyte’s takeover the club continued to deduct around £1.2m a month in PAYE Income Tax from employees’ wages, but none of the money was handed over to HM Revenue and Customs., meaning that the business was run for ten months on unpaid taxes worth more than £13m.

     

     

    Ken Olverman, finance officer at Rangers, had his bank authority reduced under Mr Whyte, who would not allow him to sign cheques for more than £100. In August 2011 he was contacted by HMRC officials regarding invoices “for many millions of pounds” it had found relating to Rangers FC on the books at Ticketus. He claimed to have “no knowledge” of the invoices raised by the club in relation to the £25.3m Ticketus deal.

     

     

    The following month he saw the invoices and felt “the nature and format of the invoices was entirely different to that of invoices raised within the finance office of Rangers FC. He was of the view that it appeared as though ‘Clip Art’ computer processes had been involved in their creation. They did not appear to him to resemble any invoices he had ever seen issued by Rangers FC. Having sight of the invoices confirmed his view even further that they had not been created within the finance office of Rangers FC.”

     

     

    According to the panel, the invoices from Rangers to Ticketus for the season ticket deals “related to sums of many millions of pounds and the VAT element in each of them had been the subject of offset by Ticketus in the submission of its VAT returns for the last period. Such was the size and impact of this offset of VAT which had been paid by Ticketus in respect of these invoices, that Ticketus had made a claim for payment of a substantial sum to it by HMRC by way of recovery of VAT paid.”

     

     

    In the judgement issued on Friday, the panel said “the massive extent of the failure and the intentional and calculated manner” in which Rangers did not pay their taxes “aggravated the [SFA rules] breach even further.”

     

     

    The judicial panel said that Rangers’ directors and employees could not try to blame the mismanagement of the club on Mr Whyte. In its reasons, it added: “The question might be ‘What could they do?’ The answer is ‘They could have made public the activities of Craig Whyte of which they were aware or ought to have been aware.’ Their fiduciary duties owed to the company might for example have led them to disclose to the Plus Stock Exchange that no accounts were likely or that no AGM was likely to be held on account of the conduct of Craig Whyte and that there was a complete breakdown of the corporate governance of Rangers FC.”
