Raith call out SFA plans for Appellate Tribunal

1262

You wonder if Ally McCoist rues the day he called for the public outing of members of the SFA Judicial Panel which imposed a player registration ban on his club.  One judge, one journalist and one football club, Raith Rovers, were soon outed.  Crossing the Fifers was a mistake.

Raith Rovers are now pointing out the same facts we have discussed here for months:

“We are also concerned that there has not as yet been an opportunity for clubs to receive legal advice from the SFL and/or debate the potential consequences on the smooth running of our league in the event that the Courts are asked to annull/strike down any of the corporate transactions that have led to the current position of Sevco Scotland Ltd as owners of certain assets of the Rangers oldco.

“Indeed, the position as regards the potential sanctions to be applied by the Scottish FA via its Appellate Tribunal has also still to be bottomed out.”

In short, Sevco’s ownership of Ibrox may be nullified by the courts and the SFA will be forced to subvert judicial oversight if it wants to guarantee Sevco participate in football next season.

While these concerns were only expressed online, the SFA were able to ignore the issue, but with Raith Rovers asking the questions Mr Regan will have to look SFL clubs in the eye and tell them what he’s going to do with Lord Carloway.

Lurgan 53

Dwyer O’Hagan, or Lurgan 53 as he was known here, passed away on Wednesday after an illness stretching back to last year.  Dwyer enjoyed our triumphs and defeats on the blog for many years and will be sadly missed by us all.  Our condolences to his family and friends.

  1. (i) That the Scottish Football League Members agree to admit Sevco Scotland Limited as an Associate Member and agrees to permit Rangers F.C. to play in the League during Season 2012/13.

this would then allow newco to apply alongside spartans etc… essentially my reading is that this is the no vote, am i wrong?

  2. stephbhoy,

I couldn’t agree more. Let’s hope thems’ demise will see a change of football philosophy and emphasis will be put on skill and technical ability rather than running power. To me, Hearts are primarily to blame for this since they had great “success” with this in the 86 season, when we beat them to the title on the very last day (and almost in the very last minute).

Just reading between the lines, I get the idea that they are on target related bonuses. If they get turnover to a certain value, they get cash in pocket. If losing Rangers cuts League turnover by £16m but also reduce costs by the same, none of the clubs lose out. Only the man at the top misses out on his cream

    Paul67,

The Raith Rovers statement indeed does ask some fundamental questions i suspect the “Reganator” man of “Reganomics” would rather not address.

I can see a legal challenge by a number of SFL clubs (Raith, Livingstone, Dundee/Dunfermline) if Zombie FC are shoe horned into SFL1.

    This should have been his immediate priorities before any attempts to get Zombie FC playing anywhere next season;

Reconvene the appellate tribunal ASAP, let them apply the sanctions that by the rules they have to apply (suspension or throw them out).

Expedite the SPL inquiry as a matter of urgency into the EBT cheating, pass judgement and apply punishment, hear any appeal that may arise.

Ask the question legally if the asset purchase is binding.

Only when these fundamental questions are answered and dealt with will Scottish Football be able to move forward, that is unless they have decided to sweep it all under the carpet at Hampden Park.

    What a mess….

(ii) That the Scottish Football League Members direct the Board of Management of The Scottish Football League (the “Board”) to provide that Rangers F.C. shall play in the Third Division of the Scottish Football League during Season 2012/13 unless the Board shall have to its satisfaction negotiated and reached agreement with The Scottish Premier League and The Scottish Football Association on a series of measures which the Board shall consider to be in the best interests of the game, how it is structured, how it is governed and how it is financed, whereupon the Board shall be authorised to provide that Rangers F.C. shall play in the First Division of the Scottish Football League during Season 2012/13…

My interpretation of the above is that the member Clubs are asked to direct the ‘The Board to admit the dead club into Division Three but if ‘The Board’ get what they are looking for ‘The Board’ will allow them into Division One.

In my opinion the member Clubs would need to be in receipt of the full facts i.e. what ‘The Board’ to perceive to be an acceptable package in order for them to allow dead club into Division One. If the member clubs having been given the full facts do not agree that the package is good enough, it is simple in my view is that the member clubs do not direct ‘The Board’ in this resolution i.e. allow dad club into Division Three. I believe that is the stance Raith Rovers have taken.

  9. I’m always disappointed that some people on a site like this always seem to blame Celtic for every ill, and seek to have us damage our own club, who have done no wrong, due to some tiresome conspiracy theories. Celtic are not, and never have been, guilty of tax avoidance, match fixing, or subverting football authorities. And I’m proud of that.

If they put them in Div1 it will seriously compromise the future of many clubs and split their supporters ….disaster! Turning fan v fan when the opportunity is there for progress .

RFC(IL)/Sevco will benefit as at a time when we should be moving on and they should be stranded they will relatively quickly catch back up on us as it will create a rift among our supporters regarding attending matches.

In some respects, Doncasters actions are more understandable, driven by his masters wishes and his own bonus.

Regan and Ogilvie are truly shocking – they have a wider responsibility for the integrity of the game in Scotland. I can only assume that Scottish and UK governments are guiding their hand – what else can explain the 180 degree turn by the SFA with respect to the independent panel verdict and the fact that inevitable future issues with regard to EBT’s etc. are being conveniently ignored?

I suspect that the Div 1 membership also comes with an amnesty???

Good comment and I agree with you.

Getting into the Celtic Academy is very hard to do no matter what the physical attributes. To be fair the community coaching is definitely geared towards the technical side of things from very young ages all the way through, Scottish kids have to develop the techniques all across the board and not just at professional clubs. I am sure Celtic will share all of their vast knowledge with all of the clubs to help transform the game in this country.

  16. It’s simple: let Sevco in and place them in division three. But let the Board promote them by two divisions if they get a big enough bribe.

They’ve given up on secret corruption and are now trying a far more open approach. If the SPL wants Sevco in division one it will have to pay up.

  17. Why does the document mention Sevco Scotland Ltd (correct) then say Rangers FC, when they don’t exist, Sevco haven’t bought Rangers FC name??

If the first proposal is rejected then it matters not a jot what happens, all following proposals are rejected too.

proposal 1 is a change in the rules and requires 66%

  25. Paul67 et al

The reference to Rangers FC should render everything in these proposals thoroughly redundant. Rangers FC still exists as an entity, albeit not one being addressed by either the SPL or the SFA. I can see real strength in the position adopted by Raith Rovers. Address the outstanding issues first, before any consideration as to whether or where, or indeed when, Sevco (if properly constituted as a Football Club) can be admitted to the SFL.

you do need to be at a good level to get into the celtic academy, but let me tell you a story, when my boy was there, there was a parent’s meeting called and tommy burns RIP was giving a presentation about progress through the system and the way training developed and at each level it showed emphasis being placed on technical ability training and physical training on a pyramid system and by the time the boys reach 18 or so the technical side was about 20% while the physical side was 80%, it was almost the reverse to age 11/12 year olds. i did not and do not agree with that. we also happen to offer english/ irish boys 3 year deals while offering scottish/ local boys 2 year deals when they are 16, which is the reason the boy wilde went to rangers.

wee james forrest was always a good player, but did not get offered a contact with celtic until he was 16 1/2 while others with less ability got offered deals of 2/3 years. his ability was never in question, his other atributes were. sometimes academy coaches need to focus on ability first then physical stuff will come and can be developed. high should not be a deciding factor when talking about footballers, afterall they are not playing basketball or airball.

there’s a change of mindset needed.
