Policing as Celtic return to Lanarkshire

Celtic fans return to Lanarkshire on Saturday, just a few miles away from New Douglas Park, where Hamilton Accies and Celtic fans were both harassed while cooperating together to protest against the Offensive Behaviour’ Act.

The policing at Hamilton two weeks ago was politically motivated. It used recent legislation, ostensibly designed to protect society from sectarianism, to prohibit peaceful political protest. The concerted forces of the Scottish Government and Police Scotland has ensured that your freedom to stage peaceful political protest is been enormously curtailed in recent years – banners bearing the message “Accies against the Act” were confiscated.

If you were subject to any of the well documented police action at Hamilton, and intend travelling to Motherwell on Saturday, do not be surprised if you are singled out.

Fir Park Motherwell is a considerably more combustible venue than New Douglas Park. It has been the scene of vandalism, general hooliganism and a pitch invasion to taunt opposition fans in recent times. Police appear reluctant to get involved with fans for these activities at Motherwell. As a football fan, it is your political views you have to watch out for.

Before planning your trip to Motherwell it’s worth revisiting this comment by Brogan Rogan’ last week.

Also take a look at the Citizens Advice notice on police powers in Scotland. If police search you, even if no offence has been committed, they can seize whatever they want. Some pretty innocuous political dissent has been proscribed.  I’m appalled – and so are some officers I know.

    Is Ronny meant to ignore the large group of young away supporters who demand he does the three fist pumps at the end of every game? I think he is just acknowledging the supports efforts, in travelling and backing the team. It was not him who called it the “Ronny Roar”. I remember the Jungle, back in the day, demanding Peter Latchford and others that they gave us a wave. Were the players that responded cheap-imposters?

     

     

    Personally, I think the Ronny Roar is a bit naff, but no more than that. I don’t think it reflects on his abilities as a manager one way or the other. Just my opinion.

    Rangers join Souttar race

     

     

    RANGERS have been linked with a move for Dundee United defender John Souttar, just days after reported interest from Celtic.

     

     

    The 19-year-old, who can play in defensive midfield or central defence, has been courted by the likes of Arsenal, Southampton and Sunderland, with United accepting a £600k bid from the latter only for Souttar to knock it back.

    That’s right, Derek Riordan, who scored 95 goals in 245 appearances for Hibs, yet played just 24 games for Celtic, is an “Ex Celtic Star”.

    Yesterday the New Regime had hoped that the case brought by Charles of Normandy would be thrown out.

     

     

    Well, it didn’t really work out like that.

     

     

    What was decided in Edinburgh yesterday by Lord Tyre was that there IS a case to be debated, and it will require two days of court time to argue it out.

     

     

    The only glimmer of good news for the chaps in the Blue Room is that the day of financial reckoning was kicked down the road to another payroll cycle.

     

     

    Despite that there was certainly no rejoicing at the top of the Marble Staircase after the decision by Lord Tyre.

     

     

    All that the New Regime achieved yesterday was to spend rather a lot of money on legal fees and kick a much bigger fee down the road for another few weeks.

     

     

    What will not be in dispute next month in the Court of Session is that the current Ibrox club is a loss making business without a credit line from a bank.

     

     

    The case is scheduled to be concluded on Friday 13th November.

     

     

    It could be a black day for Sevco if the man with the big hands gets what he thinks is contractually due to him.

    FORMER Rangers owner Sir David Murray has seen a profits jump and a 54 per cent rise in value of his Murray Capital Group.

     

     

    It comes after MCG raised £11.8 million from the sale of its stake in the UK’s leading bus and coach builder Alexander Dennis, based in Falkirk.

     

     

    Murray’s firm reported a £13.6 million pre-tax profit and a 54 per cent rise in value to £35 million.

     

     

    Pre-tax profit in 2013 was a modest £48,000.

     

     

    Murray was part of a consortium which rescued Alexander Dennis in 2004.

     

     

    MCG acquired its key assets from Murray International Holdings between 2011 and 2013.

     

     

    MIH was wound-up earlier this year owing Lloyds Banking Group £200 million following debt write-offs of £268 million.

     

     

    MCG now has a turnover of £145 million, compared to the £170 million turnover of MIH in 2012, reports the Herald.

     

     

    MCG was 100 per cent owned by Murray in 2014, but during the current year he has “gifted” shares to close family members, though still maintains a controlling interest.

     

     

    Murray purchased Rangers in 1988, then controversially sold the club to Craig Whyte for £1 in 2011.

    Thanks for posting Phil Mc’s take on this, having read johnjames, Barcabhoy, other SFM aficionados, johnjames and other assorted comments including James Forrest’s I am of the opinion there are so many known unknowns in this case to make this debate little more than guess work, albeit sometimes informed guess work.

