Raith call out SFA plans for Appellate Tribunal

1262

You wonder if Ally McCoist rues the day he called for the public outing of members of the SFA Judicial Panel which imposed a player registration ban on his club.  One judge, one journalist and one football club, Raith Rovers, were soon outed.  Crossing the Fifers was a mistake.

Raith Rovers are now pointing out the same facts we have discussed here for months:

“We are also concerned that there has not as yet been an opportunity for clubs to receive legal advice from the SFL and/or debate the potential consequences on the smooth running of our league in the event that the Courts are asked to annull/strike down any of the corporate transactions that have led to the current position of Sevco Scotland Ltd as owners of certain assets of the Rangers oldco.

“Indeed, the position as regards the potential sanctions to be applied by the Scottish FA via its Appellate Tribunal has also still to be bottomed out.”

In short, Sevco’s ownership of Ibrox may be nullified by the courts and the SFA will be forced to subvert judicial oversight if it wants to guarantee Sevco participate in football next season.

While these concerns were only expressed online, the SFA were able to ignore the issue, but with Raith Rovers asking the questions Mr Regan will have to look SFL clubs in the eye and tell them what he’s going to do with Lord Carloway.

Lurgan 53

Dwyer O’Hagan, or Lurgan 53 as he was known here, passed away on Wednesday after an illness stretching back to last year.  Dwyer enjoyed our triumphs and defeats on the blog for many years and will be sadly missed by us all.  Our condolences to his family and friends.

  1. RIP Dwyer.

Was supposed to hook up with him in Jury’s hotel where we were both staying the night before the Glasgow derby a couple of New Years ago. My train from NW England was long delayed due to snow and it was near midnight when I arrived so the meet didn’t happen.

Very sad to read of his passing.

I have always felt the assets should have been sold to pay the creditors, and that sevco wouldn’t have a stadium……from what you are saying, the Liquidators will retrieve the assets through the courts……the gift that keeps on giving…

Jabba confirmed something I posted this morning ………. Sevco don’t even have a membership certificate for the Scottish Football League, which bars them from even ‘applying’ for a place in any league, let alone SFL Division 3 …..what’s your take on that..???

  5. Paul67,

It is very impressive that Scottish Football is standing up to the propaganda and I sincerely hope that all these smaller clubs are empowered to finish off the Gigantic Cheats.

I disagree with your vision of the future about us joining the lower English Leagues, I would not be aversed to it but I feel we have to Stay and build the Scottish game up again. I will be honest, I love being the underdog and beating All the odds. Our game was healthy prior to the financial dopers ruining the Scottish game.

You, more than anyone else, will know how well we have done in the market recently without spending any serious money and I am sure the fruits of this labour is still to be realised. Celtic are so progressive in so many ways, I would feel very uncomfortable about going into that setup (Top League) where we would be paying players £100000+ to make up the first team. It doesn’t quite sit right.

All Scottish Football fans are sick of Sky and their pathetic attitude towards Scottish Football. Scotland is a nation that loves football and that should never be forgotten, we have hit the bottom because the Cheats we are allowed to prosper. Scotland has said No in so many ways and it is now time to rebuild it back to where it really should be, Celtic will be the guiding light in this process.

    Keep up the superb work.

Never had the privilege of meeting you my friend in Celtic. However, we did exchange the odd posts over our views, I do not recall having differing views.

You may not have been on earth as long as the club that existed between 1872-2012. However, they went before you, damned as being the most bigoted football club in the history of our game. Your passing will affect many who will miss you but they will be consoled by the memories you gave them and by those who shared them.

You are in a better place now, I’m sure of that. May God Bless your Soul, your family and friends.

The key function of the liquidator, in terms of the Insolvency Act 1986 section 143(1), is to “secure that the assets of the company are got in, realised and redistributed to the company’s creditors”. As you indicate, if there has been any transfer of the assets of RFC(IA), such transfer may be challenged by the liquidator. At present, therefore, Sevco faces the very real prospect of being without a training ground or a place to play. How can the SFL be asked to make any decision on admitting them under these circumstances?

Agree with you…….we must stay in Scotland…….

  11. Thindimebhoy on

When Regan mentioned “social unrest” it was a threat to the SFL what he really meant was they are to be treated differently to anyone else. Like the banks are they also too big to fail because they are part of the fabric of Scottish society and even if they cheated the society that gave them succour we must accommodate them.

What does it say for our society when we must accommodate cheats and bully boys at the expense of integrity?

I believe in the 1930s Germany people in political authority felt compelled to vote yes to things they did not like or agree with National Socialism because of fear and intimidation.

Has anyone asked Regan was he basing his social unrest theory on the oldcos previous across Europe and the UK or was it a carefully planned rhetoric to alarm and strike fear into anyone who votes no

While we wait on the SFL outcome I hope they do not forget that old phrase never truer than it is today ‘the only thing we have to fear is fear itself’ when the cast their vote

Thanks to Paul/CQN, Phil and RTC, we all know the rules, hurdles, punishment that should be applied to the old and newco. But for once we have a senior person in Mr Hutton bringing these issues out into the open, jabba knows this could be a large spanner in the works for newco, apply the rules and no newco anywhere.

His attack was the act of a coward.

Steve Pressley also commented on this. Saying the SFA will find a mechanism to project the newco into the SPL even if they finished 5th. Really good interview from Pressley, liked him playing for us and have now forgiven him for the defeat at Caley.

TBB posted a while ago that the level of Pro Youth player was going up big style and it is all set for a genuine recovery across the board.

Ogilvie, Regan and Doncaster will be forced out and the game here will start a good recovery.

We Must get all the current flavour of the month referees out as well. They are totally untrustworthy. And let the genuine refs flourish, Steven (no ph as well) Craven would be in there because he has Real integrity. Scottish football on All levels has been subverted by Cheaters. Where are we now in the FIFA rankings?

The RR statement is interesting in that it basically asks why are SFL clubs being asked to vote when there are outstanding issues for the SFA to address that could affect Newco’s future.

One issue the RR statement does not mention is that of the SFA granting Newco/Sevco membership of the SFA.

Now those application papers were handed in last week and no doubt will be used by SFA to reach a decision —- or will they?

One of the points to come out of the CST exchange with the SPL and SFA was that membership of the SFA is AUTOMATICALLY granted to a club that the SPL agree membership to (hence Sevco having to apply separately in case the SPL voted against as it did).

Now if the same automatic granting applies to a club given SFL membership, and it would be odd if it did not, then is this vote on 13th the SFA’s justification for automatically granting a membership when they could not do so under their own process?

If so then all SFL clubs should insist on the SFA making a membership decision BEFORE they are asked to vote and if the SFA say “yes” the SFL clubs should know on what basis.

Maybe RR should add this to their list of points the SFA need to clear up before the 13th?

Strategically placed puppets of the long game, the Old Guard are still pulling the string and Oldco dying means absolutely nothing until we have a root and branch clear out of the SFA and a total rethink about the game, sponsorship and the future of Scottish Football.

Regardless of Sevco kick a ball or not this season I doubt we will see any major change in the standard of refereeing for instance, I’m sure we will still be subject to many Honest Mistakes a lot of peoples noses are going to be out of joint after the death of oldco…
