Police first creditor to react

Strathclyde Police were Rangers first creditor to ask for a payment guarantee from Rangers’ newly appointed administrator, saying, “Strathclyde Police is a public body and has a duty to make sure public resources are used appropriately. We are seeking an urgent meeting with the administrators to ensure that any payment for policing costs at future Rangers games is guaranteed.

“Until we have such a guarantee we would not be in a position to commit public resources to policing an event unless we had a reassurance that our costs would be met.”

Before the administrator is able to allow the scheduled game against Kilmarnock on Saturday to proceed he would need to guarantee payments for all services employed and goods used, casting considerable doubt on the game proceeding.  The administrator is liable for any expenses he incurs from now which cannot be paid by the club.

Funds will need to be found for turnstile and security staff, while footballers may be asked to play for free.

    Fantastic day yesterday and today. They are absolutely beeling. Have no sympathy whatsoever. Down with Scotlands “Second Largest Institution”…a truly horrible mob who won’t be missed.

     

     

    Not sure if this has been posted, and do not want to get too carried away, but when can we win the league?

     

     

    I assume that if we both win all our games (highly unlikely- there will be points dropped by THEM) then we can win the league with 4 games to spare?

     

     

    It could well be won before the split then no? We have the orcs on the 25th March, two games before the split am I correct?

     

     

    Wishful thinking, but I am also in the camp that we MUST not let this get to our heads, and remain focused and wrap up what will be a wonderful title.

    The “shame game” fuss was hot on the heals of strathclyde’s finest being told what their budget cuts were to be for the next year. The best way to keep up the OT, make sure there’s plenty of work, so they went to work creating work.

     

     

    The demise of rangers could see that backfire tho. with OT cuts and jobs shed at strathclyde polis. That might mean a reduction in council tax, giving glasgow residents more cash to spend helping to stimulate the econony.

    This is not true!

     

     

    Just because the HMRC rejected the CVA proposal put forward by Oddbins not that long ago does not mean that they have had any change in policy.

     

     

    They will approve a CVA if it is a properly structured, a well thought through plan and the company has been compliant with tax rules in the past. In their recent guidelines published at http://www.hmrc.gov.uk/helpsheets/vas-factsheet.pdf they set our their policy

     

     

    The HMRC agency that decided on these proposals is called the Combined Voluntary Arrangement Service (VAS). Currently it votes in favour of c70% of all proposals. However, we have a >90% approval record.

     

     

    Once a CVA is proposed the enforcement agency of the HMRC is no longer involved and have no say over whether a proposal is accepted or rejected. In essence the job of the enforcement agency is to collect 100% of the tax owed. If this is simply not possible then responsibility passes to the VAS.

     

     

    The HMRC are keen to support VIABLE businesses as they see it as a way of reducing lost tax.

     

     

    However, it should be noted that if you do propose a CVA then you should try and pay as much tax as you can prior to the creditors meeting. It is common sense really as if you are asking for their support then you need to be seen to be doing the utmost in persuading them your business is viable and that you will pay any tax owed in the future. We will of course advise on this aspect as and when we draw up a CVA proposal.

    Taxman to target firms who avoid debts using pre-pack administrations

     

    Tax officials have been given new powers to tackle rogue directors who avoid Crown debts by using controversial pre-pack administrations.

    From April, HM Revenue & Customs (HMRC) will be able to demand a security from companies when the taxman considers there is a “serious risk” that the business will try to dodge PAYE or National Insurance Contributions (NICs).

     

    The crackdown is targeted at business owners who deduct income tax and NICs from their employees’ pay packets “but have no intention of paying it to HMRC”.

     

    The tax office said these companies often build up “substantial debts” and then use a pre-pack administration to set up a new, debt free business – a so-called “phoenix firm” – to continue trading.

     

    Failure to pay the security – which can be a cash deposit or a bank bond – demanded by HMRC will be punishable with a fine of up to £5,000.

     

    HMRC said that the new powers, an extension of rules used to tackle VAT dodgers, will “not affect employers who have genuine payment difficulties”.

     

     

    Tax officials added that the “amount of tax at risk, the employer’s previous behaviour and other risks” will be used to determine the size of the security, but it will typically be either four or six months’ worth of income tax and NICs.

     

    About 400 companies are expected to have to provide a security in the next financial year, HMRC said.

     

    The move by follows a decision by the Government to scrap plans that would have overhauled pre-pack deals with measures designed to protect trade creditors from rogue directors using them to dump debts.

     

    Pre-pack administrations allow firms that are about to collapse to be restructured and sold to new owners – often the existing management – without the consultation of unsecured creditors.