     

     

    Some folks on the SFM have done some good research though and for me two “facts” stand out…

     

     

    1 – Your Company cannot indemnify you from costs in a Criminal case where you are found guilty. This of course makes perfect sense legally

     

     

    2 – If you are convicted of a Criminal act while acting as an officer of a Company, that Company is equally liable.

     

     

    So from what I understand the accepted IB wisdom is…

     

     

    If RIFC win the case then Mr Green gets on with it and picks up his costs (appeals not withstanding)

     

     

    If Charles Green is correct and his costs in this case should be borne by RIFC then Newco pays for the reasonable Costs.

     

     

    Though if Charles Green is convicted the RIFC can retrieve those costs back from Mr Green.

     

     

    So sticking to the accepted wisdom…

     

     

    If RIFC doesn’t have to pay for Charles Greens’ costs this is good news for Newco.

     

     

    If RIFC does have to pick up the costs that is bad news for Newco and could be huge hindrance to cash flow, some say terminal.

     

     

    I’m not so sure, putting aside the $64,000 question(s). What happens in the event of Mr Green being innocent? What happens in the event of Mr Green being guilty – as point 1&2 suggests the repercussions could be huge but the point I’m pursuing is different.

     

     

    It involves another area of the accepted wisdom, that RIFC isn’t insured to cover the costs, the thinking goes… They would just have let the insurance Company pay up or that it would be the insurance Company and not RIFC that would be defending Mr Greens’ application.

     

     

    This I don’t accept, for me the idea that RIFC didn’t have insurance policies that covered their individual Directors or their Company I find hard to believe, in fact I’d find it almost inconceivable that such policies would be compulsory to get a Public Listing on the stock exchange.

     

     

    So bearing in mind that we believe Mr Green approached Mr King before his arrest and requested that RIFC pay his Legal fees as laid out in his compromise agreement we can speculate on the course of events .

     

     

    Of course Mr King stated the application would be “strongly resisted”, now you could say – he would say that anyway – yes he might but what about reality, there was a period of silence or even denial between the time Mr Green made his request and Mr King made his statement.

     

     

    What would have happened? Well once a request like Mr Greens’ is put forward the executive would get their Solicitors to look at the documentation and ascertain the merit/liability, if there was a possibility that they were liable before they get more costly Lawyers or Counsel involved they’d approach the Insurance Brokers to get their view.

     

     

    Now the Insurance company might advise they would reject the claim and that could be for a number of reasons, the policy(cies) didn’t cover Criminal cases, they don’t accept the specific charges pertaining to this case are covered in the Policy. Even if they did accept that they were liable, there would almost certainly be a cap, I would image someone in a CEO position would have a fairly substantial cap but what if it was say £500,000? I’ve seen estimates of multiple millions for the costs in this case (although I don’t accept that).

     

     

    The fact is there could be many reasons why the insurance company might not be biting at the bit to pick up this claim right of the bat. Which would compel RIFC to defend the application.

     

     

    But if my guess is correct and RIFC have Insurance, then it would almost certainly be capped at a high level for their CEO. So if Mr Green wins the case and a Law Lord says RIFC does have to pick up the costs, it is not impossible and to my mind quite likely that they could re-approach the insurers and insist with greater legal authority that it is they who pick up the claim.

     

     

    In other words the implications for RIFC may not be so dire if Mr Greens wins his case to have his fees paid as many including Phil and Johnjames are predicting.

     

     

    A guilty verdict in the Criminal case well may be an altogether different scenario.

    Yes, if we signed a striker on a permanet deal.

     

     

    Aberdeen have added to their squad (inc loans admittedly) and so far have stood toe-to-toe with us. I think that is largely down to our lack of planning and building a team they on the other hand have been building.

     

     

    The timetable of loans, really has worked against us and if Blackett and now Wilson join and become mainstays, we will be in the same situation in the summer as per Denayer.

     

     

    The evidence would suggest we do the opposite of planning and simply react after results eg the signings Jozo.

     

     

    Loans offer short term gain for mid term disruption.

    You make many many good points there and a great post by the way, but as you say, it’s all ifs and buts, lots of skeletons in cupboards, lies, finger pointing, accusations, and grand standing, scottish justice has been good to Sevco, in fact very good, and that’s not including the people who so called run our game, and I think they will continue to be good to them, as they should have been done, long long time ago, any other club or business in this country would be history, but not the, and they know it, and unfortunately deep down so do I.

    We will not be signing another striker till Stokes and scepovic move on. Or if they improve we won’t have to.

     

     

    We need another striker at CP and if it’s only gonna be young Wilson in January then so be it.

     

     

    I’d love to be only signing successes on long term deals but the reality of it is short term gain is better than no gain.
